{"id":98094,"date":"2010-01-27T00:00:00","date_gmt":"2010-01-26T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/surendra-kumar-gupta-vs-state-of-u-p-others-on-27-january-2010"},"modified":"2018-09-01T20:33:28","modified_gmt":"2018-09-01T15:03:28","slug":"surendra-kumar-gupta-vs-state-of-u-p-others-on-27-january-2010","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/surendra-kumar-gupta-vs-state-of-u-p-others-on-27-january-2010","title":{"rendered":"Surendra Kumar Gupta vs State Of U.P. &amp; Others on 27 January, 2010"},"content":{"rendered":"<div class=\"docsource_main\">Allahabad High Court<\/div>\n<div class=\"doc_title\">Surendra Kumar Gupta vs State Of U.P. &amp; Others on 27 January, 2010<\/div>\n<pre>Court No. - 18\n\nCase :- WRIT - A No. - 1966 of 2010\n\nPetitioner :- Surendra Kumar Gupta\nRespondent :- State Of U.P. &amp; Others\nPetitioner Counsel :- Manish Kumar Nigam,Ashok Kumar\nRespondent Counsel :- C.S.C.,Rajeshwar Singh\n\nHon'ble Sudhir Agarwal, J.\n<\/pre>\n<p>Heard learned counsel for the petitioner and learned Standing Counsel for the<br \/>\nrespondents.\n<\/p>\n<p>The petitioner was placed under suspension by order dated 12.10.2009<br \/>\n(Annexure 4 to the writ petition) whereagainst he filed writ petition no. 56575<br \/>\nof 2009 which was disposed of permitting the matter to be considered by the<br \/>\nDistrict Basic Education Officer in the light of the explanation submitted by<br \/>\nthe petitioner in the above writ petition and pursuant thereto, the impugned<br \/>\norder dated 18.12.2009 has been passed by the District Basic Education<br \/>\nOfficer, Kushinagar which shows that the petitioner has been found prima<br \/>\nfacie guilty of misappropriation of funds in respect to construction of the<br \/>\nschool building and, therefore, he has been placed under suspension. It cannot<br \/>\nbe disputed that the allegations, if proved, constitute a serious misconduct.<br \/>\nThis Court does not propose to make any further observation since it would<br \/>\nprejudice the enquiry which is yet to be conducted against the petitioner. It<br \/>\ncould not be shown by the learned counsel for petitioner that the impugned<br \/>\norder of suspension is without jurisdiction or is otherwise contrary to any<br \/>\nstatutory provision or has been passed on account of mala fide. Hence, no<br \/>\ninterference, in my view, is called for at this stage. However, since the<br \/>\npetitioner has been placed under suspension in October&#8217; 2009 in a<br \/>\ncontemplated departmental enquiry which has not been initiated so far, it<br \/>\nwould be in the interest of justice that the respondent-disciplinary authority<br \/>\nshould complete the departmental enquiry, if any, against the petitioner<br \/>\nexpeditiously preferably within six months from the date of production of a<br \/>\ncertified copy of this order.\n<\/p>\n<p>With the above observation, the writ petition is finally disposed of.<br \/>\nDt. 27.1.2010<br \/>\nPS-1966\/2010\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Surendra Kumar Gupta vs State Of U.P. &amp;
