The charge sheet is at page 12 dated<br \/>\n\t03\/06\/2009.  Apparently, charge which has been levelled against<br \/>\n\tpetitioner are relating to financial irregularities committed by<br \/>\n\tpetitioner.  In respect to pensionary benefit as per Gujarat Civil<br \/>\n\tServices Pension Rules, 2002, Rule 24, departmental inquiry shall<br \/>\n\tremain continue after retirement and for that whether pension is<br \/>\n\trequired to be reduced or not? The show cause notice has been served<br \/>\n\tto petitioner.  Against which, detailed reply has been submitted by<br \/>\n\tpetitioner on 13\/7\/2009 at page 17.\n<\/p>\n<p>Learned<br \/>\n\tadvocate Mr. Thakkar submitted that departmental inquiry is not<br \/>\n\tstill commenced even reply has been submitted on 13\/7\/2009,  though<br \/>\n\tmore than two years have passed.  Therefore, he submitted that some<br \/>\n\tsuitable directions may be issued to Inquiry Officer\/Competent<br \/>\n\tAuthority.  So, they may complete inquiry as early as possible<br \/>\n\twithin reasonable time.  The date of retirement of petitioner is<br \/>\n\t31\/8\/2015.\n<\/p>\n<p>Learned<br \/>\n\tAGP Mr. AL Sharma appearing for respondent submitted that after<br \/>\n\treceiving reply from petitioner now authority will appoint Inquiry<br \/>\n\tOfficer according to Rules. If petitioner wants early hearing of<br \/>\n\tdepartmental inquiry then he may file necessary application before<br \/>\n\tCompetent authority\/Inquiry Officer to complete inquiry as early as<br \/>\n\tpossible within reasonable time.\n<\/p>\n<p>In<br \/>\n\tview of above facts and circumstances and considering question that<br \/>\n\tafter submitting reply more than two years have passed, but till<br \/>\n\tdate no departmental inquiry is initiated by Competent<br \/>\n\tauthority\/Inquiry Officer.  Therefore, let petitioner may file one<br \/>\n\tapplication with a request to Competent Authority\/Inquiry Officer to<br \/>\n\tcomplete such departmental inquiry against petitioner as early as<br \/>\n\tpossible within some reasonable time. So mental agony of petitioner<br \/>\n\tis not remained continued unnecessary for long period.\n<\/p>\n<p>As<br \/>\n\tand when Competent authority\/Inquiry Officer receive such<br \/>\n\tapplication, it is directed to both authority to consider such<br \/>\n\tapplication made by petitioner and also considering fact that<br \/>\n\tincident is of 1997.  The charge sheet has been served on<br \/>\n\t03\/06\/2009, which has been replied on 13\/7\/2009 more than two years<br \/>\n\thave passed till today no departmental inquiry is commenced by<br \/>\n\tauthorities.\n<\/p>\n<p>Therefore,<br \/>\n\tlet Competent authority\/ Inquiry Officer may consider it<br \/>\n\tsympathetically and to see that departmental inquiry must have been<br \/>\n\tcommenced as early as possible and to be completed at least within<br \/>\n\treasonable time and to see that departmental inquiry is not to be<br \/>\n\tprolong unnecessarily. If possible, departmental inquiry must have<br \/>\n\tto be over within a period of one year from date of receiving copy<br \/>\n\tof such application from petitioner and petitioner must have to<br \/>\n\tcooperate such inquiry to Competent authority\/ Inquiry Officer.\n<\/p>\n<p>It<br \/>\n\tis open for petitioner to raise all contentions which has been<br \/>\n\traised before this Court in present petition before Inquiry<br \/>\n\tOfficer\/Competent authority.
