The  appellant  is the widow of one  Narayan  Naidu,  a<br \/>\nturner\tin gun carriage factory at Jabalpur.  On  15-4-1980,<br \/>\nit  was alleged, that he attempted to commit theft of 50  mm<br \/>\ngrill.\t On  17-4-1980, a charge memo was given.   On  26-6-<br \/>\n1980,  the General Manager appointed the enquiry officer  to<br \/>\nconduct\t an  enquiry  against him.  The\t delinquent  made  a<br \/>\nrepresentation\tto  higher  authorities\t that  the   enquiry<br \/>\nofficer was biased against him and requested to appoint\t any<br \/>\nother  impartial  person  to conduct  enquiry  against\thim.<br \/>\nInstead\t of acceding to the request, the higher\t authorities<br \/>\nhad directed the delinquent on 23-10-1980 to participate  in<br \/>\nthe  enquiry.\tOn 20-11-1980,\t24-11-1980  and\t 30-11-1980,<br \/>\nwitnesses  were examined ex parte.  But,  unfortunately,  on<br \/>\n14-12-1980,  the delinquent was set ex parte as he  did\t not<br \/>\nappear\tbefore\tthe enquiry officer.  On 5-3-1981,  he\tmade<br \/>\nanother\t representation\t to  recall  the  witnesses  already<br \/>\nexamined  for  cross-examination and to give him  a  further<br \/>\nopportunity   to  examine  himself  and\t his  witnesses\t  in<br \/>\nrebuttal.  The authorities directed the delinquent, by their<br \/>\norder dated 26-9-1981, to attend the enquiry when fixed\t and<br \/>\ncooperate  with\t the  enquiry  officer.\t  Pursuant  to\tthis<br \/>\ndirection,  as\tfound  from the\t record,  that\tthe  enquiry<br \/>\nofficer,  instead of reopening the matter and giving him  an<br \/>\nopportunity to cross-examine the witnesses already  examined<br \/>\nor  to examine himself as a witness or his witnesses,  by  a<br \/>\nletter dated 26-11-1991 has stated thus:\n<\/p>\n<blockquote><p>\t      &#8220;You  were advised to submit a  written  brief<br \/>\n\t      vide letter No. MWP\/ENO\/14318\/81, dated  27-8-<br \/>\n\t      1981,  by\t 10-9-1981.  No reply  was  received<br \/>\n\t      from   your  end.\t  However,  the\t  Presenting<br \/>\n\t      Officer  has  presented his written  brief,  a<br \/>\n\t      copy of which is enclosed.\n<\/p><\/blockquote>\n<blockquote><p>\t      You  are hereby given another  opportunity  to<br \/>\n\t      submit  your written brief  before  15-12-1981<br \/>\n\t      failing  which, it will be presumed  that\t you<br \/>\n\t      have  no written brief to be  submitted.\t The<br \/>\n\t      proceedings of the Court of Enquiry held, have<br \/>\n\t      already  been  sent  to you  vide\t letter\t No.<br \/>\n\t      MPI\/ENO\/149318\/80, dated 18-1-1981.&#8221;\n<\/p><\/blockquote>\n<p>3.   Therefore,\t the delinquent did not submit\this  written<br \/>\nbrief and an order of dismissal from service was passed\t and<br \/>\non appeal, it was confirmed.\n<\/p>\n<p>4. In the meanwhile, the delinquent died on 1-3-1985.His<br \/>\nwidow made a representation   for  payment  of\t gratuity,<br \/>\npension and otherretiral benefits and also     sought<br \/>\nalternative employment for her subsistence. Asregards<br \/>\npayment of gratuity, it has been paid though  belatedly,<br \/>\nbut the pensionwas  not\t paid on the  ground  that  the<br \/>\ndelinquent was dismissed from service.\tIt is said that\t the<br \/>\ndelinquent had since bee; dismissed from service, she is not<br \/>\neligible  for any compassionate appointment.  Her OA No.  85<br \/>\nof 1990 was dismissed by Central<br \/>\n<span class=\"hidden_text\">258<\/span><br \/>\nAdministrative Tribunal, Jabalpur on 26-4-1990 on the ground<br \/>\nof  multiplicity of causes of action.  Thus, this appeal  by<br \/>\nspecial leave.\n<\/p>\n<p>5.   While  issuing  notice  to\t the  respondents,  we\t had<br \/>\ndirected  the  respondents  to place before  us\t the  entire<br \/>\nrecord.