NO.1984 of 2009\n               = = = = = = = = = = = = = = = = = = = = = = = = =\n                    Dated this the 23rd day of June,   2009\n\n                                  O R D E R\n<\/pre>\n<p>                                  &#8212;&#8212;&#8212;&#8212;&#8211;\n<\/p>\n<p>      This revision        is in challenge of         judgment of  learned<\/p>\n<p>Additional District &amp; Sessions Judge (Adhoc-I), Kottayam in Crl. Appeal<\/p>\n<p>No.638 of 2007        confirming conviction and sentence for offence<\/p>\n<p>punishable under Section 138 of the Negotiable Instruments Act (for<\/p>\n<p>short, &#8220;the Act&#8221;).\n<\/p>\n<p>      2.    Petitioner and respondent No.2 filed Crl.M.A No.6000 of<\/p>\n<p>2009 reporting settlement and seeking permission to compound the<\/p>\n<p>offence.\n<\/p>\n<p>      3.    It is seen from application No.6000 of 2009 that parties<\/p>\n<p>have settled the dispute out of court. There is no reason to think that<\/p>\n<p>the composition is not voluntary. Offence under Section 138 of the Act<\/p>\n<p>is made     compoundable under Section 147 of the Act.              Hence<\/p>\n<p>permission is granted and Crl.M.A. No.6000 of 2009 is allowed.
