\no1iginail3i”belonged’:to~Vone:E3rn~t. Anandi Bai, who executed<\/p>\n
a Willdated’-V1V_’1.03:.l985″\u00b0bequeathing all her properties<\/p>\n
 heirs. As”‘per the terms of the said Will, the<\/p>\n
si_i__i’t VS(El1e:di_i1e \u00e9vproperties were bequeathed in favour of the<\/p>\n
I81  “l’he said Will further contains a condition<\/p>\n
*ijv\u00bb-v’\u00ab._fCll.a’E the.,V__A’lSt defendant should not alienate the suit<\/p>\n
   properties bequeathed to him for a period of 10<\/p>\n

  and thereafter, if he isxulhriguthe sell the same, he<\/p>\n

should give first option to the plaintiff and if it is only in
\nthe event of plaintiff declining to purchase the property,<\/p>\n
defendant No.1 could sell the property to others<\/p>\n
Written consent of the plaintiff. The said    <\/p>\n
during May 1987. The plaintiff 3filed”the”–\u00absuit
\n2008, alleging that the 1st defendant\ufb01has entered
\nagreement with defendants  to
\ninto a multi residential.   oifvthe \ufb02ats

defendantillllsliotildl\ufb01fije  from alienating the<\/p>\n
property zandalso  the same.\n<\/p>\n
 it ‘The  ‘d.e:fend,ants resisted the suit. They<\/p>\n
AV’Vcontended’\u00abth\u00abat’the suit is not maintainable, as there was<\/p>\n
no ’cause ofaetion, since no alienation has taken place.<\/p>\n
 A. .5) Z :The trial Court on assessment of the oral and<\/p>\n
 rdocumentary evidence decreed the suit and granted<\/p>\n
 p-e.r-nianent injunction restraining the 13% defendant<\/p>\n

\npermanently from alienating the schedule property in
\nviolation of the terms of the Wi1I–Ex.P1 without the written
\nconsent of the plaintiff. Further defendants — 1 to 3′;’were<\/p>\n
permanently restrained from putting–up any  poi;<\/p>\n
building in the suit property without ,<\/p>\n
complying with the pre–emptiori’  if<\/p>\n
Ex.PI.\n<\/p>\n
6} On appeal __by  Lower
\nAppellate Court held that ithels\ufb01lfit  the plaintiff was
\nnot maintainablein as\ufb01iuch  no cause of<\/p>\n
action for the ,p1’a.:n_tif\u00a3 ltod\ufb01le’ the suit in View of the fact<\/p>\n
that there was no” made. The Lower Appeliate<\/p>\n
…V.Court\u00ab.\u00a7didi’~not  the judgment of the trial Court,<\/p>\n
A”:and”hVeid:_thatfthe clause Contained in the Will is Vague.<\/p>\n
Thefefore;  Appellate Court set aside the judgement of<\/p>\n
 g [the trial  and dismissed the suit by allowing the<\/p>\n
   It is against the judgment of the Lower Appeliate<\/p>\n

Court, the unsuccessful plaintiff is before this Court in
\nthis appeal.\n<\/p>\n

8) The only question  considered by
\nthis Court is    to file the suit
\nfor permanent  of the pre–~emptiVe
\nright Ci’eate’dx.:  of the Will~Ex.P1.<\/p>\n
Aciniittedly,’ \u00abthe VVVl”~”:t:ljV*defendant succeeded to the suit<\/p>\n
schedule property’   of the Wil1–Ex.P1. It is not the<\/p>\n
I-‘:’rca.se the plaintinfyfwthat the 15’ defendant has sold the<\/p>\n
 of the defendants — 2 8: 3. According to<\/p>\n
  the A ‘–defe_ndant; he entered into an agreement for<\/p>\n
” “”–._deVeVIopinvg:the suit schedule property. The question as to<\/p>\n
  a pre–emptor has a right to seek equitable relief of<\/p>\n
 niginjunctien at the hands of the Court has been considered<\/p>\n

\nby the Apex Court in several decisions. In Kumar<\/p>\n
gonsusab 82. others vs. Mohammad Miyan Urf Baban\n<\/p>\n
82. others [ (2008) 10 SCC 153] , it has been clearly held
\nthat unless title to the suit property has
\naccordance with the provisions of the T.P. Act.,–
\nenforce pre–emption arises. As; per’  A”<\/p>\n
reported decision, there was an agree\u00e9inentldtbetvgfeenfthree<\/p>\n
appellants for sale of the”fVpi’=operty-.  Thef’d.:re’spend;ents”at<\/p>\n
therein in exercise of the of ‘pre–e.rnpti.on,,:\u00a7filed the<\/p>\n
suit. The Apex Court ulltifnatelfhield’  suit for pre-<\/p>\n
emptionv’tVbrVoueghtv ‘Vthe”\u00bbb’asis tof\ufb02such an agreement was
\nwithout any ac’ti_o’n,V~’as there was no right of pre-<\/p>\n
emption, in the respondents, which could be enforced<\/p>\n
 = law. As observed by the Apex Court in the said<\/p>\n
decis;ion,.tltterefare no equities in favour of the pre-emptor.<\/p>\n
  TheAA.pex_fCoi1rt has further observed that “it would be<\/p>\n
 “pre–emptee to defeat the law of the pre~\u00bbeInption<\/p>\n
 aby*V_Vanj;’legitimate means, which is not fraud on the part of<\/p>\n
A  ‘either the vendor or the vendee and a person is entitled to<\/p>\n
a\/<\/p>\n

\nsteer clear of the law of preemption by all lawful means”.<\/p>\n
It is further observed that “the right of prewemption is a
\nWeak right and is not looked upon with favour by Courts<\/p>\n
and therefore, the Courts cannot go out of their”‘v}ay”‘to<\/p>\n
help the pre–ernptor”. In the case on hand a1so:”th,ere.i:’is  <\/p>\n
transfer of property in accordance”‘w–ith  of<\/p>\n
Property Act. The 1st defendant  A’exectf.te’d. <\/p>\n
deed in favour of DefendantVs’~\u00a7r2p and   the’<\/p>\n
plaintiff cannot enforce’ at ysithisfvfistage th’e”‘pr*\u00e9\u00a7emptive
\nright, if any. In other   wait till the<\/p>\n
transfer: piaciew accordance with the<\/p>\n
provisions. of .i?*roperty Act.\n<\/p>\n
.. it “In the” the law laid down by the Hon’b1e<\/p>\n
in the aforesaid decision, I do not find any<\/p>\n
illegality committed by the Lower Appeilate<\/p>\n
 ‘ ‘Courtin idisrriissing the suit as the plaintiff had no cause<\/p>\n
   \u00e9l\u00e9tion to fiie the suit. In this View of the matte <\/p>\n
appeal lacks merit. The appeal does not invo1V_e__ any<\/p>\n
question of law muchless substantial question of <\/p>\n
Accordingly, the appea} is dismissed._.   ‘  \u00ab
