MUKHOPADHAYA)<\/p>\n<p>\tThe<br \/>\nadjudicating authority issued a show cause notice on the appellant<br \/>\nunder Section 11(2) of the Foreign Trade (Development &amp;<br \/>\nRegulation) Act, 1992 (for short  the Act ) asking the appellant<br \/>\nto refund the balance amount of terminal excise duty, to which the<br \/>\nappellant filed reply.\n<\/p>\n<p>\tAfter<br \/>\ngetting the clarification from the office of Indian Audit &amp;<br \/>\nAccounts Department, Mumbai and Director General of Foreign Trade,<br \/>\nNew Delhi, the authority issued the impugned order on 8th<br \/>\nJanuary, 2008 for refund of terminal excise duty of Rs.1,12,19,487\/-,<br \/>\nwhich stipulates that, on failure, action shall be taken as per the<br \/>\nAct.  Having challenged, learned Single Judge refused to entertain<br \/>\nthe writ petition there being an alternative remedy of appeal under<br \/>\nSection 15 of the Act.\n<\/p>\n<p>\tLearned<br \/>\ncounsel appearing on behalf of the appellant tried to convince that<br \/>\nno final decision has been taken on the show cause notice and the<br \/>\nreply filed by the appellant.  But, since appeal can be preferred<br \/>\nunder Section 15 of the Act by any aggrieved person against any<br \/>\ndecision taken by the adjudicating authority, learned counsel for the<br \/>\n appellant sought permission to withdraw this appeal so as to enable<br \/>\nthe appellant to prefer an appeal and requested to direct the<br \/>\nappellate authority to entertain the appeal on merit by condoning the<br \/>\ndelay, taking into consideration the fact that the appellant was<br \/>\npursuing the matter before this Court and matter is pending since<br \/>\nlong.\n<\/p>\n<p>\tMr.\n<\/p>\n<p>R.M. Chhaya, learned counsel appearing on behalf of the respondents<br \/>\nNos.1 to 3 submits that if the appellant moves an appeal before the<br \/>\nappellate authority within a reasonable time, the Court may direct to<br \/>\ndecide the same on merits.\n<\/p>\n<p>\tHaving<br \/>\nheard learned counsel for the parties, we allow the appellant to<br \/>\nprefer an appeal against the impugned order dated 8th<br \/>\nJanuary, 2008 under Section 15 of the Act, 1992.  If such appeal<br \/>\nalong with application for condonation of delay is preferred by the<br \/>\nappellant within three weeks, the appellate authority will condone<br \/>\nthe delay and entertain and decide the appeal on merits after notice<br \/>\nto the parties.  So far as interim relief is concerned, the appellant<br \/>\nis also given opportunity to file an application for interim relief<br \/>\nbefore the appellate authority within the same period of three weeks<br \/>\nand the appellate authority shall decide the question of grant of<br \/>\ninterim relief, taking into consideration the interim order passed by<br \/>\nthis Court.\n<\/p>\n<p>\tThis<br \/>\nappeal stands disposed of with the aforesaid observation and<br \/>\ndirection.
