     Heard learned counsel on both sides.         I had<\/p>\n
originally proposed to allow the writ petition on<\/p>\n
23.1.2009.   Later, on a submission made by the<\/p>\n
learned counsel for the first respondent, the matter<\/p>\n
was again heard. I heard Mr.Muhammed Mustaque<\/p>\n
learned        counsel            for    the  petitioner,<\/p>\n
Mr.E.K.Nandakumar,      learned counsel for the first<\/p>\n
respondent and learned Government Pleader<\/p>\n
2.   Petitioner opted for voluntary retirement from<\/p>\n
the first respondent in terms of Ext.P1 scheme.<\/p>\n
Clause 1 of Ext.P1 provides for the following financial<\/p>\n
package.\n<\/p>\n<\/p>\n
     “For eligible permanent employees,         an<\/p>\n
     amount equal to one and a half months<\/p>\n
     emoluments pay plus DA                for each<\/p>\n
     completed year the monthly emoluments<\/p>\n
     at the time of retirement multipled in the<\/p>\n

\n                               2<\/span><\/p>\n
      balance months of service left before normal<\/p>\n
      date of retirement whichever is less.<\/p>\n<\/blockquote>\n
           For example, an employee who has<\/p>\n
           put in 24 years of service and has got<\/p>\n
           only one more year or service for<\/p>\n
           normal retirement would get an<\/p>\n
           exgratia payment of 12 months<\/p>\n
           emoluments and not 36 months<\/p>\n
           emoluments whereas a person who<\/p>\n
           has put in 20 years of service with 5<\/p>\n
           more years for retirement, will get<\/p>\n
           a payment     equal to 20 months<\/p>\n
           emoluments and not 60 months (5<\/p>\n
           x 12) emoluments.”\n<\/p><\/blockquote>\n
\n<\/blockquote>\n
3.    Writ petition,    as it was originally instituted,<\/p>\n
contained a claim that the entire amount due to the<\/p>\n
petitioner in terms of the scheme,          has not been<\/p>\n
disbursed so far. There were proceedings earlier and<\/p>\n
pursuant to a direction issued in the Contempt of Court<\/p>\n
case, the Government issued Ext.P7 which dealt with<\/p>\n
the petitioner’s   claim   for arrears of wages for the<\/p>\n
period from 1.5.2003 to 6.4.2004, the latter being the<\/p>\n
date on which the petitioner actually left his service. It<\/p>\n
is contended that the stand taken in Ext.P7 is in<\/p>\n
consonance with Ext.R1(c), Government order dated<\/p>\n
W.P.(C).3534\/2006
\n                             3<\/span><\/p>\n
24.11.2005,      by which the Government had taken a<\/p>\n
general decision    to satisfy  the claim for arrears of<\/p>\n
salary raised by the erstwhile employees of public sector<\/p>\n
undertakings, which, due to financial stringency, were<\/p>\n
brought under a programme called `Social Safety Net<\/p>\n
Programme’, SSNP, which is reflected in Ext.P1. Apart<\/p>\n
from the financial package for VRS mentioned in Ext.P1,<\/p>\n
they are also entitled to wages till the date on which<\/p>\n
they had left service. This is denied by the Government<\/p>\n
as also the Company. It is this aspect which has been<\/p>\n
substantially urged by the petitioner in this writ petition.<\/p>\n
4.   The stand taken by the Government in Ext.R1(c)<\/p>\n
Order,     which forms     the   basis of Ext.P7,       was<\/p>\n
considered by me in Writ Petition No.3800\/2005 and<\/p>\n
connected case. Government’s stand in Ext.R1(c) was<\/p>\n
upheld. It is seen that the judgment has been affirmed<\/p>\n
by the Bench in Writ Appeal No.2835\/2007.<\/p>\n
5.   I have noticed    in the aforementioned judgment,<\/p>\n
that the amount which the workman receives as a<\/p>\n
financial package under the VRS should be treated as<\/p>\n

\n                              4<\/span><\/p>\n
one     in full and final settlement of the claim of the<\/p>\n
workmen as against the Company for proceeding on<\/p>\n
voluntary retirement. This the workman receives when<\/p>\n
he is relieved from the Company on VRS. The claim for<\/p>\n
arrears of salary was raised by similar workmen, while<\/p>\n
it was considered by the Government and this led to<\/p>\n
Ext.R1(c). I do not find any reason to take a different<\/p>\n
view in the present case          which also involves an<\/p>\n
interpretation of the same Government Order           and<\/p>\n
assessment of a similar claim by workmen of a public<\/p>\n
sector undertaking brought under the SSNP.<\/p>\n
6.    Learned counsel for the petitioner submits that the<\/p>\n
petitioner has not received the entire amount due under<\/p>\n
the VRS, that is, apart from the claim for arrears of<\/p>\n
salary or leave salary for the period from 1.5.2003 to<\/p>\n
6.4.2004.      Learned counsel for the first respondent<\/p>\n
submits that this aspect will be looked into by the<\/p>\n
Company and if a representation is filed in this regard<\/p>\n
within one month from today detailing the claim, that<\/p>\n
will be dealt with and if it is found that the amounts are<\/p>\n
still due as per the VRS package and the rules of the<\/p>\n

\n                              5<\/span><\/p>\n
Company, same shall be disbursed within one month<\/p>\n
thereafter. If the amount already disbursed is found to<\/p>\n
be adequate in terms of the rules, a detailed reply may<\/p>\n
be given in this regard to the workman within the<\/p>\n
aforementioned period.\n<\/p>\n<\/p>\n
7.   It is open to the petitioner to move the Government<\/p>\n
for enhancement of the arrears of wages which have<\/p>\n
been sanctioned under Ext.R1(c). This judgment will not<\/p>\n
stand in the way of the petitioner pursuing any such<\/p>\n
remedy for enhancement of the arrears of wages before<\/p>\n
the Government.\n<\/p>\n<\/p>\n
     Subject to the above, writ petition is disposed of.<\/p>\n
