JEEVAN REDDY, J.- Leave granted.  Heard counsel for the<br \/>\nparties.\n<\/p>\n<p>2.   This  appeal  is preferred against the  judgment  of  a<br \/>\nlearned\t Single\t Judge\tof the\tMadhya\tPradesh\t High  Court<br \/>\ndismissing   the  civil\t revision  petition  filed  by\t the<br \/>\nappellant.   The  civil\t revision  petition  was   preferred<br \/>\nagainst the judgment of the Third Additional District  Judge<br \/>\nto  the Court of District Judge, Bilaspur in Execution\tCase<br \/>\nNo.  17-A of 1970 whereunder the learned Judge\thad  allowed<br \/>\nthe application filed by the respondent-judgment debtor.\n<\/p>\n<p>3.   The appellant-decree-holder, Madhya Pradesh Electricity<br \/>\nBoard, is a statutory corporation constituted under  Section<br \/>\n5  of the Indian Electricity Act, 19 1 0. The Government  of<br \/>\nMadhya Pradesh had granted a licence to the respondent under<br \/>\nthe  said  Act for generating and supplying  electricity  to<br \/>\nconsumers  at Bilaspur.\t The appellant exercised the  option<br \/>\nof purchasing the respondent&#8217;s undertaking on 15-1-1963\t and<br \/>\n5-4-1964 as provided by Section 6 of the Act.\tAccordingly,<br \/>\nthe  possession\t of  the undertaking was  delivered  to\t the<br \/>\nappellant but while doing so, the respondent did not deliver<br \/>\npossession  of\tproperties  described  in  Schedule  1\t and<br \/>\nSchedule  11 to the plaint.  The appellant  was,  therefore,<br \/>\nobliged\t to  file  the\tCivil Suit  No.\t 17-A  of  1960\t for<br \/>\nobtaining  possession of the said properties on\t the  ground<br \/>\nthat  they  form  part of the  undertaking.   The  suit\t was<br \/>\ndecreed by the trial court on 25-8-1973.  The respondent and<br \/>\nsome other persons preferred an appeal to the Madhya Pradesh<br \/>\nHigh  Court  being  First  Appeal  No.\t39  of\t1974.\t The<br \/>\nrespondent  raised a contention in the said appeal that\t the<br \/>\nproperty mentioned in Schedule 11 to the plaint was sold  to<br \/>\nother  appellants and, therefore, did not form part  of\t the<br \/>\nundertaking.  This plea was rejected by the High Court which<br \/>\nheld  that the property in both the Schedules did form\tpart<br \/>\nof  the undertaking.  While dismissing the appeal  the\tHigh<br \/>\nCourt observed: &#8220;We may, however,<br \/>\n<span class=\"hidden_text\">366<\/span><br \/>\nadd   that  it\twould  be  open\t to  defendant\t1  to\tseek<br \/>\ncompensation   for  these  properties  in   an\t appropriate<br \/>\nproceeding   in\t accordance  with  law.&#8221;  The\tappeal\t was<br \/>\naccordingly dismissed with costs.\n<\/p>\n<p>4.The  appellant took out execution of the  decree,  wherein<br \/>\nthe first respondent filed objections purporting to be under<br \/>\nSection\t 47 of the Civil Procedure Code to the\teffect\tthat<br \/>\nthe compensation payable to him for the suit property should<br \/>\nbe  determined and should be directed to be paid to  him  in<br \/>\nthe  said proceeding itself.  This objection was  upheld  by<br \/>\nthe  executing court which found that the book value of\t the<br \/>\nSchedule  1 properties is Rs 1, 15,000 and that of  Schedule<br \/>\n11  properties Rs 9574.50 paise, a total of Rs\t1,24,574.50.<br \/>\nThe  objections filed by the respondent were allowed in\t the<br \/>\nfollowing terms:\n<\/p>\n<p>\t      &#8220;In  the result, the application\tis  allowed.<\/p>\n<p>\t      It is ordered that the M.P. Electricity  Board<br \/>\n\t      (decree-holder)  shall within two months\tfrom<br \/>\n\t      today  deposit in Court for being paid to\t the<br \/>\n\t      applicants\/judgment-debtors compensation of Rs<br \/>\n\t      1,24,574.50 (Rs One lakh twenty-four  thousand<br \/>\n\t      five hundred and seventy-four and paise  fifty<br \/>\n\t\t\t    only), failing which they shall also be  liabl<br \/>\ne<br \/>\n\t      to pay interest calculated at the bank rate of<br \/>\n\t      Reserve Bank of India, plus one per cent\tfrom<br \/>\n\t      today  till payment.  The applicants shall  be<br \/>\n\t      entitled\t to  receive  the  compensation\t  on<br \/>\n\t      payment of requisite court fees as provided by<br \/>\n\t      law.&#8221;\n<\/p>\n<p>The  executing court recorded in para 10 of its\t order\tthat<br \/>\n&#8220;possession of the suit properties was ultimately  delivered<br \/>\nto  the decree-holder on 27-12-1983 through the\t process  of<br \/>\nthis Court in the present execution proceedings&#8221;.\n<\/p>\n<p>5.   