Koshy, J<\/p>\n<p>       During the academic year 2005-06, the<\/p>\n<p>respondent\/petitioner&#8217;s                       school           had   13<\/p>\n<p>divisions with 12 posts of LPSA&#8217;s, 2 posts of<\/p>\n<p>Arabic        Teachers          and         a       Headmaster.       On<\/p>\n<p>verification of the staff strength in the year<\/p>\n<p>2006-07, there were 562 students warranting 14<\/p>\n<p>class      divisions.           But       in       a      Higher   Level<\/p>\n<p>Verification conducted on 18\/09\/06, there were<\/p>\n<p>only      457     students.              Therefore,             only 12<\/p>\n<p>divisions were sanctioned. The Manager of the<\/p>\n<p>School represented that as there was heavy<\/p>\n<p>rain on that particular day of Higher Level<\/p>\n<p>Verification and the school is situated in the<\/p>\n<p><span class=\"hidden_text\">W. A. No.1326 of 2008             -2-<\/span><\/p>\n<p>      moffusil area, the students could not attend<\/p>\n<p>      on that day. Therefore, re-verification was<\/p>\n<p>      conducted and it was found that as on the<\/p>\n<p>      first working day of the year the students&#8217;<\/p>\n<p>      strength justifies warranting 14 divisions.\n<\/p>\n<p>      Excess number of students in a class will<\/p>\n<p>      deter the standard of education. Therefore,<\/p>\n<p>      learned Single Judge found that 14 divisions<\/p>\n<p>      are to be sanctioned in the school.\n<\/p>\n<p>              2. It is the contention of the appellant<\/p>\n<p>      that under Rule 12 of Chapter XXIII KER on the<\/p>\n<p>      basis         of  re-verification,  staff  fixation<\/p>\n<p>      cannot         be changed.   But  in  the  original<\/p>\n<p>      verification conducted on the sixth working<\/p>\n<p>      day      of    the year,   there  was 562  students<\/p>\n<p>      warranting        14  divisions.   Therefore,  even<\/p>\n<p><span class=\"hidden_text\">W. A. No.1326 of 2008         -3-<\/span><\/p>\n<p>      applying the ratio based on the appellant&#8217;s<\/p>\n<p>      contentions, 14 divisions are warranted in the<\/p>\n<p>      school. The learned Single Judge only followed<\/p>\n<p>      the ratio in the judgment in O.P.18651\/2000.\n<\/p>\n<p>      The above judgment was not appealed against.\n<\/p>\n<p>              3. In the above circumstances, we see no<\/p>\n<p>      ground to interfere with the impugned judgment<\/p>\n<p>      delivered by the learned Single Judge. Appeal<\/p>\n<p>      fails and is dismissed accordingly.\n<\/p>\n<p>                                              J. B.
