SHAH\n\t\t\n\t\n\n \n\nDate\n: 21\/01\/2010 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>1.\t\tThe<br \/>\npresent Civil Application has been preferred by the applicant (third<br \/>\nparty) permitting her to be joined as respondent No.4 in main Special<br \/>\nCivil Application No.17852 of 2003.\n<\/p>\n<p>2.\t\tIt<br \/>\nis the case on behalf of the applicant that the disputed land, which<br \/>\nis subject matter of main petition was put to auction by State<br \/>\nGovernment as excess vacant land and the applicant is highest offerer<br \/>\nand his offer has been accepted and the applicant has purchased the<br \/>\nsaid land at the rate of Rs.5,000\/- per sq.mtr.\n<\/p>\n<p>3.\t\tIt<br \/>\nis the case on behalf of the applicant in para-16 of the present<br \/>\napplication that the applicant deposited 25% amount of the sale<br \/>\nconsideration i.e. Rs.32,50,000\/- plus 25% of stamp duty i.e.<br \/>\nRs.8,12,500\/- before the State Government vide Challan No.11 dated<br \/>\n30\/12\/2003 and the applicant was informed by the Competent Authority<br \/>\nand Additional Collector, Urban Land Ceiling to deposit further<br \/>\namount of Rs.24,37,500\/- and Rs.3,64,000\/- towards stamp duty vide<br \/>\nletter dated 29\/03\/2004. However, when the applicant went to deposit<br \/>\nthe said amount with the Competent Authority and Additional<br \/>\nCollector, Urban Land Ceiling, the said amount has not been accepted<br \/>\nby the Competent Authority and Additional Collector, Urban Land<br \/>\nCeiling due to pendency of Special Civil Application No.17852 of<br \/>\n2003. Hence, the applicant has preferred the present application<br \/>\npermitting her to be joined as party respondent No.4 in the main<br \/>\npetition.\n<\/p>\n<p>4.\t\tMr.K.K.Trivedi,<br \/>\nlearned advocate appearing on behalf of the Opponent No.4<br \/>\noriginal petitioner has tried to oppose the present application by<br \/>\nsubmitting that the applicant has not paid the full sale<br \/>\nconsideration and, therefore, it cannot be said that the applicant<br \/>\nhas become absolute owner of the land in question.\n<\/p>\n<p>5.\t\tMr.Premal<br \/>\nJoshi, learned advocate appearing on behalf of the applicant has<br \/>\nsubmitted that in fact after the sale was confirmed in favour of the<br \/>\napplicant, the applicant did approach the Competent Authority and<br \/>\nAdditional Collector, Urban Land Ceiling for depositing the sale<br \/>\nconsideration, however, the said amount was not accepted by the<br \/>\nCompetent Authority and Additional Collector, Urban Land Ceiling due<br \/>\nto pendency of the main petition. It is further submitted that<br \/>\nwithout prejudice to the rights and contention of the respective<br \/>\nparties, still the applicant shall deposit the balance amount  of<br \/>\nsale consideration with the Competent Authority and Additional<br \/>\nCollector, Urban Land Ceiling within the time, that may be fixed by<br \/>\nthis Court.\n<\/p>\n<p>6.\t\tConsidering<br \/>\nthe aforesaid facts and circumstances of the case more particularly<br \/>\nwhen it is case on behalf of the applicant that the applicant has<br \/>\npurchased the disputed land, which is subject matter of the main<br \/>\npetition, the applicant can be said to be an interested party in the<br \/>\nproceedings. Under the circumstance, without prejudice to the rights<br \/>\nand contentions of the respective parties, applicant is ordered to be<br \/>\njoined as party respondent No.4 in main petition i.e. Special Civil<br \/>\nApplication No.17852 of 2003. The applicant to deposit the balance<br \/>\namount of sale consideration with Competent Authority and Additional<br \/>\nCollector, Urban Land Ceiling, within a period of four weeks from<br \/>\ntoday, without prejudice to the rights and contentions of the<br \/>\nrespective parties and without affecting the proceedings of main<br \/>\npetition i.e. Special Civil Application No.17852 of 2003 and the<br \/>\nCompetent Authority and Additional Collector, Urban Land Ceiling to<br \/>\naccept the same without prejudice to the rights and contentions of<br \/>\nthe respective parties in the main petition. Registry is directed to<br \/>\namend the cause title of the main petition accordingly.
