Opposite Party\/s<br \/>\n                 ==================================================<\/p>\n<p>2   25-08-2011                    Heard learned counsel for petitioner and<\/p>\n<p>                    learned counsel for the State.\n<\/p>\n<p>                                  The petitioner apprehends his arrest in<\/p>\n<p>                    connection with a case registered for the offence<\/p>\n<p>                    under sections 420 and 409\/34 of the Indian Penal<\/p>\n<p>                    Code.\n<\/p>\n<p>                              It is stated that the First Information<\/p>\n<p>                    Report has been registered at the instance of<\/p>\n<p>                    one,    Kalyan    Kumar,    Executive     Engineer.     He   has<\/p>\n<p>                    stated    that     during       tenure   of    one,   Murlidhar<\/p>\n<p>                    Prasad, Executive Engineer in the year 2004-05,<\/p>\n<p>                    certain advance was made to different Engineers<\/p>\n<p>                    and     the    advance     so    made    was   not    adjusted.<\/p>\n<p>                    Subsequently,        said        Murlidhar       Prasad      was<\/p>\n<p>                    transferred to different division and charge was<\/p>\n<p>                    handed over to the petitioner on 15.07.2005. The<\/p>\n<p>                    petitioner was thereafter transferred from the<br \/>\n<span class=\"hidden_text\"> Patna High Court Cr.Misc. No.28299 of 2011 (2)<\/span><br \/>\n                                            2 dt.25-08-2011<\/p>\n<p>                   said division on 01.03.2008. The main allegation<\/p>\n<p>                   which has been leveled against him is that he did<\/p>\n<p>                   not     take      proper      action        for       adjustment       of     the<\/p>\n<p>                   advance          made       to        the        different           engineers<\/p>\n<p>                   subordinate to him. It is alleged that there is<\/p>\n<p>                   dereliction of duty on his part. Learned counsel<\/p>\n<p>                   for the petitioner submits that he had written<\/p>\n<p>                   some letters during his tenure to the engineers<\/p>\n<p>                   concerned in this regard but unfortunately the<\/p>\n<p>                   advance so made could not be adjusted during his<\/p>\n<p>                   tenure. He further submits that the allegation as<\/p>\n<p>                   against the petitioner is not of receiving any<\/p>\n<p>                   amount as advance or defalcating any government<\/p>\n<p>                   money       and     in     that       view        of    matter        at     best<\/p>\n<p>                   accusation           as     against             him    would        invite      a<\/p>\n<p>                   disciplinary              proceeding             but     he     cannot         be<\/p>\n<p>                   subjected to criminal proceeding.<\/p>\n<pre>                               Be      that         as        it     may,        taking         into\n\n                   consideration             the        fact       that     the        amount     in\n\n<\/pre>\n<p>                   question was not received by the petitioner nor<\/p>\n<p>                   it    was     advanced          by    him,       let     the    petitioner,<\/p>\n<p>                   namely, Ram Padarath Narayan in the event of his<\/p>\n<p>                   arrest or surrender before the court below within<\/p>\n<p>                   a     period       of     four        weeks       from        the     date    of<\/p>\n<p>                   receipt\/communication of the order be released on<br \/>\n<span class=\"hidden_text\"> Patna High Court Cr.Misc. No.28299 of 2011 (2)<\/span><br \/>\n                                            3 dt.25-08-2011<\/p>\n<p>                   bail on furnishing bail bonds of Rs.5,000\/- (five<\/p>\n<p>                   thousand) with two sureties of the like amount<\/p>\n<p>                   each      to      the     satisfaction       of    learned   Chief<\/p>\n<p>                   Judicial         Magistrate,           Vaishali   at   Hajipur   in<\/p>\n<p>                   connection with Hajipur Sadar P.S.
