JOSEPH FRANCIS, JJ.\n                - - - - - - - - - - - - - - - - - - - - - - - -\n                    M.A.C.A.NO: 835 OF 2005\n                - - - - - - - - - - - - - - - - - - - - - - - -\n              Dated this the 19th Day of June, 2009.\n\n                              JUDGMENT\n<\/pre>\n<p>Joseph J.\n<\/p>\n<\/p>\n<p>     The claimant in a petition filed under Section 166 of the<\/p>\n<p>Motor Vehicles Act, is the appellant.                He has been awarded<\/p>\n<p>Rs.85,000\/-\n<\/p>\n<p>     2.    Heard the learned counsel for the appellant and the<\/p>\n<p>learned counsel appearing on behalf of the respondent, Insurance<\/p>\n<p>Company.\n<\/p>\n<p>     3.    The appellant is a boy, aged 7 years at the time of<\/p>\n<p>accident. He suffered various injuries. This appeal is directed<\/p>\n<p>against the inadequacy of quantum.                Learned counsel for the<\/p>\n<p>appellant would submit that actually the grievance is that no<\/p>\n<p>amount is awarded towards future treatment. He would submit<\/p>\n<p>that as a result of the injuries suffered, appellant had to undergo<\/p>\n<p>treatment and the treatment is even now going on, and there are<\/p>\n<p>records to show the same also. Learned counsel for the Insurance<\/p>\n<p>Company would submit that there is no specific pleading as such.<\/p>\n<p>M.A.C.A.NO: 835 OF 2005<br \/>\n<span class=\"hidden_text\">                                : 2 :<\/span><\/p>\n<p>But it is noted that no amount was awarded towards future<\/p>\n<p>medical treatment. It is settled law, that when an accident takes<\/p>\n<p>place, there cannot be successive awards for compensation and all<\/p>\n<p>the claims must be dealt with in the same award. Learned counsel<\/p>\n<p>for appellant essentially seeks for a remand. We would think that<\/p>\n<p>in the facts of this case, the appellant should be afforded an<\/p>\n<p>opportunity to make good his claim. Accordingly, the appeal is<\/p>\n<p>allowed and the matter is remanded back to the Tribunal with<\/p>\n<p>opportunity to the parties to adduce fresh evidence.<\/p>\n<p>      4.   The parties shall appear before the Tribunal on<\/p>\n<p>10.8.2009. In view of the fact that the matter is pending from 1998,<\/p>\n<p>the Tribunal will dispose of the case, as early as possible, at any<\/p>\n<p>rate, within four months from 10.8.2009.<\/p>\n<p>                                   K.M.JOSEPH, JUDGE.\n<\/p>\n<p>                             M.
