SHAH\n\t\t\n\t\n\n \n\nDate\n: 07\/10\/2011 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\t\tThe<br \/>\npresent Criminal Misc.Application under Section 482 of the Code of<br \/>\nCriminal Procedure has been preferred by the petitioner &#8211;<br \/>\noriginal accused to quash and set aside the impugned FIR being<br \/>\nC.R.No.I-116 of 2004 registered with Kodinar Police Station filed by<br \/>\nrespondent No.2 herein for the offences punishable under Sections 406<br \/>\nand 465 of the Indian Penal Code.\n<\/p>\n<p>2.\t\tIt<br \/>\nappears that respondent No.2 herein &#8211; original complainant has<br \/>\nlodged the impugned FIR being C.R.No.I-116 of 2004 with Kodinar<br \/>\nPolice Station against the petitioner, who was at the relevant time<br \/>\nReturning Officer for conducting the election of Kodinar Taluka<br \/>\nCooperative Banking Union Limited and who was General Manager of the<br \/>\nsaid Union, for the offences punishable under Sections 406 and 465 of<br \/>\nthe Indian Penal Code alleging inter alia that when the voters&#8217; list<br \/>\nwas published by the petitioner as Returning Officer, it was found<br \/>\nthat name of the original complainant was deleted from the voters&#8217;<br \/>\nlist and by creating forged documents, the Share Certificate has been<br \/>\ntransferred in the name of other person. It was also alleged that<br \/>\nsimilarly Share Certificate of Mohammed K. Patel was also transfered<br \/>\nby creating forged documents. Being aggrieved by and dissatisfied<br \/>\nwith the impugned FIR, the petitioner has preferred the present<br \/>\napplication under Section 482 of the Code of Criminal Procedure.\n<\/p>\n<p>3.\t\tMs.Avni<br \/>\nMehta, learned advocate appearing on behalf of the petitioner has<br \/>\nsubmitted that the petitioner has not committed any offence as<br \/>\nalleged. It is submitted that there was no transfer of Share<br \/>\nCertificate of the original complainant as alleged and even that of<br \/>\nMohammed G. Patel. It is submitted that even still the impugned<br \/>\ncomplaint was filed, the Share Certificate was in the name of the<br \/>\noriginal complainant. It is further submitted that at the relevant<br \/>\ntime, there was a dispute with respect to election, the impugned FIR<br \/>\nhas been filed by the original complainant with malafide intention.<br \/>\nIt is submitted that subsequently election petition was also filed.<br \/>\nTherefore, it is submitted that the impugned FIR is nothing but abuse<br \/>\nof process of law and Court and, therefore, it is requested to<br \/>\nexercise the power under Section 482 of the Code of Criminal<br \/>\nProcedure and to quash and set aside the impugned FIR.\n<\/p>\n<p>4.\t\tMr.J.K.Shah,<br \/>\nlearned Additional Public Prosecutor has appeared on behalf of the<br \/>\nrespondent-State and has requested to pass an appropriate order in<br \/>\nthe facts and circumstances of the case.\n<\/p>\n<p>5.\t\tHeard<br \/>\nthe learned advocate appearing on behalf of the respective parties at<br \/>\nlength and considered the averments and allegations made in the<br \/>\nimpugned FIR. The allegations made in the impugned complaint are that<br \/>\nthe name of the original complainant was deleted from the voters&#8217;<br \/>\nlist and Share Certificate, which was in his name, has been<br \/>\ntransferred in the name of other person by creating forged documents.<br \/>\nIt was further alleged that even the Share Certificate, which was in<br \/>\nthe name of Mohammed Patel has also been transferred by creating<br \/>\nforged documents. However, it appears and so stated in the<br \/>\napplication, which was not disputed by the concerned respondent that<br \/>\nthe Share Certificate was still in the name of the original<br \/>\ncomplainant and his name was deleted from the voters&#8217; list after<br \/>\nfollowing due procedure and it is required to be noted that<br \/>\nsubsequently election petition was also filed.\n<\/p>\n<p>\t\tSo<br \/>\nfar as allegation with respect to transferring the Share Certificate<br \/>\nof Mohammed G. Patel is concerned, he has filed affidavit by<br \/>\nsubmitting that Share Certificate is continuing in his name. It<br \/>\nappears that the petitioner has not committed any offence as alleged<br \/>\nin the impugned FIR. At the relevant time, there was election<br \/>\ndispute, for which, election petition was filed and the impugned<br \/>\ncomplaint has been filed with malafide intention and, therefore, it<br \/>\nappears to the Court that this is a fit case to exercise the power<br \/>\nunder Section 482 of the Code of Criminal Procedure and to quash and<br \/>\nset aside the impugned FIR.\n<\/p>\n<p>6.\t\tIn<br \/>\nview of the above and for the reasons stated hereinabove, the present<br \/>\napplication succeeds and the impugned FIR being C.R.No.I-116 of 2004<br \/>\nregistered with Kodinar Police Station filed by respondent No.2<br \/>\nherein for the offences punishable under Sections 406 and 465 of the<br \/>\nIndian Penal Code is hereby quashed and set aside so far as the<br \/>\npresent petitioner is concerned.
