    Petitioner was convicted and sentenced for<\/p>\n
the offence under section 138 of Negotiable<\/p>\n
Instruments Act in C.C.862\/1999 by Judicial<\/p>\n
First  Class  Magistrate’s  Court,   Koyilandy.<\/p>\n
Petitioner  challenged   the   conviction   and<\/p>\n
sentence before Sessions Court, Kozhikode in<\/p>\n
Crl.A.375\/2003.   Learned   Sessions  Judge  on<\/p>\n
reappreciation  of   evidence   confirmed   the<\/p>\n
conviction  but   modified  the   sentence   to<\/p>\n
imprisonment till the rising of court and a<\/p>\n
compensation  of Rs.90,000\/-   and  in  default<\/p>\n
simple imprisonment for four months.   Revision<\/p>\n
is  filed   challenging  the   conviction   and<\/p>\n
sentence.\n<\/p>\n
    2.    Learned  counsel  appearing  for  the<\/p>\n
petitioner and the learned counsel appearing<\/p>\n
Crl.R.P.3035\/2005            2<\/span><\/p>\n
for the first respondent were heard.<\/p>\n
      3.        The argument  of  the  learned  counsel<\/p>\n
appearing for the petitioner is that the complaint<\/p>\n
was filed by the first respondent      and subsequently<\/p>\n
on 31.3.1999 he executed a power of attorney in<\/p>\n
favour of DW1 authorising him to prosecute the case<\/p>\n
and also to settle the same and later under Ext.P1<\/p>\n
power of attorney dated 8.11.2002 PW1 was appointed<\/p>\n
as power of attorney and it was PW1 who had given<\/p>\n
evidence and the complainant was not examined and<\/p>\n
the evidence of DW1 establish that when he was<\/p>\n
prosecuting the case as the power of attorney<\/p>\n
holder of the complainant, as authorized under      the<\/p>\n
power of attorney       he settled the dispute with the<\/p>\n
petitioner and received the entire amount and paid<\/p>\n
it to the first respondent          and therefore the<\/p>\n
conviction is not sustainable.         Learned counsel<\/p>\n
argued that eventhough it was suggested to PW1 that<\/p>\n
the matter has been settled with the original power<\/p>\n
of    attorney     holder, first   respondent was   not<\/p>\n
examined and in such circumstances even if          the<\/p>\n
conviction is to be confirmed, the compensation is<\/p>\n

to be set aside.\n<\/p>\n
      4.      Learned counsel for the first respondent<\/p>\n
argued that the evidence of DW1 cannot be relied on<\/p>\n
at all and was rightly disbelieved.       It was pointed<\/p>\n
out that PW1 had to be appointed the           power of<\/p>\n
attorney in the place of         DW1, the original power<\/p>\n
of attorney holder         and in such circumstances the<\/p>\n
evidence of DW1 was rightly rejected by the courts<\/p>\n
below and there is no reason to interfere with the<\/p>\n
conviction or the sentence.\n<\/p>\n
      5. Ext.P2 cheque is for Rs.90,000\/-.      The fact<\/p>\n
that it was issued in the account maintained by the<\/p>\n
petitioner and it was dishonoured for want of<\/p>\n
sufficient funds and first respondent had complied<\/p>\n
with all the statutory formalities are not in<\/p>\n
dispute.         Petitioner has no case that inspite of<\/p>\n
notice       demanding    the  amount  covered  by   the<\/p>\n
dishonoured        cheque, he   paid any  amount.    The<\/p>\n
payment        and   the  settlement  alleged  is   much<\/p>\n
subsequent to the filing of the complaint.       Even if<\/p>\n
it is taken that there was any payment subsequent<\/p>\n
to the commission         of the offence, the petitioner<\/p>\n

cannot contend that he did not commit the       offence.<\/p>\n
Then      the    question is whether petitioner had paid<\/p>\n
the amount covered by the dishonoured cheque to the<\/p>\n
first respondent through the power of attorney<\/p>\n
holder of the first respondent after institution of<\/p>\n
the complaint.        It is true that DW1 was the power<\/p>\n
of attorney holder of the first respondent at that<\/p>\n
time.      According to petitioner, he has settled the<\/p>\n
dispute with DW1. True, DW1 had given evidence in<\/p>\n
support of the petitioner.       The question is how far<\/p>\n
his evidence is believable.        If we are to believe<\/p>\n
DW1, the amount borrowed was only Rs.10,000\/- and<\/p>\n
still cheque was issued for Rs.90,000\/-.          It is<\/p>\n
improbable.        It is more so when even after receipt<\/p>\n
of the notice demanding Rs.90,000\/-, petitioner did<\/p>\n
not sent a reply.          If the amount borrowed was<\/p>\n
Rs.10,000\/- and based on the dishonoured cheque<\/p>\n
Rs.90,000\/-         is   demanded,   petitioner    would<\/p>\n
definitely sent a reply stating that the amount due<\/p>\n
is not Rs.90,000\/- but Rs.10,000\/-. The fact that<\/p>\n
DW1 was trying         to help the petitioner  is clear<\/p>\n
from the way in which he has given evidence.          On<\/p>\n
Crl.R.P.3035\/2005            5<\/span><\/p>\n
going through the entire evidence, I find no reason<\/p>\n
to interfere with the findings of the courts below<\/p>\n
that Ext.P2 cheque was issued towards the repayment<\/p>\n
of the amount borrowed and it was dishonoured for<\/p>\n
want of sufficient funds.        In such circumstances,<\/p>\n
conviction of the petitioner for the offence under<\/p>\n
section       138  of  Negotiable  Instruments  Act  is<\/p>\n
perfectly legal.\n<\/p>\n
      6. Then the only question is regarding the<\/p>\n
sentence.         Learned Sessions Judge modified the<\/p>\n
sentence to imprisonment till rising of court and a<\/p>\n
compensation       for   the  amount  covered  by   the<\/p>\n
dishonoured cheque.       In such circumstances, I find<\/p>\n
no reason to interfere with the sentence also.<\/p>\n
      Revision fails.      It is dismissed.  Petitioner<\/p>\n
is directed to appear before the Judicial First<\/p>\n
Class Magistrate’s Court on 13.7.2010.         Judicial<\/p>\n
First Class Magistrate is directed to execute the<\/p>\n
