The condition which is sought to be deleted reads as<br \/>\nunder:\n<\/p>\n<p>&#8220;(4)<br \/>\nOn<br \/>\nevery 1st date and 15th date of English Calender month during the<br \/>\nperiod from 10-00 a.m. to 05-00 p.m. petitioner shall appear before<br \/>\nP.S.O. Of Ghatlodia Police Station of Ahmedabad Rural and shall mark<br \/>\nhis presence for which the learned Additional Sessions Judge<br \/>\nGandhidham shall write a Yadi directing P.S.O. Of Ghatlodia Police<br \/>\nStation, Ahmedabad Rural to keep and maintain a written record for<br \/>\nsuch presence marked by petitioner.&#8221;\n<\/p>\n<p>2.<br \/>\nLearned advocate Mr.Champaneri therefore submitted that the applicant<br \/>\nis aged about 66 years and he has been marking presence as required<br \/>\nregularly and the trial is not yet commenced after 8 years, and,<br \/>\ntherefore, it may be deleted or modified.\n<\/p>\n<p>3.<br \/>\nLearned APP Ms. Nair for State places on record the report stating<br \/>\nthat there are no complaints with regard to any breach of the<br \/>\nconditions and he has been marking his presence regularly.\n<\/p>\n<p>4.<br \/>\nHaving heard learned advocate Mr.Champaneri for the applicant and<br \/>\nMs.Mini Nair, learned APP and having considered the fact and<br \/>\ncircumstances, the present application deserves to be allowed.<br \/>\nAccordingly condition no.4 imposed regarding marking of presence as<br \/>\nstated above shall stand deleted. However, it may be subject to<br \/>\nfurther condition that applicant will again give a complete details<br \/>\nof his residential premises which he requires to give and shall also<br \/>\nintimate if there is any change.\n<\/p>\n<p>5.<br \/>\nWith above observation and condition, present application is allowed.<br \/>\nRule is made absolute to the aforesaid extent.
