Respondent\n                                         ......\n       Coram:\u00a0Hon'ble\u00a0Mr.\u00a0Justice\u00a0R.K.Merathia\n                           ......\n       For\u00a0the\u00a0Petitioner\u00a0 \u00a0:\u00a0Mr.\u00a0Ayush\u00a0Aditya,\u00a0Advocate\n       For\u00a0the\u00a0Bank        \u00a0:\u00a0Mr.\u00a0Gyanendra\u00a0Kuamr,\u00a0Advocates.\n                           ......\n\n2\/30.11.2010<\/pre>\n<p>      Heard\u00a0the\u00a0parties.\n<\/p>\n<p>       2          This \u00a0 C.M.P. \u00a0 Has \u00a0 been \u00a0 filed \u00a0 for \u00a0 extension \u00a0 of \u00a0 time \u00a0 for \u00a0 paying \u00a0 the\u00a0<\/p>\n<p>       amounts\u00a0in\u00a0terms\u00a0of\u00a0the\u00a0order\u00a0dated\u00a030\/08\/2010.\u00a0It\u00a0is\u00a0submitted\u00a0by\u00a0the\u00a0<\/p>\n<p>       learned\u00a0counsel\u00a0for\u00a0the\u00a0petitioners\u00a0that\u00a0out\u00a0of\u00a0the\u00a0dues\u00a0of\u00a0Rs.\u00a05,32,146.50\u00a0<\/p>\n<p>       paise,\u00a0the\u00a0petitioners\u00a0deposited\u00a0two\u00a0installments\u00a0as\u00a0per\u00a0the\u00a0said\u00a0order,\u00a0but\u00a0<\/p>\n<p>       he\u00a0could\u00a0not\u00a0deposit\u00a0the\u00a03rd\u00a0 and\u00a04th\u00a0 installments\u00a0for\u00a0the\u00a0reasons\u00a0stated\u00a0in\u00a0<\/p>\n<p>       the\u00a0petition,\u00a0and\u00a0therefore,\u00a0\u00a0the\u00a0time\u00a0to\u00a0deposit\u00a0the\u00a0same\u00a0may\u00a0be\u00a0extended.\u00a0<\/p>\n<p>       Referring \u00a0 to \u00a0 Annexure\u00adC \u00a0 to \u00a0 the \u00a0 counter \u00a0 affidavit \u00a0 to \u00a0 the \u00a0 writ \u00a0 petition, \u00a0 he\u00a0<\/p>\n<p>       submitted\u00a0that\u00a0on\u00a006\/07\/2010 \u00a0the\u00a0present \u00a0outstanding \u00a0on\u00a0that\u00a0day\u00a0was\u00a0<\/p>\n<p>       shown\u00a0as\u00a0Rs.\u00a05,32,146.50\u00a0paise\u00a0and,\u00a0accordingly,\u00a0the\u00a0said\u00a0order\u00a0was\u00a0passed\u00a0<\/p>\n<p>       in\u00a0the\u00a0writ\u00a0petition\u00a0but\u00a0now\u00a0the\u00a0bank\u00a0is\u00a0asking\u00a0for\u00a0higher\u00a0amount.<\/p>\n<p>       3.         On \u00a0 the \u00a0 other \u00a0 hand, \u00a0 learned \u00a0 counsel \u00a0 appearing \u00a0 for \u00a0 the \u00a0 bank\u00a0<\/p>\n<p>       submitted \u00a0 that \u00a0 the \u00a0 order \u00a0 dated \u00a0 30\/08\/2010 \u00a0 was \u00a0 passed \u00a0 on \u00a0 petitioners&#8217;\u00a0<\/p>\n<p>       readiness \u00a0 and\u00a0willingness\u00a0 to\u00a0 pay \u00a0the\u00a0dues \u00a0of\u00a0 the\u00a0 bank\u00a0if\u00a0 some\u00a0time\u00a0was\u00a0<\/p>\n<p>       granted.\u00a0Referring\u00a0to\u00a0Annexure\u00a0A\u00a0dated\u00a01.9.2006\u00a0(to\u00a0the\u00a0counter\u00a0affidavit\u00a0<\/p>\n<p>       filed\u00a0in\u00a0the\u00a0writ\u00a0petition)\u00a0he\u00a0submitted\u00a0that\u00a0in\u00a0the\u00a0letter\u00a0dated\u00a006\/07\/2010\u00a0<\/p>\n<p>       it\u00a0was\u00a0noted\u00a0that\u00a0the\u00a0loan\u00a0account\u00a0is\u00a0NPA\u00a0in\u00a0the\u00a0books\u00a0of\u00a0the\u00a0bank\u00a0from\u00a0<\/p>\n<p>       30\/06\/2006 \u00a0 and, \u00a0 accordingly, \u00a0 the \u00a0 interest \u00a0 was \u00a0 not \u00a0 shown \u00a0 alongwith\u00a0<\/p>\n<p>       outstanding\u00a0amount\u00a0of\u00a0Rs.\u00a05,32,146.50.\n<\/p>\n<p>       4.         