RESPONDENTS\n\n(By Shri.T.P.Srinivas, Additionai Government Advocate for\nRespondentl to Respondent.3, Respondent.4 served)\n\nThis Writ Petition is filed under Articles 226 and 227 of the\n\nConstitution of India praying to quash the letter\/endorsement\ndated 1.8.2008, issued by the Respondent. l. and Respondent.2, as\nper Annexurej by declaring the same is illegal and has no\napplication to the case of the petitioner and to declare the\nRespondentl and Respondent.2, to settle the terminal benefits of\nthe petitioner by taking the scale at Rs.l30--290 as the basis given\nto the post of First Division Clerk with subsequent increments and\nfix the pension accordingly and etc.,\n\nThis Writ Petition coming on for final hearing this day, the\nCourt made the following: --\n\nORDER\n<\/pre>\n<p>Heard the Counsel for the petitioner and the Counsel for the<\/p>\n<p>respondents.\n<\/p>\n<p>Assistants on or after 1.1.1970 was only from graduates in<br \/>\nscience.\n<\/p>\n<p>That the posts of Laboratory Assistants were existing i.n the<br \/>\ncolleges fell under the jurisdiction of the Karnataka University,<br \/>\nDharwad only. Their duties are akin to those of the First Division<br \/>\nClerks like, maintenance of laboratory equipments, maintenance<br \/>\nof accounts, stock registers, issue registers etc., &#8216;i&#8217;he graduates<\/p>\n<p>who were recruited as First Division Clerks to get promotion as<\/p>\n<p>superintendents. But, the Laboratory Assistants remain as<br \/>\nLaboratory Assistants as there are no promotional opportunities.<br \/>\nHence, on the 1&#8217;ecommendation of the second respondent, the State<\/p>\n<p>Government issued an order dated 23.1.1979 equating the post of<\/p>\n<p>Laboratory Assistants, who were graduates with those of First-\n<\/p>\n<p>Division Clerks in the scale of pay of Rs.l30&#8211;290, which was the<br \/>\n1970 scale, with a further direction that the Laboratory Assistants<br \/>\nequated to the cadre of First Division Clerks should work as First<\/p>\n<p>Division Clerks at least for one ygzr.\n<\/p>\n<p>Following the said order, the second respondent had issued<\/p>\n<p>a circular dated 3.4. E. 979 directing the management of the private<\/p>\n<p>aided colleges affiliated to Karnataka University to take action<\/p>\n<p>accordingly and to show the Laboratory Assistants in the seniority<br \/>\nlist of First Division Clerks. A clarification was sought by one<br \/>\nB.C.Angadi by his representation dated 3.8.1979, as to whether<br \/>\nthe said order of the Government and the circular of the second<\/p>\n<p>respondent would be applicable to Laboratory Assistants working<\/p>\n<p>in the institutions under the management of the third respondent.<br \/>\nThe second respondent addressed to the Principal of<br \/>\nS.Nijalingappa College that the intention of the Government under<br \/>\nthe above Government Order was to provide promotional channel<br \/>\nto Laboratory Assistants and eventualiy to abolish that cadre as<br \/>\nand when the existing Laboratory Assistants get promotion and it<br \/>\nwas immaterial in which college they worked, with a further<br \/>\ninstruction that the above circular dated 3.4.1979 followed in<br \/>\nrespect of the Laboratory Assistants would apply to<\/p>\n<p>S.Nijalingappa College also.\n<\/p>\n<p><span class=\"hidden_text\">8<\/span><\/p>\n<p>Following the said order and clarification, the petitioner<\/p>\n<p>who was working as a graduate Laboratory Assistant was<\/p>\n<p>informed to work as First Division Clerk in B.V.Bhoomaraddy .\n<\/p>\n<p>College and he was entrusted such work against the vacancy of<br \/>\nFirst Division Clerk as per the Office Memo dated 271.1982. He<br \/>\nworked in that capacity from 27.1.1982 to 31.5.2008. He drew the<br \/>\npay as per the scale fixed with subsequent increments issued from<\/p>\n<p>time to time and ultimately he retired from service on 31.5.2008.\n<\/p>\n<p>His service record was forwarded with i a recommendation to<br \/>\nsettle his terminal benefits and the third respondent has also<br \/>\nrecommended the sanie to the first respondent. While the<br \/>\npetitioner has been anxiously waiting the settlement of the<br \/>\nterminal benefits and fixation of pension, the respondents had<br \/>\nfailed to do se.\n<\/p>\n<p>it is by a letter dated 1.8.2008 from the first respondent to<br \/>\nthe third respondent to send a proposal for refixing the scale of the<br \/>\npetitioner as Second Division Assistant, that the petitioner was<\/p>\n<p>taken by shock and surprise. it is his contention that non~graduate<\/p>\n<p>&#8216;Z<\/p>\n<p><span class=\"hidden_text\">8<\/span>\n<\/p>\n<p>3. The Counsel for the petitioner while reiterating the<\/p>\n<p>aforesaid circumstances, submits that there is no second opinion<br \/>\nas to the petitioner&#8217;s entitlement in the light of the established<br \/>\ncircumstances in relation to other similarly placed workmen and<br \/>\nhence, would submit that the petition be allowed.\n<\/p>\n<p>4. While the Government Advocate would make a feeble<br \/>\nattempt to resist the petition.\n<\/p>\n<p>5. Having regard to the facts and circumstances, there is<\/p>\n<p>little substance in the contentions urged by the Government<br \/>\nAdvocate. In any event, he has not been in a position to file the<br \/>\nstatement of objections to deny the petition averments. Having<br \/>\nregard to the categorical contentions raised with reference to the<br \/>\nannexures, which are produced in support thereof, the writ petition<br \/>\nis allowed. Annexure&#8211;J is quashed. The respondents are directed<br \/>\nto settle the terminal benefits of the petitioner while adopting the<br \/>\npay scale of Rs. 130-290 as the basis with subsequent increments<br \/>\nand fix the pension accordingly.
