The Mukhia Gram Panchayat Raj Ichaloo\n                   under       Block        Dugarwa,      District\n                   Purnea.........................Respondents\n                                     --------\n<\/pre>\n<p>3.   17.08.2010          Heard    learned     counsel   for    the<\/p>\n<p>                  petitioner and learned counsel for the State.<\/p>\n<p>                            Learned counsel for the petitioner as<\/p>\n<p>                  well as learned counsel for the State informs<\/p>\n<p>                  this Court that now the Appellate Authorities<\/p>\n<p>                  constituted by the State Government under Rule<\/p>\n<p>                  18 of the Bihar Panchayat Prarambhik Shikshak<\/p>\n<p>                  (Niyojan Avam Seva Sart) Niyamvali, 2006 (as<\/p>\n<p>                  amended by Amendment Act, 2008) are functional<\/p>\n<p>                  and   are      now   efficacious        alternative        forums<\/p>\n<p>                  available      to    the    petitioner      and    others     for<\/p>\n<p>                  consideration of their grievances.<\/p>\n<pre>                            In    view       of    the   submissions    of      the\n\n                  learned        counsels         and    in   view      of      the\n<span class=\"hidden_text\">                           -2-<\/span>\n\n\n\n\n      availability         of        the   efficacious        alternative\n\n<\/pre>\n<p>      forum for consideration of matters relating to<\/p>\n<p>      employment of Shiksha Mitra\/Panchayat Shikshak,<\/p>\n<p>      the     writ    application           is       disposed   of     with<\/p>\n<p>      liberty        to        the     petitioner        to     file    an<\/p>\n<p>      appropriate         application           before   the    concerned<\/p>\n<p>      Appellate Authority, if not already filed, for<\/p>\n<p>      redressal of his grievance. In case such an<\/p>\n<p>      application         is    filed      by    the   petitioner,     the<\/p>\n<p>      Appellate Authority shall consider the same and<\/p>\n<p>      all documents enclosed including orders of this<\/p>\n<p>      Court     in        identical         matters,      if    produced<\/p>\n<p>      therewith and make all endeavours to dispose of<\/p>\n<p>      the same on its own merits after hearing the<\/p>\n<p>      parties        concerned,            by    a     speaking      order<\/p>\n<p>      preferably within the time prescribed under the<\/p>\n<p>      Rules for the purpose without going into the<\/p>\n<p>      question of limitation.\n<\/p>\n<p>                It is made clear that this Court has not<\/p>\n<p>      expressed any opinion with regard to the merits<\/p>\n<p>      of the claim of the petitioner.\n<\/p>\n<\/p>\n<pre>B.T                            (J.