It\u00a0is\u00a0clear\u00a0from\u00a0the\u00a0order\u00a0dated\u00a030\/08\/2010\u00a0that\u00a0the\u00a0petitioners\u00a0<\/p>\n<p>       expressed\u00a0their\u00a0\u00a0readiness\u00a0\u00a0and\u00a0\u00a0willingness\u00a0\u00a0to\u00a0\u00a0pay\u00a0the\u00a0dues\u00a0of\u00a0the\u00a0bank\u00a0\u00a0if\u00a0<br \/>\n                                                 \u00ad2\u00ad<\/p>\n<p>      some \u00a0 time \u00a0 is \u00a0 granted \u00a0 by \u00a0 this \u00a0 Court. \u00a0 The \u00a0 dues \u00a0 of \u00a0 the \u00a0 bank \u00a0 were \u00a0 not\u00a0<\/p>\n<p>      ascertained\u00a0at\u00a0the\u00a0time\u00a0of\u00a0passing\u00a0the\u00a0said\u00a0order.\u00a0 \u00a0However,\u00a0in\u00a0view\u00a0of\u00a0the\u00a0<\/p>\n<p>      said\u00a0letter\u00a0dated\u00a006\/07\/2010,\u00a0order\u00a0was\u00a0passed\u00a0directing\u00a0the\u00a0petitioners\u00a0to\u00a0<\/p>\n<p>      pay\u00a0Rs.\u00a05\u00a0lakhs\u00a0in\u00a0four\u00a0installments,\u00a0and\u00a0thereafter,\u00a0the\u00a0bank\u00a0\u00a0was\u00a0directed\u00a0<\/p>\n<p>      to\u00a0supply\u00a0the\u00a0details\u00a0of\u00a0the\u00a0balance\u00a0amount\u00a0due\u00a0to\u00a0the\u00a0petitioners,\u00a0which,\u00a0<\/p>\n<p>      the \u00a0 petitioners \u00a0 were \u00a0 directed \u00a0 to \u00a0 deposit. \u00a0 It \u00a0 was \u00a0 also \u00a0 ordered \u00a0 that \u00a0 if \u00a0 the\u00a0<\/p>\n<p>      petitioners\u00a0fail\u00a0to\u00a0comply\u00a0with\u00a0any\u00a0part\u00a0of\u00a0the\u00a0order,\u00a0the\u00a0bank\u00a0may\u00a0auction\u00a0<\/p>\n<p>      the\u00a0property\u00a0mortgaged\u00a0and\u00a0will\u00a0debit\u00a0the\u00a0expenses\u00a0of\u00a0advertisement\u00a0in\u00a0the\u00a0<\/p>\n<p>      account\u00a0of\u00a0the\u00a0petitioner.\n<\/p>\n<p>      5.          In\u00a0the\u00a0circumstances,\u00a0I\u00a0indicated\u00a0that\u00a0if\u00a0the\u00a0petitioners\u00a0are\u00a0ready\u00a0<\/p>\n<p>      and\u00a0willing\u00a0to\u00a0pay\u00a0the\u00a0dues\u00a0of\u00a0the\u00a0bank\u00a0as\u00a0per\u00a0the\u00a0bank&#8217;s\u00a0calculation\u00a0with\u00a0<\/p>\n<p>      interest\u00a0till\u00a0the\u00a0date\u00a0of\u00a0payment,\u00a0the\u00a0time\u00a0can\u00a0be\u00a0extended,\u00a0but\u00a0Mr.\u00a0Ayush\u00a0<\/p>\n<p>      Aditya,\u00a0learned\u00a0counsel\u00a0for\u00a0the\u00a0petitioners,\u00a0on\u00a0instructions\u00a0submitted\u00a0that\u00a0<\/p>\n<p>      the \u00a0 petitioners \u00a0 are \u00a0 not \u00a0 agreeable, \u00a0 and \u00a0 therefore, \u00a0 they \u00a0 may \u00a0 be \u00a0 allowed \u00a0 to\u00a0<\/p>\n<p>      withdraw\u00a0this\u00a0C.M.P.\u00a0as\u00a0well\u00a0as\u00a0the\u00a0main\u00a0writ\u00a0petition.<\/p>\n<p>                  In\u00a0the\u00a0facts\u00a0and\u00a0circumstances\u00a0noticed\u00a0above,\u00a0this\u00a0C.M.P.\u00a0\u00a0stands\u00a0<\/p>\n<p>      dismissed\u00a0as\u00a0withdrawn.\u00a0But\u00a0petitioners\u00a0can\u00a0not\u00a0be\u00a0allowed\u00a0to\u00a0withdraw\u00a0the\u00a0<\/p>\n<p>      disposed\u00a0of\u00a0writ\u00a0petition.\n<\/p>\n<p>                                 \u00a0       \u00a0\u00a0\u00a0\u00a0<\/p>\n<p>      \u00a0\u00a0\u00a0\u00a0                                              \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0(R.K.Merathia,\u00a0J)<\/p>\n<p>Mukund\/\u00ad\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Jharkhand High Court Sri Arjun Prasad Agarwal vs Indian Overseas Bank, Gumla Br on 30 November, 2010 IN\u00a0THE\u00a0HIGH\u00a0COURT\u00a0OF\u00a0JHARKHAND\u00a0AT\u00a0RANCHI C.M.P.\u00a0No.\u00a0405\u00a0of\u00a02010 1.
