efzhaneement of compensation by challenging the Judgment<\/p>\n
 .. and ‘respective awards passed in the respective claim<\/p>\n
A’ =._”pe+..i’uons dated 31.3.2006 by MACT, Maddur.
\n;2. The facts Of the case which are no longer in dispute<\/p>\n
are that the claimants were travelling in a Maxicab bearing<\/p>\n
\u00abE:\n<\/p>\n

\nregistration No.KA~13\/ 2818 from Mandya to Maddur when
\nthe driver of the maxi cab drove the same in a rash and
\nnegligent manner and dashed against a lorry bearing
\nregistration No. ADP’ 7116, as a result of <\/p>\n
sustained injuries and they were shifted to <\/p>\n
treatment. Contending that they had suffelre-:1lisermanlenth,<\/p>\n
disability, they filed their respecAtiVe_.,claira_p petition l<\/p>\n
compensation on various heads.\n<\/p>\n
3. After service of not_ic’e._ front the ‘friE5u’r1al the<\/p>\n
respondents appeared and conttested-the mlatte.r..\/I<\/p>\n
4. thin tsnpportlqolf”–t_h’eir=’ case, the claimants examined<\/p>\n
themselves xartcigot. lniarked their respective documents.<\/p>\n
docter”W’as also examined. On the basis of the<\/p>\n
 s_a”i’d  the Tribunal awarded compensation of<\/p>\n
‘7R;’s’;4.2,o0e’i;Vf.ar:’ in MVC.No.867\/2000, Rs.61,000\/– in<\/p>\n
i\\\/IVL?.i\\lo.868\/2000, Rs.56,000\/– in lVIVC.No.869\/2000,<\/p>\n
 AVVf{‘s-42,000\/– in MVC.No.870\/2000 and Rs.35,000\/~ in<\/p>\n
lfMVC.No.871\/2000 with interest at 6% pa from the date of<\/p>\n
claim petition and fastened the liability on the insurer of the
\nmaxicab. Not being satisfied with the said award, the<\/p>\n
claimants have preferred these appeals. Since these appeals<\/p>\n
\/3:\u00bb,-\u00ab.\n<\/p>\n
arise out of the same Judgment and the claimants are
\ninjured in the Very same accident, they have been taken up<\/p>\n
together and disposed of by this common judgment.<\/p>\n
5. I have heard the learned counsel for the  and<\/p>\n
learned counsel for the respondents.<\/p>\n
6. It is submitted on behalf Zofmthe. appellants, that tile  <\/p>\n
Tribunal has awarded meager conapenslation’  the<\/p>\n
paid and suffering, loss of inoome;  l<\/p>\n
and incidental charges as weli”asfnn”-loss of amenities. That<\/p>\n
in 4oomp.e:nsati.onl has been awarded in all the
\ncaseslwithout’  ‘injtU.:aecount the injuries sustained by
\nthe _ respeletiyve .el,ainiant; therefore, these are fit cases for<\/p>\n
enhancement of lcoriipensation.\n<\/p>\n
\u00bb  .,VPer’\u00ab._e*ontra, learned counsel for the respondent<\/p>\n
H  ‘liompany supporting the Judgment and Award<\/p>\n
su’bmitted”that the award made in each of these cases is just<\/p>\n
  proper, which does not call for interference and<\/p>\n
\ufb02therefore, these appeals ought to be dismissed. g<\/p>\n

8. After hearing the learned counsel on both sides, the
\nonly point that arises for my consideration is as toowhether<\/p>\n
the appellants are entitled to enhanced compensatioVi;;\u00a7;”‘j.,,<\/p>\n
9. The claimant in Mvo.No.s69\/2000 sust-aine’d.’<\/p>\n
of right clavical and there was tenderness”‘ <\/p>\n
lumbar region. She was treatecl’\u00bb.:for::’th.e’ fracture ofisc\u00e9agg-vula <\/p>\n
and was an impatient for \ufb01ife’\u00ab.\u00a2;lays and 1.vasiva’clir\u00a2iseg3 bed rest<\/p>\n
and follow-up treatment. According to.P\\l\\f.6:~DoCtor she is
\nsuffering from perrnarieiit 1;i_hysioal.._disahi1ity of 20% in the
\nright hand. On the  of  the Tribunal<\/p>\n

