No.36527 of 2010\n                   CHHOTAN RAI, son of Lakhi Rai\n                                Versus\n                         STATE OF BIHAR\n                               -----------\n<\/pre>\n<p>2\/-   28.10.2010            Heard learned Counsel for the petitioner and the<\/p>\n<p>                   State.\n<\/p>\n<p>                            The petitioner seeks bail in a case instituted for<\/p>\n<p>                   the offence under section 302\/34 of the Indian Penal<\/p>\n<p>                   Code.\n<\/p>\n<p>                            Considering that there is no direct material<\/p>\n<p>                   against the petitioner and the entire case is based on<\/p>\n<p>                   suspicion, let the petitioner above named, who is in<\/p>\n<p>                   custody since 15.05.2010, be released on bail on<\/p>\n<p>                   furnishing bail bond of Rs.5,000\/- (Five thousand) with<\/p>\n<p>                   two sureties of the like amount each or any other surety<\/p>\n<p>                   to be fixed by the court concerned to the satisfaction of<\/p>\n<p>                   Sub-Divisional Judicial Magistrate, Sheohar, in Tariyani<\/p>\n<p>                   P.S. Case No. 62 of 2010 subject to the conditions, (i)<\/p>\n<p>                   That one of the bailor will be a close relative of the<\/p>\n<p>                   petitioner who will give an affidavit giving genealogy as<\/p>\n<p>                   to how he is related with the petitioner. The bailor will<\/p>\n<p>                   undertake to furnish information to the Court about any<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>            change in address of the petitioner. (ii) That the affidavit<\/p>\n<p>            shall clearly state that the petitioner is not an accused in<\/p>\n<p>            any other case and if he is he shall not be released on<\/p>\n<p>            bail, (iii) That the bailor shall also state on affidavit that<\/p>\n<p>            he will inform the court concerned if the petitioner is<\/p>\n<p>            implicated in any other case of similar nature after his<\/p>\n<p>            release in the present case and thereafter the court below<\/p>\n<p>            will be at liberty to initiate the proceeding for<\/p>\n<p>            cancellation of bail on ground of misuse, (iv) That the<\/p>\n<p>            petitioner will give an undertaking that he will receive<\/p>\n<p>            the police papers on the given date and be present on<\/p>\n<p>            date fixed for charge and if he fails to do so on two given<\/p>\n<p>            dates and delays the trial in any manner, his bail will be<\/p>\n<p>            liable to be cancelled for reasons of misuse, and (v) That<\/p>\n<p>            the petitioner will be well represented on each date if he<\/p>\n<p>            fails to do so on two consecutive dates, his bail will be<\/p>\n<p>            liable to be cancelled.\n<\/p>\n<\/p>\n<p>                                                    ( Anjana Prakash, J. )<\/p>\n<p>Ashwini\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Chhotan Rai vs State Of Bihar on 28 October, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
