Application No. 283 of 2009 dated 22.6.2009 by which<br \/>\nthe learned Judge rejected the application for cancellation of bail<br \/>\nunder Section 439(2) of the Code of Criminal Procedure and directed<br \/>\nto issue non-bailable warrant against the applicant.\n<\/p>\n<p>3.\tLearned<br \/>\nadvocate Mr NS Sheth for the applicant submitted that the complaint<br \/>\nwas lodged on 9.1.2009 and the applicant was arrested on 24.3.2009.<br \/>\nAfter the period of remand, the applicant preferred bail application<br \/>\nbefore the Judicial Magistrate First Class at Unjha on 31.3.2009.<br \/>\nThe learned Magistrate was pleased to release the applicant on<br \/>\nregular bail on certain terms and conditions.  Respondent No.2 filed<br \/>\nCriminal Misc. Application No.283 of 2009 on 13.4.2009 before the<br \/>\nlearned Sessions Court, Mehsana praying for cancellation of bail<br \/>\ngranted to the applicant by the learned JMFC on 31.3.2009.<br \/>\nRespondent No.1 i.e. the State of Gujarat also filed Criminal Misc.<br \/>\nApplication No. 295 of 2009 before the learned Sessions Court,<br \/>\nMehsana for cancellation of bail.  Both the aforesaid Criminal Misc.<br \/>\nApplication Nos. 283 and 295 of 2009 were allowed by the learned<br \/>\nAdditional Sessions Judge, Mehsana Camp at Visnagar by order dated<br \/>\n22.6.2009. Being aggrieved by the aforesaid order dated 22.6.2009,<br \/>\nthe applicant has preferred the present Revision Application.\n<\/p>\n<p>4.\tLearned<br \/>\nadvocate for the applicant submitted that the order passed by the<br \/>\nlearned Additional Sessions Judge is contrary to the facts and<br \/>\nevidence on record of the case.  The learned Judge has misread the<br \/>\nevidence on record for the purpose of considering the prima facie<br \/>\ncase against the applicant. The learned Judge committed grave error<br \/>\nin holding that the alleged offence would have serious effect on the<br \/>\nsociety as police had not recovered Muddamal articles in question.<br \/>\nThe learned Judge ought to have held that the applicant had not<br \/>\ncommitted breach of the conditions imposed by the learned Magistrate<br \/>\nand therefore, there was no reason to interfere with the order passed<br \/>\nby the learned Magistrate.  The learned Judge ought to have<br \/>\nappreciated the provisions of Section 439(2) of the Code of Criminal<br \/>\nProcedure in its true perspective while cancelling the bail granted<br \/>\nto the applicant by the learned Magistrate.  Thus, it is submitted by<br \/>\nthe learned advocate for the applicant that the provisions of Section<br \/>\n439(2) is very clear.  If breach of conditions imposed by the Court<br \/>\nis committed by the applicant or the order is ex-facie, illegal or<br \/>\nperverse, then, in such circumstances, the Court can interfere with<br \/>\nthe order passed by the Court below granting bail.\n<\/p>\n<p>5.\tThe<br \/>\nlearned advocate for the applicant has placed reliance on the<br \/>\njudgment rendered in the case of Narendra<br \/>\nK. Amin Vs. State of Guajrat and another, reported<br \/>\nin 2008 (13)<br \/>\nSCC 584 and submitted that parameters for the grant<br \/>\nof bail as well as for cancellation of bail are quite different.  The<br \/>\nCourt while dealing with the cancellation of bail application is<br \/>\nrequired to find whether irrelevant material of substantial nature<br \/>\nwas taken into account or relevant material omitted from<br \/>\nconsideration, while granting bail.  If so, then, the order granting<br \/>\nbail would be perverse and justifying the cancellation. Thus, the<br \/>\nlearned advocate for the applicant submitted that considering the<br \/>\nreasonings given by the learned Judge, the provisions of Section<br \/>\n439(2) have not been properly appreciated by the learned Judge and<br \/>\ntherefore, the order cancelling the bail deserves to be quashed and<br \/>\nset aside.\n<\/p>\n<p>6.\tLearned<br \/>\nAdditional Public Prosecutor, Ms Krina P Calla for the State, while<br \/>\nopposing the bail application, submitted that the applicant had<br \/>\ncommitted breach of the conditions imposed by the Trial Court and<br \/>\ntherefore, the bail was rightly cancelled by the learned Sessions<br \/>\nJudge.  The learned Judge has<br \/>\nassigned adequate reasons for cancelling the bail application of the<br \/>\napplicant. The Muddamal was not recovered during pendency of the<br \/>\nRevision Application as observed by the learned Sessions Judge and<br \/>\nthe applicant had left the premises by placing the lock on the<br \/>\npremises.  