SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 30\/09\/2008 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>Present<br \/>\n\tSpecial Criminal Application under Article 227 of the Constitution<br \/>\n\tof India is filed by the petitioners ?  original accused for<br \/>\n\tappropriate writ, order and\/or direction, quashing and setting aside<br \/>\n\tthe judgement and order dtd.25\/7\/2008 passed by the learned 3rd<br \/>\n\tAdditional Senior Civil Judge and Judicial Magistrate, First Class,<br \/>\n\tJamnagar below application Ex.55 in Criminal Case No.5414 of 2007.<br \/>\n\tIn the alternate it is prayed to direct the court concerned to<br \/>\n\tcomplete the task of recording of evidence (Chief and Cross) through<br \/>\n\tcommission of two witnesses named in Ex.55 on any fixed date or any<br \/>\n\ttime bound  schedule as deemed fit by this  Court.\n<\/p>\n<p>Today<br \/>\n\twhen the matter is called out, Mr.Dagali, learned advocate appearing<br \/>\n\ton behalf of the  petitioners has submitted that the petitioners are<br \/>\n\tnot pressing for the present petition challenging the order<br \/>\n\tdtd.25\/7\/2008 passed by the learned 3rd Additional Senior<br \/>\n\tCivil Judge and Judicial Magistrate, First Class, Jamnagar below<br \/>\n\tapplication Ex.55 in Criminal Case No.5414 of 2007. However, he has<br \/>\n\tsubmitted that witnesses named in the application Ex.55 are not<br \/>\n\tinterested in giving their evidence at the earliest and hence the<br \/>\n\ttrial is delayed.\n<\/p>\n<p>Mr.Zubin<br \/>\n\tBharda, learned advocate appearing on behalf of the  respondent No.2<br \/>\n\tnamely Nandbalaben and Hiralal whose evidence is to be recorded by<br \/>\n\tappointing commission, will appear before the learned Chief Judicial<br \/>\n\tMagistrate, Porbandar for giving their deposition on 10\/10\/2008 and<br \/>\n\tthe deposition may be recorded on that day.\n<\/p>\n<p>Under<br \/>\n\tthe aforesaid circumstances, the present Special Criminal<br \/>\n\tApplication is disposed by directing that the aforesaid two<br \/>\n\twitnesses namely  Nandbalaben and Hiralal may appear before the<br \/>\n\tlearned Chief Judicial Magistrate, Porbandar on 10\/10\/2008 for<br \/>\n\tgiving their deposition and the  learned Chief Judicial Magistrate,<br \/>\n\tPorbandar to record the evidence\/deposition of aforesaid two<br \/>\n\twitnesses as per the order dtd.25\/7\/2008 passed by the learned 3rd<br \/>\n\tAdditional Senior Civil Judge and Judicial Magistrate, First Class,<br \/>\n\tJamnagar below application Ex.55 in Criminal Case No.5414 of 2007.\n<\/p>\n<p>With<br \/>\n\tthese, the present Special Criminal Application is disposed of.<br \/>\n\tDirect Service Today is permitted.\n<\/p>\n<p>\t\t\t\t\t\t\t[M.R.\n<\/p>\n<p>SHAH, J.]<\/p>\n<p>rafik<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Nitin vs State on 30 September, 2008 Author: M.R.