It Is against the said order that the appellant filed a<br \/>\ncivil\trevision  petition  before  the\t High  Court.\t The<br \/>\nappellant&#8217;s   contention  was  that  the  determination\t  of<br \/>\ncompensation  is outside the purview of the executing  court<br \/>\nand outside the purview of Section 47 of the Civil Procedure<br \/>\nCode  as  well.\t Relying upon the observations made  in\t the<br \/>\njudgment  of the High Court in First Appeal No. 39 of  1974,<br \/>\nthe  appellant\tcontended that the only course open  to\t the<br \/>\nrespondent  is to file a suit in accordance with law, if  it<br \/>\nis  so\tadvised.   The learned Single  Judge  rejected\tthis<br \/>\ncontention  holding that Section 47 is wide enough  and\t the<br \/>\nexecuting  court  is  competent to decide  the\tquestion  of<br \/>\ncompensation  for  the\tsuit  properties  thereunder.\t The<br \/>\ncorrectness of the said view is questioned in this appeal.\n<\/p>\n<p>6.   In our opinion, it is unnecessary to go into the  scope<br \/>\nof  Section  47 of the Civil Procedure Code in\tthe  present<br \/>\nproceedings for the reason that while dismissing the  appeal<br \/>\npreferred by the first respondent-judgment-debtor and  other<br \/>\nappellants,  the  High\tCourt had observed that\t so  far  as<br \/>\ncompensation  is concerned &#8220;it would be open to defendant  1<br \/>\nto  seek compensation for the properties in  an\t appropriate<br \/>\nproceeding  in\taccordance  with law&#8221;.\t The  words  &#8220;in  an<br \/>\nappropriate  proceeding&#8221;  in  the  said\t observation  cannot<br \/>\ncertainly mean execution proceeding of the very same decree,<br \/>\nwhich  is but the same proceeding.  The said words  meant  a<br \/>\nseparate  independent  proceeding.   It is  not\t for  us  to<br \/>\nexpress any opinion whether the proceeding contemplated is a<br \/>\n<span class=\"hidden_text\">367<\/span><br \/>\nsuit  or  any other proceeding.\t Suffice it to say  that  it<br \/>\ndoes not certainly take in execution proceedings of the very<br \/>\nsame decree.  On this ground alone the appeal is allowed and<br \/>\nthe judgment of the executing court as well as the  judgment<br \/>\nof  the\t High  Court  affirming it are\tset  aside  and\t the<br \/>\nobjections filed by the first respondent under Section 47 of<br \/>\nthe Civil Procedure Code are dismissed as not maintainable.\n<\/p>\n<p>7.   Mr\t  Harish  Salve,  learned  counsel  for\t the   first<br \/>\nrespondent-judgment debtor requested towards the end of\t the<br \/>\narguments that in such an eventuality his objection petition<br \/>\nfiled  under Section 47 of the Civil Procedure Code  may  be<br \/>\nallowed\t to  be\t converted  into a  suit.   Though  we\twere<br \/>\ninclined  to accede to the said request at first, we are  of<br \/>\nthe  opinion,  on a further consideration, that\t the  proper<br \/>\ncourse would be to leave it open to the first respondent  to<br \/>\ninstitute  a suit or adopt such other proceeding as  may  be<br \/>\nopen  to  him in accordance with law and to direct  that  if<br \/>\nsuch  proceedings are taken within a period of three  months<br \/>\nfrom today, the first respondent shall be entitled to  claim<br \/>\nthe  benefit  of Section 14 of the Limitation  Act  for\t the<br \/>\nperiod\tspent in pursuing the proceedings under\t Section  47<br \/>\nincluding the period spent in appellate courts.\n<\/p>\n<p>8.   Mr G.L. Sanghi, learned counsel for the appellant\tmade<br \/>\na grievance that possession of all the suit properties\thave<br \/>\nnot  been  delivered  to the appellant and  that  the  first<br \/>\nrespondent  and\t other parties at its instance\tand  on\t its<br \/>\nbehalf\tare raising obstruction in obtaining  possession  of<br \/>\nthe properties.\t We have already referred to the observation<br \/>\nof   the  executing  court  that  possession  of  the\tsuit<br \/>\nproperties was delivered to the appellant through the  Court<br \/>\neven on 27-12-1983.  Mr Salve, learned counsel for the first<br \/>\nrespondent affirmed the said fact and stated that the  first<br \/>\nrespondent  is\tnot  in\t possession  of\t any  of  the\tsuit<br \/>\nproperties and that they were delivered to the appellant  as<br \/>\nrecorded by the executing court.  It is made clear that\t the<br \/>\nappellant   is\tentitled  to  take  possession\tand  be\t  in<br \/>\npossession   of\t all  the  suit\t properties,   without\t any<br \/>\nobstruction by respondent or any person claiming through it.\n<\/p>\n<p>9.
