JUSTICE R.M.DOSHIT\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 26\/03\/2009 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\t\tThis<br \/>\n application  is  made  by the accused under Section 482 of the Code<br \/>\nof Criminal Procedure, 1973 for quashing the proceedings in Criminal<br \/>\nInquiry Case No. 8 of 2006 pending before the Learned Judicial<br \/>\nMagistrate First Class,  Ahmedabad.\n<\/p>\n<p>2.\t\tRespondent<br \/>\nNo.2, Vinodbhai Somabhai Patel has filed the above referred criminal<br \/>\ncomplaint  before the Learned Judicial Magistrate First Class,<br \/>\nAhmedabad against the present applicant in respect of  commission of<br \/>\noffences  under sections 379, 380, 406, 420, 467, 468, 471, 120-B and<br \/>\n 114 of Indian Penal Code.  It is the case of the complainant that<br \/>\nthe complainant had purchased a residential flat from the accused.<br \/>\nHe had  made part payment in the sum of Rs. 5,90,000\/-.  The<br \/>\nremaining amount had not been paid as the accused  had not completed<br \/>\ncertain extra work and not parted with the title of the flat.<br \/>\nNevertheless, the  accused being Chairman\/Secretary of the Society<br \/>\nused to visit the complainant.  During one of such visits, he had<br \/>\nstolen certain blank cheques, had forged signature of the<br \/>\ncomplainant, written the details  and presented  to  the Bank.\n<\/p>\n<p>3.\t\tPending<br \/>\ninvestigation of the said complaint, the  accused has filed this<br \/>\napplication for quashing of the complaint.  Learned Advocate, Mr<br \/>\nDivetia has appeared for the complainant. He has submitted that the<br \/>\ncheques in question were issued by  the complainant against the sale<br \/>\nprice  of the flat.  As the cheques,  on presentation in the  bank<br \/>\nwere not honoured for want of sufficient funds, the accused  has<br \/>\nfiled complaint against the complainant under section 138 of the<br \/>\nNegotiable Instruments Act   in Satellite police station.  The same<br \/>\nis registered as M. Case No.1 of 2006.  The aforesaid complaint No.8<br \/>\nof 2006 has been filed by the complainant  in retaliation  to the<br \/>\ncomplaint filed by the accused.   The complaint filed in retaliation<br \/>\nof the complaint lodged by the  accused amounts to  abuse of process<br \/>\nof law.  It requires to be  quashed and set aside.  He has relied<br \/>\nupon the  judgment of the Hon&#8217;ble Supreme Court in the matter of<br \/>\n<a href=\"\/doc\/505047\/\">Mahindra &amp; Mahindra Financial Services Limited  &amp; Anr.<br \/>\nv. Rajiv Dubey<\/a>  (2009) 1 SCC (Cri.) 603).  He has submitted<br \/>\nthat in the similar set of facts, the Hon&#8217;ble Supreme Court quashed<br \/>\nthe  criminal proceeding.   Be it  noted that in the matter before<br \/>\nthe Hon&#8217;ble Supreme Court, the complainant against whom offence under<br \/>\nsection 138 of the Negotiable Instruments Act had been registered did<br \/>\nnot dispute that the cheques in question were issued by him.  In the<br \/>\npresent case, the complainant has  specifically alleged that the<br \/>\ncheques were not issued by him.  He has also disputed the writing and<br \/>\nsignature  on the cheques.\n<\/p>\n<p>4.\t\tIn<br \/>\nmy opinion, it is too early a stage to quash the complaint No.8 of<br \/>\n2006.  The complaint does   call  for investigation.\n<\/p>\n<p>5.\t\tFor<br \/>\nthe  aforesaid  reasons,  this application is rejected.  Rules is<br \/>\ndischarged.
