Mahajan, J.  <\/p>\n<p> 1. By way of present petition, the petitioners<br \/>\nseek quashing of demand notice dated 16.1.1996 issued<br \/>\nby respondent\/DDA demanding a composition fee of<br \/>\nRs. 76,608\/- from the petitioners.\n<\/p>\n<p> 2. The petitioners purchased a plot of land<br \/>\nbearing No. D-14\/4, measuring 201.60 sq.mts. in an<br \/>\nopen public auction for a sum of Rs. 2,62,000\/-.<br \/>\nPossession of the plot was given to the petitioners on<br \/>\n11.2.1986. However, the lease deed was executed and<br \/>\nregistered on 23.4.1987. As per the lease deed, the<br \/>\npetitioners were required to make construction on the<br \/>\nsaid plot within a period of three years from the date<br \/>\nof possession. By letter dated 4.3.1986 the<br \/>\npetitioners informed the respondent\/DDA that there was<br \/>\nno basic amenities viz. electricity, water and<br \/>\nsewerage etc. and the petitioners were unable to make<br \/>\nconstruction on the plot in question. It was also<br \/>\nstated in the letter that DDA had committed fraud upon<br \/>\nthe petitioners by auctioning the undeveloped plot.<br \/>\nReminders were issued to the respondent\/DDA on<br \/>\n19.5.1986, 9.3.1987, 13.9.1993, 30.8.1994 and<br \/>\n1.9.1994. The respondent\/DDA failed to respond to the<br \/>\naforesaid letter and reminders. By notice dated<br \/>\n16.1.1996, the respondent\/DDA imposed a penalty of<br \/>\nRs. 76,608\/- on the petitioners on the ground that<br \/>\nbuilding was not completed\/constructed within the<br \/>\nstipulated time. Hence the present petition.\n<\/p>\n<p> 3. There is no appearance on behalf of<br \/>\nrespondent\/DDA. However, counter affidavit filed by<br \/>\nrespondent\/DDA way back in December, 1996 is on record<br \/>\nwherein the respondent\/DDA stated that petitioner<br \/>\nshould have satisfied themselves regarding<br \/>\navailability of civic amenities before bidding for the<br \/>\nplot. The water and sewerage connection was to be<br \/>\nprovided by M.C.D. and the electricity connection by<br \/>\nD.E.S.U. It is admitted by respondent\/DDA that water<br \/>\nwas made available in August, 1989. It was also<br \/>\nstated that penalty of Rs. 76,608\/- was imposed on the<br \/>\npetitioners on account of non-construction for the<br \/>\nperiod 11.2.1989 to 31.3.1996. It was also stated<br \/>\nthat on inspection on 17.3.1994 it was found that<br \/>\nadjoining plots had been constructed and the units<br \/>\nwere running their industries on them. It was stated<br \/>\nin the supplementary affidavit filed by respondent\/DDA<br \/>\non 6th August, 2001 that a sum of Rs. 99,51,601\/- was<br \/>\ndeposited with Delhi Vidyut Board towards<br \/>\nelectrification of the bifurcated plots in Blocks D&amp;F<br \/>\nin three stages on 10.6.1987, 6.10.1987 and 13.1.1998.\n<\/p>\n<p> 4. I have heard learned counsel for the<br \/>\npetitioner and perused the documents on record.\n<\/p>\n<p> 5. Counsel for the petitioner contends that it<br \/>\nis the statutory duty of the DDA under Rule 26 and<br \/>\nRule 29 of the Nazul Rule 1981 to auction the plots<br \/>\nonly after these are fully developed and all amenities<br \/>\nmentioned in Section 2-A of Delhi Development Act,<br \/>\n1957 are provided. The respondent\/DDA has itself<br \/>\nfailed to fulfill its statutory duties and imposed<br \/>\npenalty on the petitioners for is own default. The<br \/>\npenalty was not warranted.\n<\/p>\n<p> 6. From the perusal of the documents on record,<br \/>\nit appears that respondent\/DDA had declared that what<br \/>\nwas being auctioned were developed industrial plots<br \/>\nbut admittedly up to 1989 civic services and amenities<br \/>\nwere not available. The petitioners were only<br \/>\ninformed in 1995 that essential services had been<br \/>\nprovided in 1989. In terms of the lease, construction<br \/>\nwas to be completed within two years from 11.2.1986.<br \/>\nLease was executed only in April, 1987. The<br \/>\npetitioners addressed communications to the<br \/>\nrespondents and pointed out in 1993 and 1994 that<br \/>\nessential amenities were lacking and construction<br \/>\ncould into be commenced. Extension was sought.<br \/>\nRespondents had misrepresented to the petitioner,<br \/>\ndeclaring land was developed. The water lines,<br \/>\nsewerage lines and electricity polls were not<br \/>\nprovided. The petitioners ought to have granted<br \/>\nreasonable time for construction. The respondent\/DDA<br \/>\nwas required to fulfill its statutory duty under Rule<br \/>\n26 and Rule 29 of the Nazul Rule 1981 before<br \/>\nauctioning the plots. It had failed to do so.<br \/>\nDespite failure on the part of respondent\/DDA to<br \/>\nfulfil its statutory duties under Nazul Rules, the<br \/>\nrespondent\/DDA imposed penalty on the petitioners for<br \/>\nnot completing the construction. The act of the<br \/>\nrespondent\/DDA cannot be sustained in light of the<br \/>\nfacts narrated above.\n<\/p>\n<p> 7. The petition is accordingly allowed.
