The\u00a0point\u00a0for\u00a0consideration\u00a0in\u00a0this\u00a0appeal\u00a0is\u00a0Sl.No.4\u00a0in\u00a0appellant&#8217;s\u00a0<br \/>\nRTI\u00adapplication, \u00a0 which \u00a0 was \u00a0 relating \u00a0 to \u00a0 disclosure \u00a0 of \u00a0 the \u00a0 soft \u00a0 copy \u00a0 of\u00a0<br \/>\nLedger\u00a0Account\u00a0Cards\u00a0as\u00a0on\u00a0the\u00a0date\u00a0of\u00a0the\u00a0application,\u00a0viz.\u00a001.03.2010.\n<\/p>\n<p>3.     Respondents\u00a0explained\u00a0that\u00a0the\u00a0soft\u00a0copies\u00a0of\u00a0the\u00a0ledger\u00a0accounts\u00a0<br \/>\nsought \u00a0 by \u00a0 the \u00a0 appellant \u00a0 contained \u00a0 personal \u00a0 details \u00a0 of \u00a0 around \u00a0 54,000\u00a0<br \/>\nemployees.\u00a0 \u00a0These\u00a0details\u00a0comprised\u00a0names,\u00a0the\u00a0contribution\u00a0by\u00a0each,\u00a0<br \/>\ninterest\u00a0payment,\u00a0if\u00a0any\u00a0and\u00a0so\u00a0on.\u00a0\u00a0These\u00a0could\u00a0not\u00a0be\u00a0authorized\u00a0to\u00a0be\u00a0<br \/>\ndisclosed\u00a0as\u00a0the\u00a0exemption\u00a0under\u00a0Section\u00a08(1)(j)\u00a0was\u00a0attracted.\n<\/p>\n<p>4     I\u00a0am\u00a0in\u00a0agreement \u00a0with\u00a0the\u00a0respondents \u00a0that\u00a0the\u00a0details \u00a0such\u00a0as\u00a0<br \/>\nthose\u00a0mentioned\u00a0above\u00a0were\u00a0in\u00a0the\u00a0personal\u00a0domain\u00a0of\u00a0the\u00a0contributors\u00a0to\u00a0<br \/>\nCIC_AT_A_2010_000373_M_43167.doc\u00a0<br \/>\n                                                                            Page\u00a01\u00a0of\u00a03<br \/>\n the\u00a0fund\u00a0and\u00a0could\u00a0not\u00a0be\u00a0allowed\u00a0to\u00a0be\u00a0disclosed\u00a0to\u00a0an\u00a0RTI\u00a0applicant.\u00a0<br \/>\nSection\u00a08(1)(j)\u00a0is\u00a0attracted.\n<\/p>\n<p>5.     Appeal\u00a0fails.\u00a0\u00a0Closed.\n<\/p>\n<p>Appeal\u00a0No.CIC\/AT\/A\/2010\/000373:\n<\/p>\n<p>6.    Appellant&#8217;s \u00a0 RTI\u00adqueries \u00a0 comprised \u00a0 in \u00a0 his \u00a0 application \u00a0 dated\u00a0<br \/>\n27.02.2010\u00a0were\u00a0mostly\u00a0in\u00a0regard\u00a0to\u00a0the\u00a0management\u00a0of\u00a0the\u00a0depositors\u00a0<br \/>\nfunds\u00a0by\u00a0the\u00a0Board\u00a0of\u00a0Trustees.\n<\/p>\n<p>7.    Respondents \u00a0have \u00a0cited \u00a0non\u00addisclosure \u00a0agreement \u00a0with \u00a0the \u00a0fund\u00a0<br \/>\nmanagers\u00a0to\u00a0decline\u00a0the\u00a0requested\u00a0information.\u00a0\u00a0Appellate\u00a0Authority\u00a0cited\u00a0<br \/>\nSection\u00a08(1)(e)\u00a0to\u00a0decline\u00a0disclosure.\n<\/p>\n<p>8.      In \u00a0 my \u00a0 view, \u00a0 such \u00a0 a \u00a0 manner \u00a0 of \u00a0 denial \u00a0 of \u00a0 information \u00a0 for \u00a0 specific\u00a0<br \/>\nqueries\u00a0is\u00a0procedurally\u00a0deficient.