PACH'HAPLTRE..A J,..,]13EI,VIv--I=:REVD\nTHE FOLLOWING:       \n\nThe petition is filed Challenginiiigiaiithe,Vconizi'et_ion:  sentence\nfor the offence punishable of  Negotiable\nInstruments Act (herein after a trial held by\n\nthe J.M.F.C., ROn2_'Vari\u00a7jlI.i-'the:7convi'ction_Vand--sentence having been\n\ncon\ufb01rmed  the appeal \u00bbthe_TSessions Court.\n2. Thefacts rel.ev'a_nt forpthe purpose of this revision are as\n\nunder-\n parties are 'reiei\u00e9rea as per the rankpbefore the Trial\n\nCo'U,rtV'for't.hVe4\/I.\n\n\n\nand the father of the accused is the member of the said Bank and\nhad approached for the Ioan facility and on his applicationnidated\n\n20\/ 06\/ 2001 the Bank advanced an amount of \n\nloan to the father of the accused on prevaiiiingifuinteirest \n\nmortgaging the immovable as security   \nof the accused did not repay the loan. and \"inrthe  ;\nthe end of June 2007 the total amountdue   interest\nwas Rs. 3,39,267\/--. As the gegieused  not pay this\namount an arbitration case   was passed by\nthe arbitrator.  the accused was\nplaced for   auction the accused\nissued two :che'q-ii{{;\u00e9.V'.to}:::gs.5:o,Q.oo\/Li\ufb02\u00e9a\u00e9ii dated 31\/03\/2007 and\n10\/O4\/200'7:ii\"dra1i?Vn  Bank and in addition to\nthese two cheques an afmounitdof Rs.1,00,000\/-- in cash was also\n\npggd by   .   ..... .._p.approachied the Sessions Court in Cr]. Appeal No. 59\/ 2007 and the\n\n   came to be heard on merits and vide judgment and\n\norderigdated 27 \/O8\/2007, the appeal came to be dismissed.\n\ned\n\n\n\nand perverse. Per contra, the learned counsel appearing for\n\nrespondent submits that the payment which has been r,r_1Vac1e.i__s by\n\nthe father of the petitioner and not by the accused _hirnself in\n\nsuch circumstances it cannot be considered asa they \n\namount of \ufb01ne ordered by the Court be;loW,,,  theicircuznsrtanrges,\n\nit is submitted that there is no material to\"warrantiVa'iiy Vinterfereiice ; e\n\nin the orders of the Court below.\n\n9. I have scrutinisedeomplainant and the\ndocuments produceiiegn   siuijiniissions made by\nthe learned counsel  be seen from the\nallegations  serious dispute that the\naccused had  cheques at the time when the\nauction was 'being held  were issued towards the\n\npayment ;of the lialzzility of \"his father. Under the circumstances,\n\n'takinginto Zclozisideration the provision of Section 138 of the Act,\n\nthe the cheques towards the liability of his father\n\nAland thei\"ef0r{5 issuance of cheques is within the purview of the\n\nit \" 'T  133 \"of; the Act. \u00e9\u00e9\n\n\n\n10. The perusal of the evidence of P.W.1 and 2 and the fact\nthat the cheques have been produced, which were returnedpiiiby the\n\nBank with an endorsement of 'Insufficient Funds'  \n\ndespite the notice, the accused did not repay the,.aiinoU:nt\u00ab_Aof the \n\ncheques raises a presumption under the  \\\nof the N.Ii. Act and thereby there.'_is miaterial  \naccused has committed an offenceiiiiip:uinishable~under'Section 138\nof the Ni. Act. So far presumption is\nconcerned, it is relevant to  neither replied\nthe notice nor en'teii*ed.' the  the allegations\nmade. Though  that an amount\nmore  I\ufb02aidiiiiunder the receipts dated\n03\/ 11  the  receipt reveals that an amount of\n\nRs. 58,9s_1_\/-- aaa vRs.._+i6,i2_77'~~\/'i-- was paid on the said date to the\n\n,*'con;plainian;trBavnk and\"it\"*is mentioned in the receipt that the said\n\namount \"is  from RM. Mathapathi, who is none else than\n\ni it  ,_the father of theiiipetitioner. In the circumstances, it cannot be said\n\n,that it is the; petitioner\/accused, who has made the payment of\n\n  avmount to the Bank. Therefore, the petitioner cannot seek the\n\nMa.\n\n\n\nset off of this payment made, towards the \ufb01ne amount which has\n\nbeen ordered by the Trial Court.   \n11. The learned counsel for petitioner submitted Vlthat \"the\n\norder of the Trial Court so far as the sentence of  \nconcerned is harsh. It is relevant to n'ote\"\"that'..l&thel  i T\ntaken the responsibility to make the  \nfather as a moral obligation on   has been\ndone by the petitioner, I do not thinkthere shoulcivibe a harsh\napproach against the petitioner.' ' \u00a7o.it;21i'\u00a7ingfintovconsideration these\n\nfacts, I am of the opinion  ord:er,_diret;\u00abting the petitioner to\n\nundergo ir:ilprisonihent\"for  is rather unreasonable and\nimproper.  think  and proper if the petitioner is\n\ndirected to payiilsrome. fineiinliaddition to the fine of Rs.1,00,000\/-,\n\n:_i\"Wh.ich viisl\"pa3Iabrle to lthe-respondent towards the liability. In that\n\nView th.e\"mat_i:erTVto the extent of imprisonment is concerned, the\n\n ,_order ii.nipugne'd'i__h:as to be modified. Hence, i answer the point\n\n 'partly in affirmative and party in negative and proceed to pass the\n\ni' \"  \n\n\n\nORDER\n<\/pre>\n
