Justice ANTONY DOMINIC\n\n Dated :19\/02\/2008\n\n O R D E R\n                           ANTONY DOMINIC, J.\n\n                           --------------------------\n\n                           W.P.(C)No.5854  OF 2008\n\n                           -----------------------------\n\n             DATED THIS THE 19TH DAY OF FEBRUARY, 2008\n\n\n                              J U D G M E N T\n<\/pre>\n<p>      Although   in   this   writ   petition   filed   challenging   the<\/p>\n<p>proceedings   initiated   against   the   petitioner   under   the<\/p>\n<p>Securitisation   and   Reconstruction   of   Financial   Assets   and<\/p>\n<p>Enforcement   of   Security   Interest   Act,   2002   ,   substantial<\/p>\n<p>contentions have been raised by the petitioner what is now urged<\/p>\n<p>before me is for an instalment facility to discharge the liability.\n<\/p>\n<p>      2.     I have heard the counsel for the respondent-bank also.\n<\/p>\n<p>Accordingly   I   dispose   of   this   writ   petition   directing   that   the<\/p>\n<p>amount due to the bank will be paid by the petitioner in six equal<\/p>\n<p>monthly instaments, the first of which is payable in the first week<\/p>\n<p>of March, 2008 and the subsequent instalments be payable in the<\/p>\n<p>first   week   of   every   succeeding   month.     Subject   to   payment   as<\/p>\n<p>above,   proceedings   initiated   against   the   petitioner   shall   be<\/p>\n<p>deferred and in case default is committed, the bank will be free to<\/p>\n<p>continue   the   action   that   it   has   already   initiated   without   further<\/p>\n<p>notice to the petitioner.
