       Petition for bail.\n<\/p>\n
       2. The alleged offences are under sections 143, 147, 148,<\/p>\n
341, 307, 324, 302 read with section 149 IPC. According to<\/p>\n
prosecution, there was a dispute between two groups regarding<\/p>\n
the presidentship of the mosque committee. On the crucial day<\/p>\n
there was a quarrel between them in the mosque on this and<\/p>\n
following the quarrel, petitioners along with other accused<\/p>\n
attacked de facto complainant and others using knives, iron rod,<\/p>\n
stick, etc. De facto complainant’s two brothers were murdered.<\/p>\n
Four other persons were injured in the incident.<\/p>\n
       3. Accused 1, 3, 4, 5 and 7 were arrested on 4-9-2008,<\/p>\n
accused 6 and 9 were arrested on 6-10-2008 and 10th accused<\/p>\n
was arrested on 30-8-2008. Learned counsel for petitioners<\/p>\n
submitted that petitioners are in jail for a very long time. It is also<\/p>\n
submitted that various accused in this case also sustained serious<\/p>\n
injuries in the course of the same incident and they were<\/p>\n
hospitalized. According to petitioners, incident happened while<\/p>\n
the 2nd accused (who was subsequently deleted from the array of<\/p>\n
the accused) was taking water from the mosque. He filed a<\/p>\n

complaint, based on which, Crime No.432\/2008 was registered<\/p>\n
against de facto complainant in this case and various others for<\/p>\n
assaulting him and many of the accused in this case. But, the<\/p>\n
accused in that case are at large and not arrested so far.<\/p>\n
       4. It is pointed out that a car in which de facto complainant<\/p>\n
and others were travelling was found to contain some weapons<\/p>\n
and that will indicate that de facto complainant and others were<\/p>\n
carrying weapons.      It is   also submitted that petitioners are<\/p>\n
prepared to abide by any condition and they will not enter the<\/p>\n
limits of police station which which the crime is registered.<\/p>\n
Petitioners had sustained serious injuries including penetrating<\/p>\n
wound, etc. Hence, they may be granted bail, it is submitted.<\/p>\n
      5.    This petition is strongly opposed. Learned public<\/p>\n
prosecutor submitted that these cases involve a quarrel between<\/p>\n
two factions in which two persons succumbed to the injuries<\/p>\n
sustained in the incident. Four persons were injured and they<\/p>\n
were hospitalized. Deadly weapons were used for the offence by<\/p>\n
both sides and another case was also registered for offence under<\/p>\n
section 307 IPC etc. But, it is not correct to say that the police was<\/p>\n
inactive in not arresting the accused in the counter case. They<\/p>\n
were injured and hospitalized.\n<\/p>\n

       6. The submission made by petitioners counsel itself<\/p>\n
reveals that in connection with this incident both sides were<\/p>\n
injured. It is pointed out by learned Public Prosecutor. If the<\/p>\n
petitioners are released on bail, it is likely that there will be more<\/p>\n
bloodshed. The opposite group will be waiting for the release of<\/p>\n
petitioners to retaliate and in such case, there will be law and<\/p>\n
order problem in the locality. There is already a tensed situation<\/p>\n
in the locality, though apparently it appears to be calm, learned<\/p>\n
Public Prosecutor submitted.\n<\/p>\n
            7.    On hearing both sides, it appears that there were<\/p>\n
attacks by two groups against each other and both were using<\/p>\n
weapons at the premises of a mosque. However, 10th accused was<\/p>\n
in judicial custody from 30-8-2008 onwards for the past 85 days.<\/p>\n
The charge sheet is not submitted so far. If 90 days are<\/p>\n
completed, he will be entitled to statutory bail. His name is not<\/p>\n
mentioned in the F.I.R. and no overt act is attributed to him as per<\/p>\n
the allegations in the F.I.R. In such circumstances, I find that<\/p>\n
10th accused can be granted bail on stringent conditions but, I am<\/p>\n
not inclined to grant bail to other accused.\n<\/p>\n
      8. In the result, the following order is passed.<\/p>\n
     1)The 10thaccused is granted bail on his executing a bond<\/p>\n

           for Rs.1 lakh with two solvent sureties each for the<\/p>\n
           like amount to the satisfaction of the learned<\/p>\n
           Magistrate     concerned,     on     the    following<\/p>\n
           conditions:-\n<\/p><\/blockquote>\n
           i)   He shall report before the Superintendent<\/p>\n
                of Police, Malappuram on every alternate<\/p>\n
                day between      10 a.m. and 1 p.m. until<\/p>\n
                further orders.\n<\/p><\/blockquote>\n
           ii)  He shall not enter the limits of the<\/p>\n
                police station within which the crime<\/p>\n
                is registered.\n<\/p><\/blockquote>\n
           iii) He shall surrender his passport, if any ,<\/p>\n
                before      the    Magistrate      Court<\/p>\n
                concerned within seven days from his<\/p>\n
                release on bail. If he has no passport,<\/p>\n
                he shall file an affidavit to that effect<\/p>\n
                before the Magistrate Court, within<\/p>\n
                seven days from today.\n<\/p><\/blockquote>\n
           iv)  He shall reside at a place lying within<\/p>\n
                a radius of 3 k.m. from the office of<\/p>\n
                the Superintendent of Police.<\/p>\n<\/blockquote>\n

           v)     He shall not intimidate or influence<\/p>\n
                any witness or tamper with evidence<\/p>\n
                or commit any offence while on bail<\/p>\n
                and in case breach of this condition,<\/p>\n

     2) The prayer for bail by other accused is rejected.<\/p>\n
