SHAH\n\t\t\n\t\n\n \n\nDate\n: 03\/08\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tPresent<br \/>\npetition under Article 226 of the Constitution of India has been<br \/>\npreferred by the petitioner for execution of the order passed by the<br \/>\nlearned Family Court, by which the order of maintenance has been<br \/>\npassed in favour of the petitioner.  It is not in dispute that<br \/>\npetitioner has already initiated the proceedings before the Family<br \/>\nCourt for recovery of the amount as provided under the provisions of<br \/>\nthe Code of Criminal Procedure, 1973 by way of recovery application<br \/>\nas well as the warrant has also been issued, hence, present petition<br \/>\nis not entertained.  Even otherwise, for execution of the order<br \/>\npassed by the learned Family Court, petition under Article 227 of the<br \/>\nConstitution of India is not maintainable and\/or is not required to<br \/>\nbe entertained.
