APP for\nOpponent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 15\/09\/2010 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p>1.\tThe<br \/>\npresent appellant has preferred this appeal under sec. 374(2) of the<br \/>\nCode of Criminal Procedure, against the judgment and order of<br \/>\nconviction and sentence  dated 7.7.2008 passed by the learned Addl.<br \/>\nSessions Judge &amp; Presiding Officer, Fast Track Court no. 5,<br \/>\nGondal at Dhoraji in Sessions Case No.55\/2007, whereby, the learned<br \/>\nJudge has convicted the appellant under sec. 376 of IPC and sentenced<br \/>\nto undergo R\/I for 7 years and to pay a fine of Rs. 100\/-, in<br \/>\ndefault, to undergo further S\/I for one year. The appellant is also<br \/>\nconvicted under sec. 506(2)  of IPC and sentenced to undergo R\/I for<br \/>\na period of one year and to pay a fine of Rs 50\/-, in default, to<br \/>\nundergo further S\/I for three months, which is impugned in this<br \/>\nappeal. All the sentences were ordered to be run concurrently.\n<\/p>\n<p>2.\tThe<br \/>\nbrief facts of the prosecution case is as under:\n<\/p>\n<p>3.\tThat<br \/>\non 9.2.1996, at about 1.00 hours in the night, the appellant-accused<br \/>\nhas committed rape on the prosecutrix by showing knife and also<br \/>\nthreatened her to  kill if she informs about the rape committed by<br \/>\nthe appellant, to anybody.\n<\/p>\n<p>4.\tTherefore<br \/>\na complaint came to be filed by the prosecutrix. The panchnama of the<br \/>\nclothes put on by the victim was prepared in the presence of panch<br \/>\nwitness and statements of other witnesses were recorded and on<br \/>\ncompletion of the investigation, charge-sheet was filed in the Court<br \/>\nof learned Judicial Magistrate First Class, Dhoraji. Thereafter, as<br \/>\nthe case was exclusively triable by the Court of Sessions, the<br \/>\nlearned Magistrate has committed the case to the Court of Sessions,<br \/>\nwhich was given number as Sessions Case No.55\/2007.\n<\/p>\n<p>5.\tThereafter,<br \/>\nthe charge was framed at Ex. 19 against the appellant. The appellant<br \/>\n  accused has pleaded not guilty and claimed to be tried.\n<\/p>\n<p>6.\tIn<br \/>\norder to bring the home the charge levelled against the appellant-<br \/>\naccused, the prosecution has examined the witnesses and also produced<br \/>\ndocumentary evidence before the trial Court.\n<\/p>\n<p>7.\tThereafter,<br \/>\nafter examining the witnesses, further statement of the<br \/>\nappellant-accused under sec. 313 of CrPC was recorded in which the<br \/>\nappellant-accused has denied the case of the prosecution.\n<\/p>\n<p>8.\tAfter<br \/>\nconsidering the oral as well as documentary evidence and after<br \/>\nhearing the parties, learned Judge vide impugned judgment and order<br \/>\ndated 7.7.2008 held the appellant   accused guilty to the charge<br \/>\nlevelled against him under sec. 376 and 506(2) of IPC and convicted<br \/>\nand sentenced the appellant accused, as stated above.\n<\/p>\n<p>9.\tBeing<br \/>\naggrieved by and dissatisfied with the impugned judgment and order of<br \/>\nconviction and sentence passed by the learned Addl. Sessions Judge,<br \/>\nDhoraji, the present appellant has preferred this appeal.\n<\/p>\n<p>10.\tHeard<br \/>\nMr. Virat Popat learned advocate for the appellant and Mr HH Parikh<br \/>\nlearned APP for the respondent-State.\n<\/p>\n<p>11.\tMr.\n<\/p>\n<p>Virat Popat learned advocate appearing for the appellant has fairly<br \/>\nadmitted that he is not arguing the matter on merits, but he is<br \/>\narguing the matter only on the point of quantum of punishment. He has<br \/>\nread the charge and the judgment and order of conviction and sentence<br \/>\nand contended that though it was established before the  learned<br \/>\nJudge that there was a love affair between the appellant and<br \/>\nprosecutrix and both were major, however, the same was not considered<br \/>\nby the learned Judge and, therefore, question regarding consent was<br \/>\nalso not considered by the learned Judge. Mr Popat has further<br \/>\ncontended that from the oral evidence of prosecutrix, it was also<br \/>\nestablished beyond reasonable doubt that there was a consent of the<br \/>\nprosecutrix. From the medical evidence, not a single iota of evidence<br \/>\nwith regard to any injury was found on the body of prosecutrix. Mr<br \/>\nPopat has also contended that FSL report is also in favour of the<br \/>\nappellant. Mr. Popat has submitted that the appellant has already<br \/>\nundergone the sentence of 2 years and 4 months and, therefore,<br \/>\nsentence imposed upon the appellant is very harsh and, the same  may<br \/>\nbe reduced.\n<\/p>\n<p>12.\tLearned<br \/>\nAPP Mr. Parikh appearing for the State has contended that this is not<br \/>\na case of consent. He has drawn my attention to the circumstantial<br \/>\nevidence and argued that before the learned Judge it was established<br \/>\nbeyond reasonable doubt that the appellant has committed serious<br \/>\noffence under sec. 376 and 506(2) of IPC. Mr Parikh has also<br \/>\nsubmitted that the evidence of prosecutrix is sufficient and no<br \/>\ncorroboration is necessary to prove the case and, therefore, this<br \/>\nappeal may be dismissed.\n<\/p>\n<p>13.\tI<br \/>\nhave considered the submissions made by the learned advocates<br \/>\nappearing for the parties and perused the papers. I have also gone<br \/>\nthrough the oral as well as documentary evidence produced on the<br \/>\nrecord. I have read the oral evidence of prosecutrix. No doubt, in<br \/>\nthe cross-examination, the  defence has tried to establish that there<br \/>\nwas love affair between the appellant and prosecutrix and  the age of<br \/>\nthe appellant at the time of incident was only 22 years and he was<br \/>\ndoing labour work and having two children and he is the only bread<br \/>\nwinner in the family . In that view of the matter, I am of the<br \/>\nopinion that the sentence imposed upon the appellant is very harsh<br \/>\nand the same  requires to be reduced. This Court, without entering<br \/>\ninto the merits of the matter, the sentence to undergo R\/I for 7<br \/>\nyears imposed upon the appellant by the learned Addl. Sessions Judge<br \/>\nis requires to be reduced.\n<\/p>\n<p>14.\tIn<br \/>\nthe result, this appeal is partly allowed. The impugned judgment and<br \/>\norder of conviction dated 7.7.2008 passed in Sessions Case No.<br \/>\n55\/2008 by the learned Addl. Sessions Judge &amp; Presiding Officer,<br \/>\nFast Track Court No. 5, Gondal at Dhoraji convicting the<br \/>\nappellant-accused under sec. 376 and 506(2) of IPC is hereby<br \/>\nconfirmed. However, the order of sentence sentencing the<br \/>\nappellant-accused to undergo R\/I for 7 years for the offence under<br \/>\nsec. 376 of IPC, is hereby  reduced to the extent that instead  the<br \/>\nappellant-accused is hereby sentenced to undergo R\/I for 3 years and<br \/>\n6 months.
