Dabhi, Ld. APP waives service of rule for the respondent<br \/>\nState.\n<\/p>\n<p>2.\t\tHeard<br \/>\nLd. Advocate Mr. E G Ahuja for the applicant and Ld. APP Mr. Dabhi<br \/>\nfor the respondent   State.\n<\/p>\n<p>3.\t\tThis<br \/>\nCourt vide order dated 21\/5\/2009 in Criminal Misc. Application No.<br \/>\n6167 of 2009 released the applicant on regular bail by imposing<br \/>\ncertain conditions. Condition [e] runs as under :\n<\/p>\n<p> [e]<br \/>\n not leave the local limits of State of Gujarat without the prior<br \/>\npermission of the concerned Sessions Judge.\n<\/p>\n<p>Condition<br \/>\n[f] runs as under :\n<\/p>\n<p> [f]\t\tmark<br \/>\npresence before concerned Police Station on 15th day of<br \/>\nevery English calendar month, any time between 9.00 a.m and 5.00 p.m<br \/>\ntill commencement of trial <\/p>\n<p>4.\t\tLd.\n<\/p>\n<p>Advocate Mr. Ahuja for the applicant submitted that in the instant<br \/>\ncase  the investigation is over and the police has filed charge-sheet<br \/>\non  5\/5\/2010. It is further submitted that for the deletion of the<br \/>\naforesaid two conditions the applicant had filed Criminal Misc.<br \/>\nApplication No. 13532 of 2009. However, at that time, the<br \/>\ninvestigation was in progress and the charge-sheet was not filed and,<br \/>\ntherefore, on 4\/12\/2009 said application was not pressed and<br \/>\naccordingly said application stood disposed of as not pressed. It is<br \/>\nsubmitted that now charge-sheet is filed and the investigation is<br \/>\nover. The applicant on account of his business, has to go on and<br \/>\noften out of Gujarat and, therefore, it is requested  that condition<br \/>\n[e] mentioned above may be deleted.\n<\/p>\n<p>4.1.\t\tSo<br \/>\nfar as the condition [f] regarding marking of presence before<br \/>\nconcerned police station is concerned, the said condition is valid<br \/>\nonly till commencement of the trial. In that view of the matter, \tLd.<br \/>\nAdvocate Mr. Ahuja for the applicant submits that he does not press<br \/>\nthe deletion of said condition at this stage.\n<\/p>\n<p>5.\t\tLd.\n<\/p>\n<p>APP Mr. Dabhi for the respondent   State  opposed this application.\n<\/p>\n<p>6.\t\tConsidering<br \/>\nthe facts and circumstances of the case and the seriousness of the<br \/>\noffences alleged against the applicant, I am of the considered<br \/>\nopinion that condition [e] should not be deleted. However condition<br \/>\n[e] requires to be suitably modified.\n<\/p>\n<p>7.\t\tIn<br \/>\nthat view of the matter, so far as the condition [e] is concerned,<br \/>\nthe applicant is required to obtain prior permission of the concerned<br \/>\nSessions Judge before leaving the territory of India.\n<\/p>\n<p>8.\t\tFor<br \/>\nthe foregoing reasons, the application is allowed in part. Condition<br \/>\n[e] set forth in the order dated 21\/5\/2009 in Criminal Misc.<br \/>\nApplication No. 6167\/2009 now reads as under :\n<\/p>\n<p> [e]\tnot<br \/>\nto leave the local limits of India without the prior permission of<br \/>\nthe concerned Sessions Judge.\n<\/p>\n<p>9.\t\tIn<br \/>\nthe result, the application is allowed in part. Condition [e] set<br \/>\nforth in the order dated 21\/5\/2009 in Criminal Misc.
