Dhyani\nRespondent           -      Central Bureau of Investigation (CBI)\n                                   Decision announced: 5.3.2010\n\n\nFacts<\/pre>\n<p>:\n<\/p>\n<p>         By an application of 26.5.08 Shri Anil Kumar Dhyani of Mayur Vihar,<br \/>\nPhase-1, Delhi applied to the DOPT seeking the following information:\n<\/p>\n<blockquote><p>         &#8220;With reference to the above mentioned subject, I would like to<br \/>\n         inspect all the complete Original Files \/ documents \/ records \/<br \/>\n         statements of all the witnesses recorded under sec. 161 of Cr.P.C.<br \/>\n         etc. of the above mentioned case number under sub sec. (1) of<br \/>\n         Sec. 7 of the Act as Form &#8216;A&#8217; and process fee of Rs. 10\/- in cash<br \/>\n         are enclosed herewith for your further necessary action.&#8221;<\/p><\/blockquote>\n<p>         The reference is to a case registered in CBI&#8217;s Anti-Corruption Branch on<br \/>\n30.5&#8217;02. This application was forwarded by Under Secretary Shri Chander<br \/>\nPrakash, DOPT, who received the application on 6.6.08, to the JD (P), CBI,<br \/>\nNorth Block, on 11.6.&#8217;08 as below:\n<\/p>\n<blockquote><p>         &#8220;Since subject matter of information pertains to the CBI, the same is<br \/>\n         hereby transferred to the CBI under Sec. 6(3) of the RTI Act for<br \/>\n         further appropriate action.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>         This was then further transferred on 16.6.08 to SP, CBI, ACB, New Delhi.\n<\/p><\/blockquote>\n<p>CPIO Shri Sumit Sharan, SP, CBI, ACB, New Delhi in his letter of 3.7.08 then<br \/>\ninformed Shri Dhyani, as below:\n<\/p>\n<blockquote><p>         &#8220;It is intimated that all the relied upon documents and statements<br \/>\n         under Sec. 161 of CrPC have already been supplied to you in the<br \/>\n         Court.&#8221;<\/p><\/blockquote>\n<p>         Shri Dhyani has then moved an appeal before the DIG, CBI, ACB, New<br \/>\nDelhi on 8.7.08 on the following grounds:\n<\/p>\n<p><span class=\"hidden_text\">                                                1<\/span><\/p>\n<blockquote><p>               (i)       &#8220;I have an doubt about the authenticity of some of<br \/>\n                        the statements of the witnesses which were<br \/>\n                        recorded and filed by the CBI in the court because<br \/>\n                        when I shows some statements to the witnesses<br \/>\n                        who gave those statements before the<br \/>\n                        Investigating Officer during investigation they told<br \/>\n                        me that they have not given any such kind of<br \/>\n                        statement before the I.O. and they denied their<br \/>\n                        statements.\n<\/p><\/blockquote>\n<blockquote><p>              (ii)      I also would like to know the statements of all<br \/>\n                        other witnesses whose statements are recorded<br \/>\n                        by the I.O. during investigation but neither filed<br \/>\n                        those statements in the Court nor were the copies<br \/>\n                        of such statements provided to me till date by the<br \/>\n                        CBI.\n<\/p><\/blockquote>\n<blockquote><p>              (iii)     As the trial is already going on in the court so I<br \/>\n                        think there should be no harm to show me all the<br \/>\n                        complete original Files \/ Documents \/ Records \/<br \/>\n                        Statement of all the witnesses recorded under<br \/>\n                        Section 161 of CrPC for inspection at this stage.&#8221;<\/p><\/blockquote>\n<p>       Upon this Shri Sudhir Kumar Saxena, DIG, CBI, ACB New Delhi directed<br \/>\nas follows:\n<\/p>\n<blockquote><p>       &#8220;If the appellant has any grievance he is free to approach the trial<br \/>\n       Court for redressal of his grievance. Additional information asked<br \/>\n       for by the appellant cannot be supplied to him as it would impede<br \/>\n       the prosecution and exempted u\/s 8(1)(h) of the RTI Act.<br \/>\n       Accordingly the appeal is disposed of.&#8221;<\/p><\/blockquote>\n<p>       Shri Dhyani has then approached this Commission with a second appeal<br \/>\npraying as follows:\n<\/p>\n<blockquote><p>       &#8220;In the premises, the Applicant most respectfully prays that this<br \/>\n       Hon&#8217;ble Commission may kindly &#8211;\n<\/p><\/blockquote>\n<blockquote><p>       i)     Allow me to inspect all the complete original files \/<br \/>\n              documents \/ records \/ statements of all the witnesses (both<br \/>\n              whether it was filed or not filed in the court) recorded u\/s 161<br \/>\n              of CrPC by the CBI during investigation and I can take the<br \/>\n              photocopies which ever is desired to me.\n<\/p><\/blockquote>\n<blockquote><p>       ii)    Instruct the 1st Appellate Authority to provide me all the<br \/>\n              complete data available in their computers of my case in<br \/>\n              &#8220;Pen Drive&#8221; as per under Sec. 2(j)(iv) of the Act.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">                                         2<\/span><\/p>\n<blockquote><p>        iii)   Pass such other and further orders(s) and \/ or direction(s) as<br \/>\n              is deem fit and proper by this Commission in the present<br \/>\n              facts and circumstances of the case.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>       The appeal was heard on 5.3.2010. The following are present:<\/p><\/blockquote>\n<p>       Appellant<br \/>\n             Shri Anil Kumar Dhyani<br \/>\n       Respondents<br \/>\n             Shri Sumit Sharan, SP, CBI<\/p>\n<p>       Appellant Shri Anil Kumar Dhyani submitted that as per his information<br \/>\nthere were certain witnesses whose statements had been recorded, which do not<br \/>\nform part of the record submitted to the Court. It is for this reason that he would<br \/>\nlike to inspect the file. CPIO Shri Sumit Sharan, SP, CBI on the other hand<br \/>\nsubmitted that all documents relied upon by the CBI in the prosecution have<br \/>\nbeen, in original, transferred to the Court.\n<\/p>\n<p>                                DECISION NOTICE<\/p>\n<p>       We have in earlier cases also held that once a trial Court has taken<br \/>\ncognizance of a case and charge sheet filed documents that concern that case<br \/>\nbecome the property of that Court and therefore deemed to be held by it, even if<br \/>\nthey may be in the physical possession of the prosecuting agency. For this<br \/>\nreason, appellant is advised that should he wish to inspect documents contained<br \/>\nin the files of CBI which pertain to the present case, but which he suspects have<br \/>\nnot been submitted to the Court, he is free to move an application accordingly<br \/>\nbefore the Court. Besides, the trial Court itself is subject to the provisions of the<br \/>\nRTI Act. If, therefore, the trial Court was to concede appellant&#8217;s request for<br \/>\ninspection of such records, it will be open to the trial Court to transfer the<br \/>\napplication, if necessary, under sub sec. (3) of Sec. 6 of the RTI Act, 2005, to the<br \/>\nagency holding the information sought. In either case, however, ruling upon the<br \/>\nplea of appellant Shri Anil Kumar Dhyani is beyond the jurisdiction of this<br \/>\nCommission. The appeal is therefore dismissed.\n<\/p>\n<p><span class=\"hidden_text\">                                          3<\/span><\/p>\n<p>        Announced in the hearing.
