JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n\t\t\t\tDate\n: 28\/02\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tThis<br \/>\npetition, under Article 226 of the Constitution of India, has been<br \/>\nfiled with the following prayers:-\n<\/p>\n<p>&#8220;14)\tThe<br \/>\npetitioner therefore prays that this Hon&#8217;ble Court may be pleased to<br \/>\nissue a writ of mandamus or any other writ, direction or order:\n<\/p>\n<p>A)\tDirecting<br \/>\nthe Respondent to decide the representation dt.8.2.2010 of the<br \/>\npetitioner regarding his seniority, within one month and to<br \/>\ncommunicate the result forthwith.\n<\/p>\n<p>B)\tDuring<br \/>\nthe pendency and final disposal of this petition the respondent may<br \/>\nbe directed to decide the representation dt.8.2.2010 of the<br \/>\npetitioner.\n<\/p>\n<p>C)\tTo<br \/>\ngrant such and further relief as may be deemed fit and proper.&#8221;\n<\/p>\n<p>2.\tHeard<br \/>\nMr. A.S. Supehia, learned advocate for Mr. I.S. Supehia, learned<br \/>\ncounsel for the petitioner. It is submitted by him that the<br \/>\npetitioner had resigned from service on 05.06.1981 and he was denied<br \/>\nseniority and other benefits. He filed Special Civil Application<br \/>\nNo.7143 of 2009, which came to be disposed of, as withdrawn by order<br \/>\ndated 30.07.2009 with the certain observations, including the fact<br \/>\nthat the petitioner was desirous of making a representation, as<br \/>\nregards his pay, pension and leave benefits. The petitioner made a<br \/>\nrepresentation on 01.09.2009, as a result of which, the State<br \/>\nGovernment, by order dated 13.10.2009, decided to join the period of<br \/>\nbreak-in service from 19.11.1981 to 20.07.1982(245 days in all).\n<\/p>\n<p>3.\tThe<br \/>\nperiod of break-in service of the petitioner with effect from<br \/>\n19.11.1981 to 20.07.1982 has been treated as leave without pay, and<br \/>\nthe services of the petitioner have been treated as continuous for<br \/>\nthe purpose of pay, pension and leave. In view of the above, the<br \/>\npetitioner made another representation dated 08.02.2010, requesting<br \/>\nthe respondent to count his service period before 19.11.1981 for the<br \/>\npurpose of seniority. This representation has been forwarded by the<br \/>\nSuperintending Engineer, Vadodara to the respondent by letter dt. Nil<br \/>\nof 2010, annexed as Annexure-&#8216;D&#8217; to the petition. However, no<br \/>\ndecision has been arrived by the respondent upon this representation.<br \/>\nTherefore, the interest of justice would be met, if directions are<br \/>\ngiven to the respondent to consider and decide the same,<br \/>\nexpeditiously.\n<\/p>\n<p>3.\tUpon<br \/>\nthe above statement being made by the learned advocate for the<br \/>\npetitioner, the following order is passed:-\n<\/p>\n<p>\tThe<br \/>\nrespondent shall consider and decide representation dated 08.02.2010,<br \/>\nmade by the petitioner, in accordance with law and within a period of<br \/>\nthree months from the date of receipt of a copy of this order.\n<\/p>\n<p>\tIt<br \/>\nis clarified that while passing this order, the Court has not entered<br \/>\ninto the merits of the case.\n<\/p>\n<p>4.\tThe<br \/>\npetition is disposed of, in the above terms.\n<\/p>\n<p> (Smt.