\u00a0 \u00a0A\u00a0reading\u00a0of\u00a0the\u00a0queries\u00a0shows\u00a0that\u00a0a\u00a0<br \/>\nlarge\u00a0part\u00a0of\u00a0these\u00a0relate\u00a0to\u00a0figures\u00a0of\u00a0funds\u00a0deposited,\u00a0interest\u00a0rates\u00a0paid\u00a0<br \/>\nby\u00a0various\u00a0Banks,\u00a0differential\u00a0rates\u00a0of\u00a0Private\u00a0and\u00a0Public\u00a0Sector\u00a0Banks,\u00a0<br \/>\namong\u00a0others.\u00a0\u00a0Similarly,\u00a0other\u00a0queries\u00a0were\u00a0also\u00a0regarding\u00a0such\u00a0details\u00a0<br \/>\nas \u00a0 the \u00a0 names \u00a0 of \u00a0 the \u00a0 Banks \u00a0 where \u00a0 the \u00a0 funds \u00a0 were \u00a0 deposited \u00a0 and \u00a0 the\u00a0<br \/>\nmanner\u00a0approval\u00a0of\u00a0the\u00a0Board\u00a0of\u00a0Trustees\u00a0was\u00a0taken.\u00a0 \u00a0A\u00a0little\u00a0reflection\u00a0<br \/>\nabout\u00a0each\u00a0one\u00a0of\u00a0these\u00a0queries\u00a0could\u00a0have\u00a0revealed\u00a0that\u00a0quite\u00a0a\u00a0large\u00a0<br \/>\nnumber\u00a0of\u00a0information\u00a0could\u00a0be\u00a0provided\u00a0from\u00a0the\u00a0information\u00a0as\u00a0held\u00a0by\u00a0<br \/>\nthe \u00a0 public \u00a0 authority, \u00a0 viz. \u00a0 CMPF, \u00a0 without \u00a0 violating \u00a0 any \u00a0 confidentiality\u00a0<br \/>\nagreement \u00a0 that \u00a0 might \u00a0 be. \u00a0 \u00a0 The \u00a0 Commission \u00a0 has \u00a0 been \u00a0 advising \u00a0 the\u00a0<br \/>\nAppellate\u00a0Authorities\u00a0and\u00a0the\u00a0CPIOs\u00a0to\u00a0invariably\u00a0consider\u00a0each\u00a0item\u00a0of\u00a0<br \/>\ninformation\u00a0autonomously\u00a0for\u00a0reply\u00a0and\u00a0to\u00a0avoid\u00a0taking\u00a0omnibus\u00a0positions.\n<\/p>\n<p>9.     I\u00a0would\u00a0like\u00a0the\u00a0Appellate\u00a0Authority,\u00a0CMPF\u00a0to\u00a0reconsider\u00a0the\u00a0range\u00a0<br \/>\nof\u00a0queries\u00a0de\u00adnovo\u00a0and\u00a0to\u00a0give\u00a0a\u00a0reply\u00a0to\u00a0each\u00a0of\u00a0these\u00a0queries\u00a0in\u00a0the\u00a0light\u00a0<br \/>\nof \u00a0 legal \u00a0 provisions, \u00a0 without \u00a0 any \u00a0 mental \u00a0 pre\u00addispositions \u00a0 or \u00a0 pre\u00ad<br \/>\ndetermination. \u00a0 \u00a0 If \u00a0 considered \u00a0 necessary, \u00a0 the \u00a0 third\u00adparties \u00a0 \u2015 \u00a0 the \u00a0 fund\u00a0<\/p>\n<p>CIC_AT_A_2010_000373_M_43167.doc\u00a0<br \/>\n                                                                               Page\u00a02\u00a0of\u00a03<br \/>\n managers \u00a0 \u2015 \u00a0 might \u00a0 also \u00a0 be \u00a0 consulted \u00a0 under \u00a0 Section \u00a0 7(7) \u00a0 and \u00a0 Section\u00a0<br \/>\n11(1)\u00a0of\u00a0the\u00a0RTI\u00a0Act.\n<\/p>\n<p>10. Matter \u00a0is\u00a0accordingly \u00a0remitted \u00a0back \u00a0to\u00a0the\u00a0Appellate \u00a0Authority \u00a0for\u00a0<br \/>\nde\u00adnovo\u00a0consideration\u00a0and\u00a0decision\u00a0within\u00a0four\u00a0weeks.\n<\/p>\n<p>11.
