DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 16\/07\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>\tThe<br \/>\npetitioners have filed this petition under Articles 226 and 227 of<br \/>\nthe Constitution with the following main prayers:\n<\/p>\n<p>&#8220;(A)\tYour<br \/>\nLordships may be pleased to call for the R&amp;P of H.R.P. Suit<br \/>\nNo.1063 of 1991 and that of Civil Appeal No.92 of 1999 pending before<br \/>\nthe learned Appellate Bench of the Small Causes Court at Ahmedabad<br \/>\nand after perusing the same, may further be pleased to issue<br \/>\nappropriate writ and\/or direction to quash and set aside the order<br \/>\npassed below Application Exh.33 (Annexure-H) by the learned Appellate<br \/>\nBench of the Small Causes Court at Ahmedabad on 4.5.2010&#8221;\n<\/p>\n<p>2.\tMr.\n<\/p>\n<p>V.P.Nanavati, learned advocate for the petitioners, submits that a<br \/>\nserious error is committed by the Appellate Bench while passing the<br \/>\norder dated 4.5.2010 below Exh.33 by refusing to keep the record in<br \/>\nsafe custody and to initiate legal action in view of certain<br \/>\ninterpolation in the copy of the plaint.  Learned advocate further<br \/>\nsubmits that the above order is a case of non-application of mind on<br \/>\nthe pat of the learned Appellate Bench of the Small Causes Court and,<br \/>\ntherefore, deserves correction in exercise of powers under Articles<br \/>\n226 and 227 of the Constitution of India.\n<\/p>\n<p>3.\tHaving<br \/>\nheard learned advocate for the petitioner and on perusal the record<br \/>\nof the case, including the impugned order, it is clear that the<br \/>\nAppellate Bench of Small Causes Court, Ahmedabad has considered the<br \/>\nvery issue and decided that whether the Trial Court has committed an<br \/>\nerror or not and if at all an investigation is to be done, then the<br \/>\nmatter will have to be referred to the learned In-charge Chief Judge<br \/>\nand without proceeding further with the mater it was not possible for<br \/>\nthe Bench to consider the above aspect in detail for arriving at any<br \/>\nconclusion.\n<\/p>\n<p>4.\tThe<br \/>\nabove approach of the Appellate Bench of the Small Causes Court,<br \/>\nAhmedabad cannot be said to be in any manner contrary to law or<br \/>\nillegal.  It is also true that by such an interlocutory order<br \/>\nimpugned in this petition, no grave injustice or hardship is caused<br \/>\nto the petitioners, which calls for any interference of this Court in<br \/>\nexercise of powers under Articles 226 and 227 of the Constitution of<br \/>\nIndia.  Even some error of fact or law by itself cannot be subjected<br \/>\nto the jurisdiction of this Court under Article 226 and 227 of the<br \/>\nConstitution of India.\n<\/p>\n<p>5.\tIn<br \/>\nview of the above discussion, this petition fails and is hereby<br \/>\ndismissed in limine. However, it will be open for the Appellate Bench<br \/>\nof the Small Causes Court, Ahmedabad to examine the issue without<br \/>\nbeing influenced by this order at the appropriate  stage of the<br \/>\nproceedings.\n<\/p>\n<p>[Anant<br \/>\nS.
