Justice R.BASANT\n\n Dated :19\/06\/2007\n\n O R D E R\n                                    R.BASANT, J\n\n                          ------------------------------------\n\n                               B.A.No.3691 of 2007\n\n                          -------------------------------------\n\n                      Dated this the 19th day of June, 2007\n\n\n                                        ORDER\n<\/pre>\n<p>       Application   for   anticipatory   bail.     The   1st  petitioner   is   the<\/p>\n<p>husband   of   the   defacto   complainant.     Some   of   the   co-accused   have<\/p>\n<p>been   granted   anticipatory   bail   by   the   learned   Sessions   Judge.<\/p>\n<p>Petitioner&#8217;s   prayer   was   turned   down.     Marriage   took   place   in   2003.<\/p>\n<p>There   is   strain   in   the   relationship   between   the   spouses.     They   are<\/p>\n<p>residing   separately.     Wife   so   residing   separately   has   filed   a   private<\/p>\n<p>complaint.     That   was   referred   to   the   police   under   Section   156(3)<\/p>\n<p>Cr.P.C.  Investigation is in progress.  Petitioner apprehends imminent<\/p>\n<p>arrest for the offence under Section 498 A I.P.C.<\/p>\n<p>       2.      The   learned   counsel   for   the  petitioner   prays,   the   learned<\/p>\n<p>Public Prosecutor  does not seriously oppose the said prayer and I am<\/p>\n<p>satisfied   that   direction   under   Section   438   Cr.P.C   can   be   issued   in<\/p>\n<p>favour of the petitioner.   In coming to this conclusion, I take note of<\/p>\n<p>the   fact   that   no   serious   injuries   are   suffered   by   the   victim   and   the<\/p>\n<p>contention   is   that   fanciful   and   exaggerated   allegations   are   raised<\/p>\n<p>because   of   the   strain   in   the   matrimonial   relationship.     Appropriate<\/p>\n<p>conditions   can   be   imposed   in   the   interests   of   a   fair,   efficient   and<\/p>\n<p>expeditious investigation.\n<\/p>\n<p>\n<span class=\"hidden_text\">B.A.No.3691 of 2007                           2<\/span><\/p>\n<p>         3.      In   the   result,   this   Bail   Application   is,   allowed.     The<\/p>\n<p>following directions are issued under Section 438 Cr.P.C.<\/p>\n<p>         i)      The petitioner shall appear before the learned Magistrate<\/p>\n<p>having jurisdiction at 11 a.m on 26.06.2007.   He shall be released on<\/p>\n<p>regular  bail   on his executing a  bond  for Rs.25,000\/-  (Rupees  Twenty<\/p>\n<p>Five thousand only)   each with two solvent sureties each for the like<\/p>\n<p>sum to the satisfaction of the learned Magistrate;<\/p>\n<p>         ii)     The   petitioner   shall   make   himself   available   for<\/p>\n<p>interrogation   before   the   Investigating   Officer   between   10   a.m   and   4<\/p>\n<p>p.m on 27.06.2007 and thereafter between 10 a.m and 12 noon on all<\/p>\n<p>Mondays and Fridays until further orders;\n<\/p>\n<\/p>\n<p>         iii)    If   the   petitioner   does   not   appear   before   the   learned<\/p>\n<p>Magistrate   as   directed   in   clause   (i),   directions   issued   above   shall<\/p>\n<p>thereafter   stand   revoked   and   the   police   shall   be   at   liberty   to   arrest<\/p>\n<p>the   petitioner   and   deal   with   him   in   accordance   with   law   as   if   those<\/p>\n<p>directions were not issued at all;\n<\/p>\n<\/p>\n<p>         iv)     If   the   petitioner   were   arrested   prior   to   his   surrender   on<\/p>\n<p>26.06.07 as directed in clause (1) above, he shall be released   on his<\/p>\n<p>executing a bond for Rs.25,000\/- (Rupees Twenty Five thousand only)<\/p>\n<p>without   any   sureties   undertaking   to   appear   before   the   learned<\/p>\n<p>Magistrate on 26.06.07.\n<\/p>\n<\/p>\n<p>                                                               (R.BASANT, JUDGE)<\/p>\n<p>rtr\/-\n<\/p>\n<p>\n<span class=\"hidden_text\">B.A.No.3691 of 2007    3<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Rajesh P.K. vs Sub Inspector Of Police on 19 June, 2007 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl No. 3691 of 2007() 1.
