(Oral)\n<\/pre>\n<p>            Sahi Ram has filed this revision petition assailing judgment<\/p>\n<p>dated 11.4.2009 of learned Additional Sessions Judge, Faridabad, whereby<\/p>\n<p>respondent nos. 1 to 7 have been ordered to be released on probation of<\/p>\n<p>good conduct and also ordered to pay compensation to the injured person<\/p>\n<p>including the petitioner-complainant, while upholding the conviction of the<\/p>\n<p>respondents.\n<\/p>\n<p>            Respondent nos. 1 to 7 along with Shakuntala and Kaushalya<\/p>\n<p>were convicted by learned Judicial Magistrate Ist class,       Palwal vide<\/p>\n<p>judgment dated 19.9.2008 under sections 148, 323, 324, 325 and 506 IPC<\/p>\n<p>read with section 149 IPC and vide order dated 22.9.2008 Shakuntala and<\/p>\n<p>Kaushalya were ordered to be released on probation whereas respondent<\/p>\n<p>nos. 1 to 7 were awarded substantive sentence.      Respondent nos. 1 to 7<\/p>\n<p>preferred appeal wherein they did not challenge their conviction but prayed<\/p>\n<p>for release on probation as noticed in paragraph no. 9 of the impugned<\/p>\n<p>judgment of the appellate court.   The learned appellate court accepted the<br \/>\n<span class=\"hidden_text\"> Criminal Revision No. 1947 of 2009                              -2-<\/span><\/p>\n<p>said prayer of respondent nos. 1 to 7 and ordered their release on probation<\/p>\n<p>of good conduct and also directed them to pay Rs              3500\/- each as<\/p>\n<p>compensation including the fine amount of Rs 1500\/- each which was also<\/p>\n<p>converted into compensation.\n<\/p>\n<p>             Feeling aggrieved, the complainant has preferred this revision<\/p>\n<p>petition.\n<\/p>\n<p>             I have heard learned counsel for the petitioner and perused the<\/p>\n<p>case file.\n<\/p>\n<p>             Learned counsel for the petitioner contended that the appellate<\/p>\n<p>court has not recorded any reason for releasing respondent nos. 1 to 7 on<\/p>\n<p>probation. The contention cannot be accepted because in paragraph no. 13<\/p>\n<p>of the impugned judgment as well as in preceding paragraphs, reasons have<\/p>\n<p>been recorded for ordering release of respondent nos. 1 to 7 on probation.<\/p>\n<p>In addition thereto, in view of provisions of Probation of Offenders Act,<\/p>\n<p>1958 as well as sections 360 and 361 Cr.P.C. , special reasons have to be<\/p>\n<p>recorded for denying the benefit of probation in such cases.      Respondent<\/p>\n<p>nos. 1 to 7 are not previous convicts.     The offences were not punishable<\/p>\n<p>with imprisonment for life. There was no special reason to deny the benefit<\/p>\n<p>of probation to respondent nos. 1 to 7.    There is, thus, no infirmity much<\/p>\n<p>less illegality in the impugned judgment of the appellate court granting<\/p>\n<p>benefit of probation to respondent nos. 1 to 7.\n<\/p>\n<p>             In view of the aforesaid, finding no merit in the instant revision<\/p>\n<p>petition, the same is hereby dismissed in limine.<\/p>\n<pre>\n\n\n                                                       ( L.N.
