Heard learned counsel for the petitioner and<\/p>\n<p>                   the State.\n<\/p>\n<p>                             2. During the pendency of the writ petition<\/p>\n<p>                   petitioner     superannuated    while   serving    as    Sub-<\/p>\n<p>                   Inspector of Police with the District Police, Rohtas with<\/p>\n<p>                   effect from 30.6.2009. He has filed this writ petition<\/p>\n<p>                   praying, inter alia, to direct the State-respondents to<\/p>\n<p>                   consider his case for promotion on the post of<\/p>\n<p>                   Inspector of Police as others junior to the petitioner<\/p>\n<p>                   included at Serial No. 1196, 1244, 1370, 1378 of the<\/p>\n<p>                   Gradation List have already been so promoted. Serial<\/p>\n<p>                   number of the petitioner in the Gradation-List is<\/p>\n<p>                   760(A).\n<\/p>\n<p>                             3.    By filing   counter affidavit     the   State-<\/p>\n<p>                   respondents have opposed the prayer by stating that<\/p>\n<p>                   petitioner has been promoted as Sub-inspector of<\/p>\n<p>                   Police in the year 1994 and thereafter no junior to him<\/p>\n<p>                   has been promoted as Inspector of Police.<\/p>\n<p>                             4. In the counter affidavit there is no denial of<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>         the fact that the serial number of the petitioner in the<\/p>\n<p>         Gradation-List is 760(A) as also that Serial No. 1196,<\/p>\n<p>         1244, 1370, 1378 have already been promoted as<\/p>\n<p>         Inspector of Police. In view of the fact that junior to the<\/p>\n<p>         petitioner in the Gradation List having Serial No. 1196,<\/p>\n<p>         1244, 1370, 1378 already been promoted as Inspector<\/p>\n<p>         of Police, and such fact having not been disputed in the<\/p>\n<p>         counter affidavit, I have no option but to direct the<\/p>\n<p>         State-respondents to consider the case of the petitioner<\/p>\n<p>         for promotion on the post of Inspector of Police with<\/p>\n<p>         effect from the date his juniors were so promoted.<\/p>\n<p>         Necessary consideration in this regard be made by the<\/p>\n<p>         competent authority, as early as possible, in any case<\/p>\n<p>         within a period of three months from the date of<\/p>\n<p>         receipt\/production of a copy of this order before the<\/p>\n<p>         competent authority.\n<\/p>\n<p>                  5.
