ABDUL REHIM, J\n                 ------------------------------\n              WP(C) NO. 28673 OF 2010\n              ------------------------------------\n       Dated this the 16th day of September, 2010\n\n\n                        JUDGMENT\n<\/pre>\n<p>     Ext.P3 order passed by the second respondent<\/p>\n<p>appellate authority is under challenge in this Writ Petition.<\/p>\n<p>Against Ext.P1 order of assessment a statutory appeal was<\/p>\n<p>filed before the second respondent as per Ext.P2. Pending<\/p>\n<p>disposal of the appeal stay against collection of tax amount<\/p>\n<p>in dispute was sought for. Ext.P3 is the order passed on the<\/p>\n<p>stay application.\n<\/p>\n<p>     2.   In Ext.P3, the petitioner was directed to make<\/p>\n<p>payment of 50% of the disputed tax and interest due<\/p>\n<p>thereon, and to furnish adequate security with respect to<\/p>\n<p>the balance amount. According to the petitioner, the<\/p>\n<p>appellate authority having been found that a prima facie<\/p>\n<p>case was established, could not have insisted for payment<\/p>\n<p>for 50% of the tax amount as well as the interest. It is also<\/p>\n<p>contended that insistence for furnishing adequate security<\/p>\n<p>with respect to the balance amount is also creating<\/p>\n<p><span class=\"hidden_text\">                               2<\/span><br \/>\nWP(C) No. 28673\/2010<\/p>\n<p>problem.\n<\/p>\n<p>     3.     The order in question is one issued by a statutory<\/p>\n<p>appellate authority exercising its discretion in granting<\/p>\n<p>interim relief pending disposal of an appeal. Unless such<\/p>\n<p>orders are highly cryptic or one issued without application of<\/p>\n<p>mind or without advertence to the contentions raised in the<\/p>\n<p>appeal, no interference in exercise of jurisdiction under<\/p>\n<p>Article 226 is proper and justifiable. Going by contents of<\/p>\n<p>Ext.P3, it is evident that the appellate authority had<\/p>\n<p>elaborately considered almost all the contentions raised in<\/p>\n<p>the appeal. Having found that a prima facie case has been<\/p>\n<p>established a conditional stay was granted. The question as<\/p>\n<p>to whether the condition imposed is onerous or rigorous is<\/p>\n<p>also not a matter arising for consideration in a Writ Petition.<\/p>\n<p>Therefore on the merits of the contentions an interference<\/p>\n<p>with the impugned order is not at all warranted.<\/p>\n<p>     4.     However, learned counsel for the petitioner points<\/p>\n<p>out that a major portion of amount due pertains to interest<\/p>\n<p>and insistence for payment 50% tax amount as well as<\/p>\n<p><span class=\"hidden_text\">                              3<\/span><br \/>\nWP(C) No. 28673\/2010<\/p>\n<p>interest will work out to an onerous liability which he will<\/p>\n<p>find impossible to comply with. Further, the direction for<\/p>\n<p>instances to furnish adequate security will lead to difficulties<\/p>\n<p>since the assessing authority will insist on furnishing Bank<\/p>\n<p>Guarantee       on  that account.  Considering     the   above<\/p>\n<p>contentions, in exercise of equity, I am inclined to order<\/p>\n<p>slight modification with respect to the conditions imposed<\/p>\n<p>under Ext.P3.\n<\/p>\n<p>     5.     Under the above circumstances, while dismissing<\/p>\n<p>the Writ Petition, a partial modification of the conditions<\/p>\n<p>stipulated in Ext.P3 is allowed, to the extent of insisting<\/p>\n<p>payment of only 1\/3rd of the tax amount and interest in<\/p>\n<p>dispute and furnishing of Security Bond, without sureties, for<\/p>\n<p>the balance amount. Time for compliance of the above<\/p>\n<p>conditions will stand extended for a period of one month from<\/p>\n<p>today.\n<\/p>\n<\/p>\n<p>                                   C.K.
