No.4078 of 2011\n                                  YOGENDRA PRASAD .\n                                             Versus\n                                 THE STATE OF BIHAR .\n                                           -----------\n<\/pre>\n<p>03   26.03.2011             It is pointed out by learned counsel appearing for<\/p>\n<p>                  the petitioner in Cr. Misc. No. 3955 of 2011 that in prayer portion<\/p>\n<p>                  of his application in place of Additional Chief Judicial<\/p>\n<p>                  Magistrate, Patna City, it has wrongly been typed as Chief<\/p>\n<p>                  Judicial Magistrate, Patna.\n<\/p>\n<p>                                Learned counsel for the petitioner is permitted to<\/p>\n<p>                  make necessary correction in prayer portion of his application<\/p>\n<p>                  within course of the day.\n<\/p>\n<p>                                All the above stated petitions are taken enbloc as<\/p>\n<p>                  the above stated petitions have arisen out of Agamkuan P.S. Case<\/p>\n<p>                  No. 195 of 2010, initially, registered under Section 394 of the<\/p>\n<p>                  Indian Penal Code and subsequently, Sections 395, 397 and 412<\/p>\n<p>                  of the Indian Penal Code were also added and accordingly, all the<br \/>\n above stated petitions are being disposed of by this common<\/p>\n<p>order.\n<\/p>\n<p>              Supplementary affidavit is filed on behalf of the<\/p>\n<p>petitioner in Cr. Misc. No. 1623 of 2011.\n<\/p>\n<p>              Heard all the learned respective counsels appearing<\/p>\n<p>in the above stated petitions as well as learned Additional Public<\/p>\n<p>Prosecutor for the State.\n<\/p>\n<p>              Admittedly, petitioners are not named in the first<\/p>\n<p>information report nor they have been put on Test Identification<\/p>\n<p>Parade. It is stated that except petitioner in Cr. Misc. No. 3955 of<\/p>\n<p>2011, some looted cash have been recovered from possession of<\/p>\n<p>all the petitioners. It is evident from perusal of the impugned<\/p>\n<p>order as well as submissions of the parties that except petitioners<\/p>\n<p>in Cr. Misc. No. 3955 of 2011 and 4006 of 2011, sons of rest<\/p>\n<p>petitioners have been made accused in this case. It also appears<\/p>\n<p>from submissions of the parties that name of petitioner in Cr.<\/p>\n<p>Misc. No. 4006 of 2011 transpired in this case on the basis of<\/p>\n<p>information supplied by spy of the police and subsequently, the<\/p>\n<p>above stated petitioner made his confessional statement<\/p>\n<p>disclosing the names of his associates and, thereafter, raid was<\/p>\n<p>made on the houses of accused persons of this case.<\/p>\n<p>              Although, some looted cash has been recovered<\/p>\n<p>from the house of petitioner in Cr. Misc. No. 1623 of 2011 but<\/p>\n<p>even if, the confessional statement of co-accused, namely, Bittu<\/p>\n<p>@ Gaurav Nishant is taken, then also, the petitioner in Cr. Misc.<\/p>\n<p>No. 1623 of 2011 has not taken active part in committing the<br \/>\n           alleged crime.\n<\/p>\n<p>                        So far as petitioner in Cr. Misc. No. 2884 of 2011<\/p>\n<p>          and petitioner in Cr. Misc. No. 4078 of 2011 are concerned, the<\/p>\n<p>          case of above stated petitioners is same to the case of petitioner<\/p>\n<p>          in Cr. Misc. No. 1623 of 2011.\n<\/p>\n<p>                        Although, petitioner in Cr. Misc. No. 3955 of 2011<\/p>\n<p>          is said to be associate of petitioner in Cr. Misc. No. 4006 of 2011<\/p>\n<p>          but it appears that except the confessional statement of co-<\/p>\n<p>          accused, there is nothing against him. Admittedly, nothing has<\/p>\n<p>          been recovered from his conscious possession.<\/p>\n<p>                        Petitioner in Cr. Misc. No. 4006 of 2011 has made<\/p>\n<p>          his confessional statement and on the basis of his confessional<\/p>\n<p>          statement, some looted cash said to have been recovered from his<\/p>\n<p>          conscious possession but there is nothing on the record to show<\/p>\n<p>          this fact that the seized cash was looted property except this fact<\/p>\n<p>          that the seized notes were signed by injured of this case. It is hard<\/p>\n<p>          to believe that all the looted cash were signed by the above stated<\/p>\n<p>          injured of this case.\n<\/p>\n<p>                        Taking into consideration the above stated facts<\/p>\n<p>          and circumstances of the case as well as submissions of the<\/p>\n<p>          parties, let the above named petitioners be released on bail on<\/p>\n<p>          furnishing bail bonds of Rs. 10,000\/- (Ten Thousand) each with<\/p>\n<p>          two sureties of the like amount each to the satisfaction of<\/p>\n<p>          Additional Chief Judicial Magistrate, Patna City in connection<\/p>\n<p>          with above stated Agamkuan P.S.