10. In ‘respect of MVC.No.867\/2000, the claimant has<\/p>\n
 is sustained fracture of right wrist, tenderness over right chest<\/p>\n
‘  fracture of lower end of right ulna bone. According to<\/p>\n
Vthe doctor she is suffering from 20% permanent physical<\/p>\n
\u00a3-\n<\/p>\n
disability to the right hand. The Tribunal awarded
\ncompensation of Rs.42,000\/ — in the following manner’:<\/p>\n
\n\nPain & suffering Rs.  ~ 2\nLoss of future earning capacity    \nMedical Expenses      \n\nLoss of amenities    V'  T\n\n<\/pre>\n
11. In respect of MVC.Noi.l8fl3:8,\/.200(l)’*the  claimant had
\nsustained injury to    upper lip, swelling
\non the right anlde andA..f.f::f_1der’ri_les_S orivth:e{_h’ip portion. As per<\/p>\n
X–Ray there?__’wa;s.iractnre. and’l_sh_e”l?1ad–wtaken treatment. The<\/p>\n
doctor opinedlthat\u00ab..:there.llwas 30% disability. However,
\nthe T\ufb01h\ufb01nal has the disability at 15% of the whole<\/p>\n
body and’ awarded’. cornpensation of Rs.61,000\/– in the<\/p>\n
‘ V’  f’o.llo\\\ufb01ii.338 “n.1aI1nelr”:’ “”” <\/p>\n
V  \u00e9ain  Rs. 10.000\/ –\n<\/p>\n
l ‘Loss of earning capacity Rs.45,000\/–<\/p>\n
Medical Expenses Rs. 3,000\/~<\/p>\n
  of amenities ‘ Rs. 3,000\/-\n<\/p>\n
 12. MVC.No.871\/2000 is filed by a minor claimant in<\/p>\n
respect of the injuries sustained in the accident namely<\/p>\n
fracture of superior rarnus of right pubic bone. The doctor<\/p>\n

was examined in the matter and the permanent physical
\ndisability was assessed at 15%. The Tribunal hasipawarded
\ncompensation of Rs.35,000\/~ in the    .<\/p>\n

And no award was made towards loss of amenities.<\/p>\n
13. From theppmaterialion ‘ispV—apparent that the
\naccident   ‘.1,\/\/1’9′.31′.\u00a7.l The claimants in
\nMvc.No.s09 308\/2000 are agricultural
\nhas taken daily income at
\n piper ::wh’1le_:”assessing loss of future earning<\/p>\n
capacity,  ..I..’–fin’d son the lower side. Taking Rs.80\/~<\/p>\n
   as the daily’ income and Rs.2,400\/– as the monthly<\/p>\n

applying the appropriate multiplier after deducta? the<\/p>\n

and suffering, loss of amenities as well as medical expenses<\/p>\n
as stated stereo typed awards have been made and lower<\/p>\n

17. As far as the appellant in MFA.No.11268\/2006 is<\/p>\n
concerned, a sum of Rs.50,000\/– along with pr0portiQrla:te_V<\/p>\n
interest shall be kept in fixed deposit in any  <\/p>\n
Bank until he attains 2} years of age. 3″<\/p>\n
compensation shall be released to the e. e <\/p>\n
guardian of the appellant to be nti..liseddf0r”the  bf <\/p>\n
minor appellant.\n<\/p>\n
18. For the aforesaid reasVc_)ns,V  are allowed in
\npart. Since  petiticnilras’ dis.inis_sed as against the
\nOriental Insul*an\u00bb-are the liability fastened<\/p>\n
