Justice K.T.SANKARAN\n\n Dated :24\/11\/2010\n\n O R D E R\n                 K.T.SANKARAN, J.\n          ------------------------------\n             W.P.(C).No.35221  OF 2010\n          ------------------------------\n     Dated this the 24th day of November, 2010\n\n\n\n\n                     JUDGMENT\n<\/pre>\n<p>    The  petitioners  were  appointed  as  HSAs in<\/p>\n<p>St.Joseph&#8217;s   Boys&#8217;   Higher    Secondary   School,<\/p>\n<p>Kozhikode.   The   District   Educational   Officer<\/p>\n<p>declined  approval  of   the  appointment  of   the<\/p>\n<p>petitioners  as   per  Exts.P10   to  P13   orders.<\/p>\n<p>Challenging those orders, the Manager filed appeals<\/p>\n<p>before  the  Deputy  Director  of   Education,  who<\/p>\n<p>dismissed the appeals, as per Exts.P14 to P16.   In<\/p>\n<p>this  Writ  Petition,  the   petitioners  challenge<\/p>\n<p>Exts.P10 to P16 orders. There is also a prayer to<\/p>\n<p>issue  a  direction  to  the  District  Educational<\/p>\n<p>Officer  to   approve  the   appointments  of   the<\/p>\n<p>petitioners and to disburse the salary and other<\/p>\n<p>monetary benefits to the petitioners.<\/p>\n<p>    2. The learned Government Pleader pointed out<\/p>\n<p>that under Rule 8A of Chapter XIV A KER, the<\/p>\n<p><span class=\"hidden_text\">W.P.(C).No.35221 OF 2010    2<\/span><\/p>\n<p>petitioners have an alternative remedy of filing<\/p>\n<p>revision before the Director of Public Instruction.<\/p>\n<p>It is not in dispute that the petitioners have an<\/p>\n<p>alternative remedy.    The learned counsel for the<\/p>\n<p>petitioners submitted that the only ground on which<\/p>\n<p>the approval was rejected was that the Rule 51A<\/p>\n<p>                           th<br \/>\nclaim put forward by the 4   respondent was pending.<\/p>\n<p>The  learned   counsel  submits  that  the  question<\/p>\n<p>                 th<br \/>\nwhether   the   4    respondent   is   entitled   to<\/p>\n<p>preferential claim under Rule 51A is pending before<\/p>\n<p>the Government.   It is also submitted that even if<\/p>\n<p>                        th<br \/>\nthe claim made by the 4    respondent is genuine, it<\/p>\n<p>would affect the appointment of only one of the<\/p>\n<p>petitioners.   It is submitted that in such a case,<\/p>\n<p>                         rd<br \/>\nthe appointment of the 3    petitioner alone need be<\/p>\n<p>declined   and   the  appointment    of  the   other<\/p>\n<p>petitioners could be approved.      This contention<\/p>\n<p>could very well be taken in revision before the<\/p>\n<p>Director of Public Instruction.<\/p>\n<p>    3. Since the petitioners have an effective<\/p>\n<p><span class=\"hidden_text\">W.P.(C).No.35221 OF 2010  3<\/span><\/p>\n<p>alternative remedy, I am not inclined to entertain<\/p>\n<p>the Writ Petition.