\t A counter-affidavit has been filed and record\talso<br \/>\nhas  been  placed  before us.\tIn  fairness,  Shri  Kailash<br \/>\nYasdev, learned counsel for the Union of India, having\tgone<br \/>\nthrough\t the  entire record, has placed\t necessary  material<br \/>\nbefore\tus.  As seen from the narration of the\tfacts,\tthat<br \/>\nafter  the direction was issued by the Director\t General  in<br \/>\nhis  letter  dated 26-9-1981, the enquiry  officer  had\t not<br \/>\nrecalled  the  ex parte order dated 14-12-1980\tnor  did  he<br \/>\nrecall\tthe witnesses already examined on  20-9-1981,  24-9-<br \/>\n1981  and 30-9-1981 for cross-examination nor had given\t him<br \/>\nan  opportunity to adduce his evidence in rebuttal.  On\t the<br \/>\nother\thand,  it  is  clear  from  the\t  letter   extracted<br \/>\nhereinbefore that despite the direction issued by the higher<br \/>\nauthorities, the enquiry officer directed the delinquent  to<br \/>\nsubmit written brief, in other words, he proceeded from\t the<br \/>\nstage  where he last closed the proceedings.  That  was\t not<br \/>\nthe spirit of the order of&#8217; the Director General.  Thus,  it<br \/>\nis  a clear case of the violation of principles\t of  natural<br \/>\njustice.   It  is seen that right  through,  the  delinquent<br \/>\nofficer\t had entertained a doubt about the  impartiality  of<br \/>\nthe enquiry to be conducted by the enquiry officer.  When he<br \/>\nmade a representation at the earliest, requesting to  change<br \/>\nthe enquiry officer, the authorities should have acceded  to<br \/>\nthe  request  and appointed another enquiry  officer,  other<br \/>\nthan the one whose objectivity was doubted.   Unfortunately,<br \/>\nthat  was  not done.  Even after the  Director\tGeneral\t had<br \/>\ngiven an opportunity to the delinquent to participate in the<br \/>\nenquiry,  the  enquiry\tofficer obviously  was\texpected  to<br \/>\nrecall\tthe  ex\t parte\torder and  give\t the  delinquent  an<br \/>\nopportunity to cross-examine the witnesses already  examined<br \/>\nand  to\t adduce\t his evidence  in  rebuttal.   However,\t the<br \/>\nenquiry officer did not adopt the said procedure which would<br \/>\nhave been just, fair and reasonable.\n<\/p>\n<p>6.   Under these circumstances, it is a clear case that\t the<br \/>\ndelinquent  had not been afforded a fair  opportunity,\tmuch<br \/>\nless  a reasonable opportunity to defend himself.  That\t has<br \/>\nresulted  in violation of the principles of natural  justice<br \/>\nand  fair play offending Articles 41, 21 and 311(2)  of\t the<br \/>\nConstitution.\tThe orders of dismissal as confirmed by\t the<br \/>\nappellate   authority\tare   accordingly   quashed.\t The<br \/>\nrespondents  are  directed  to grant to\t the  appellant\t the<br \/>\npensionary benefits according to rules and also to  consider<br \/>\nher  case for suitable appointment on any post to which\t she<br \/>\nmay be eligible for rehabilitation, on compassionate ground.<br \/>\nThe respondents are further directed to pay the full  salary<br \/>\npayable to the deceased delinquent to the appellant from the<br \/>\ndate  on  which he was kept under suspension  till  date  on<br \/>\nwhich  he would have attained superannuation  or  28-2-1985,<br \/>\nthe  preceding date of his death whichever is earlier,\twith<br \/>\nall  consequential benefits after deducting the\t subsistence<br \/>\nallowance   already  paid,  right  from\t the  date  of\t the<br \/>\nsuspension  order  till\t date of  dismissal.   The  exercise<br \/>\nshould\tbe  done within three months from the  date  of\t the<br \/>\nreceipt of the order.\n<\/p>\n<p>7.
