No.531\/2009 whereby and where-<\/p>\n<p>                        under after rejecting a petition under Section 317 of the<\/p>\n<p>                        Cr.P.C. cancelled the bail bond and issued non bailable<\/p>\n<p>                        warrant of arrest followed with an order dated 24 th June<\/p>\n<p>                        2011 passed by the Additional Sessions Judge, FTC-V,<\/p>\n<p>                        Bhagalpur in Cr. Revision No. 359 of 2010 whereby and<\/p>\n<p>                        where-under the Revision petition has been dismissed.<\/p>\n<p>                                    The instant petition has been filed invoking<\/p>\n<p>                        inherent jurisdiction vested with this Court under Section<\/p>\n<p>                        482 of the Cr.P.C. Submission is that on 20.08.2010<br \/>\n<span class=\"hidden_text\">                  2<\/span><\/p>\n<p>though the case was posted for framing of charge but due<\/p>\n<p>to some exigencies petitioners were represented under<\/p>\n<p>Section 317 of the Cr.P.C which was not moved on<\/p>\n<p>account of slackness of conducting Advocate as well as<\/p>\n<p>having the prayer simultaneously to grant adjournment<\/p>\n<p>on the ground of ailment of conducting Advocate so that<\/p>\n<p>they could file a petition for discharge, the same was<\/p>\n<p>rejected by the order impugned resulting cancellation of<\/p>\n<p>bail bond followed with issuance of non bailable warrant<\/p>\n<p>of arrest.\n<\/p>\n<p>             It has been submitted on behalf of the<\/p>\n<p>petitioner that the composite order rejecting the<\/p>\n<p>representation petition filed under Section 317 Cr.P.C<\/p>\n<p>and cancelling the bail bond is non permissible in light of<\/p>\n<p>the judicial pronouncement by this Court reported in<\/p>\n<p>2009(2) PLJR 260 as well as 2011(3) PLJR 286. So<\/p>\n<p>submitted that the order impugned happens to be bad in<\/p>\n<p>law and is accordingly fit to be set aside.<\/p>\n<p>             On the other hand, learned APP opposed the<\/p>\n<p>prayer and submitted that the accused-petitioners<\/p>\n<p>adopted dilly delaying tactics just to linger the<\/p>\n<p>proceeding as on previous date alone they were directed<br \/>\n<span class=\"hidden_text\">                  3<\/span><\/p>\n<p>to be physically present for framing of charge. That<\/p>\n<p>means to say, they were all aware with the intention of<\/p>\n<p>the Court.\n<\/p>\n<p>             Whether the Court is competent to reject 317<\/p>\n<p>Cr.P.C and simultaneously empowered to cancel bail<\/p>\n<p>bond, for which I would like to refer paragraph-16 of the<\/p>\n<p>decision reported in 2009 (2) PLJR 260;<\/p>\n<blockquote><p>              &#8221; Section 317 Cr.P.C. provide for<br \/>\n       inquiries and trial being held in the absence of<br \/>\n       accused in certain cases. However, if the<br \/>\n       Magistrate finds that personal appearance of<br \/>\n       the accused is necessary, he would direct that<br \/>\n       accused would no longer be represented on the<br \/>\n       next date by a pleader under Section 317<br \/>\n       Cr.P.C. but would appear in person. If the<br \/>\n       accused in spite of such order does not appear<br \/>\n       in person, it would be open for the learned<br \/>\n       Magistrate to issue warrant of arrest and<br \/>\n       proceed in accordance with the procedure<br \/>\n       prescribed in Chapter-VI of the Cr.P.C. and<br \/>\n       may also cancel bail and bail bond and proceed<br \/>\n       in accordance with Chapter-XXXIII of the<br \/>\n       Cr.P.C. It does not appear from the order of the<br \/>\n       preceding dates i.e. 31.1.2008, 26.3.2008 that<br \/>\n       personal attendance of petitioner would no<br \/>\n       longer be dispensed with, and he is required to<br \/>\n       attend in person. The Magistrate in view of<br \/>\n       Section 317(1) Cr.P.C. ought to have given an<br \/>\n       opportunity to an accused to appear in person<br \/>\n       who was being allowed to be represented<br \/>\n       through a pleader. The order of preceding dates<br \/>\n       in the case on the contrary shows that<br \/>\n       Magistrate in fact accepted the representation<br \/>\n       under Section 317 Cr.P.C. The Magistrate has<br \/>\n       to follow the procedure prescribed therein, if it<br \/>\n       does not dispenses with his personal attendance.<br \/>\n       A Magistrate while rejecting a representation<br \/>\n<span class=\"hidden_text\">                           4<\/span><\/p>\n<p>                 under Section 317 Cr.P.C cannot at the same<br \/>\n                 time cancel bail bond and issue non-bailable<br \/>\n                 warrant of arrest if on preceding dates has not<br \/>\n                 clearly directed that personal attendance under<br \/>\n                 Section 317 Cr.P.C. will no longer be dispensed<br \/>\n                 with. The Court ought to provide a reasonable<br \/>\n                 opportunity to the accused to appear in person<br \/>\n                 whose representation was earlier being allowed<br \/>\n                 under Section 317 Cr.P.C.. In this case it<br \/>\n                 appears that trial lingered as a co-accused Prem<br \/>\n                 Prakash was absconding. Learned counsel for<br \/>\n                 the petitioner has also submitted that there have<br \/>\n                 been no laches in his part.\n<\/p><\/blockquote>\n<blockquote><p>                     From the aforesaid citation it is evident that<\/p>\n<p>         the learned lower court was wrong in his action while<\/p>\n<p>         rejecting petition under Section 317 of the Cr.P.C.\n<\/p><\/blockquote>\n<blockquote><p>         simultaneously cancelling the bail bond and issuing non<\/p>\n<p>         bailable warrant of arrest. The same principle has also<\/p>\n<p>         been reiterated subsequently in 2011(3) PLJR 286.\n<\/p><\/blockquote>\n<blockquote><p>                     In the aforesaid facts and circumstances, the<\/p>\n<p>         order impugned is set aside.