The applicant is also involved in other offence under the<br \/>\nprovisions of Negotiable Instrument Act and in spite of issuance of<br \/>\nsummons under Section 160 of the Code of Criminal Procedure, he was<br \/>\nnot available at his residence and had also locked the shop where he<br \/>\nis doing his business.  As per the reasoning given by the learned<br \/>\nSessions Judge, the applicant is involved in the offence punishable<br \/>\nunder Sections 406, 420 and 114 of the IPC and amount worth<br \/>\nRs.24,73,626\/- is at stake.\n<\/p>\n<p> Considering the aforesaid aspects, the learned Judge has rightly<br \/>\nallowed the applications filed by the complainant as well as by the<br \/>\nState and cancelled the bail granted to the applicant under Section<br \/>\n439(2) of the Code of Criminal Procedure and hence, no interference<br \/>\nis called for in the said order passed by the learned Judge and this<br \/>\napplication deserves to be dismissed.\n<\/p>\n<p>7.\tLearned<br \/>\nadvocate Mr Mahendra Trivedi for respondent No.2 submitted that the<br \/>\nlearned Judge has assigned sufficient reasons for cancelling the bail<br \/>\ngranted to the applicant.  The applicant was not found either in the<br \/>\nresidential premises or in the shop and as the applicant had<br \/>\ncommitted breach of the terms of the order of bail, the learned Judge<br \/>\nhas rightly exercised the powers for cancellation of bail as provided<br \/>\nunder Section 439(2) of the Code of Criminal Procedure.  The learned<br \/>\nadvocate for respondent No.2 submitted that considering the aforesaid<br \/>\naspects and the exhaustive reasons given by the learned Judge, no<br \/>\ninterference is called for in the order passed by the learned Judge<br \/>\nand the application deserves to be dismissed.\n<\/p>\n<p>8.\tI<br \/>\nhave heard learned advocate Mr NS Sheth for the applicant, learned<br \/>\nAdditional Public Prosecutor, Ms Krina P Calla for the State and<br \/>\nlearned advocate Mr Mahendra Trivedi for respondent No.2 at length<br \/>\nand in great detail.  I have also considered the detailed and<br \/>\nexhaustive reasons given by the learned Judge while cancelling the<br \/>\nbail application bearing Criminal Misc. Application No. 283 of 2009<br \/>\nof the applicant.  As per the reasons given by the learned Judge, the<br \/>\nMuddamal in question was not recovered till filing of the Revision<br \/>\nApplication. The applicant had left the premises and whereabouts of<br \/>\nthe applicant were not known, even summons under Section 160 of the<br \/>\nCode of Criminal Procedure was issued against the applicant. The<br \/>\napplicant was not extending full co-operation when he was arrested<br \/>\nand even subsequently, Police Inspector, Unjha Police Station had to<br \/>\nissue RPAD notice to the applicant at his New Delhi residence.<br \/>\nConsidering the aforesaid aspects and since the applicant was not<br \/>\nimmediately available either at his residence or at the business<br \/>\npremises, the learned Judge has cancelled the bail granted to the<br \/>\napplicant, exercising the powers under Section 439(2) of the Code of<br \/>\nCriminal Procedure.  It has been strenuously contended by the learned<br \/>\nadvocate that as per the arrest warrant dated 22.7.2009, the place of<br \/>\nresidence of the applicant is shown as Iqbal Gadh, Tal. Amalkat,<br \/>\nDistrict Banaskantha and he had not left either the residential house<br \/>\nor the business premises as mentioned in the reasoning given by the<br \/>\nlearned Judge.\n<\/p>\n<p>9.\tConsidering<br \/>\nthe submissions canvassed by the learned advocates and the reasonings<br \/>\ngiven by the learned Judge, I am of the view that the learned Judge<br \/>\nhas assigned sufficient and adequate reasons for cancelling the bail<br \/>\nunder Section 439(2) of the Code of Criminal Procedure.  The<br \/>\nprovisions of Section 439(2) can be invoked when a person who is<br \/>\nreleased on bail committed breach of the conditions imposed or the<br \/>\norder on the face of it, is illegal or perverse.  Thus, considering<br \/>\nthe aforesaid aspects and the reasons given by the learned Judge, I<br \/>\ndo not think that any interference is called for in the order passed<br \/>\nby the learned Additional Sessions Judge, Mehsana Camp at Visnagar<br \/>\ndated 22.6.2009 which is under challenge in the present Revision<br \/>\nApplication.
