No.5208\/2007 @ S.L.P.(C) No.9423\/2005<\/p>\n<p>Dr. ARIJIT PASAYAT, J.\n<\/p>\n<p>1.\tLeave granted.\n<\/p>\n<p>2.\tChallenge in these appeals is to the order passed by a<br \/>\nlearned Single Judge of the Bombay High Court, Aurangabad<br \/>\nBench dismissing the writ petitions filed by the appellant<br \/>\n(described hereinafter as `the Insurance Company&#8217;).  The<br \/>\ncontroversy lies within a very narrow compass.\n<\/p>\n<p>3.\tThe respondents were travelling in the Trolly attached to<br \/>\na Tractor as labourers. They claimed to have suffered injuries<br \/>\nbecause the Tractor with the Trolly in each case met with an<br \/>\naccident.  Petitions claiming compensation under the Motor<br \/>\nVehicles Act, 1988 (in short `the Act&#8217;) were filed along with<br \/>\napplication under Section 140 of the Act.  Order was passed<br \/>\nby the learned Additional District Judge and Ex-officio<br \/>\nMember, Motor Accident Claims Tribunal, Latur (in short `the<br \/>\nMACT&#8217;) on the principle of no fault liability. The Insurance<br \/>\nCompany took the stand that it had no liability in respect of<br \/>\nthe persons travelling in the Trolly and the owner of the<br \/>\nTractor is liable to pay compensation.  This plea was rejected<br \/>\nby the MACT.  Appeal in terms of Section 173 of the Act in<br \/>\neach case was preferred before the High Court.  Learned Single<br \/>\nJudge, prima-facie, was of the view that the appeal was not<br \/>\nmaintainable.  Nevertheless, he referred the matter to the<br \/>\nDivision Bench, which, it appears referred it to a Full Bench.<br \/>\nWhile the matter was pending consideration by the Full<br \/>\nBench, execution proceedings were filed. Therefore, writ<br \/>\npetitions were filed before the High Court.  The High Court, by<br \/>\nthe impugned order in each case, dismissed the writ petitions<br \/>\nholding that though arguable questions were involved, the writ<br \/>\npetitions did not deserve consideration.\n<\/p>\n<p>4.\tIn support of the appeals, learned counsel for the<br \/>\nappellant-Insurance Company submitted that the appeals in<br \/>\nterms of Section 173 of the Act were maintainable and in any<br \/>\nevent, the Insurance Company has no liability in respect of the<br \/>\npersons travelling in trollies attached to the Tractors.\n<\/p>\n<p>5.\tThere is no appearance on behalf of the respondents<br \/>\nwhen the matter was called.\n<\/p>\n<p>6.\tSo far as the question of maintainability aspect is<br \/>\nconcerned, the issue is concluded by a judgment of this Court<br \/>\nin Smt. Yallwwa &amp; Ors. Vs. National Insurance Co. Ltd. and<br \/>\nAnr. (2007 (8) SCALE 77).\n<\/p>\n<p>7.\tIn paragraphs 16 to 19 of the judgment, it was observed<br \/>\nas follows:\n<\/p>\n<p>16.\tThe question which is required to<br \/>\nbe considered is what would be the<br \/>\nmeaning of the term award when such<br \/>\na contention is raised. Although in a<br \/>\ngiven situation having regard to the<br \/>\nliability of the owner of the vehicle, a<br \/>\nclaim Tribunal need not go into the<br \/>\nquestion as to whether the owner of the<br \/>\nvehicle in question was at fault or not,<br \/>\nbut determination of the liability of the<br \/>\ninsurance company, in our opinion,<br \/>\nstands on a different footing.  When a<br \/>\nstatutory liability has been imposed<br \/>\nupon the owner, in our opinion, the<br \/>\nsame cannot extend the liability of an<br \/>\ninsurer to indemnify the owner,<br \/>\nalthough in terms of the insurance<br \/>\npolicy or under the Act, it would not be<br \/>\nliable therefor.\n<\/p>\n<p>17.\tIn a given case, the statutory<br \/>\nliability of an insurance company,<br \/>\ntherefore, either may be nil or a sum<br \/>\nlower than the amount specified under<br \/>\nSection 140 of the Act. Thus, when a<br \/>\nseparate application is filed in terms of<br \/>\nSection 140 of the Act, in terms of<br \/>\nSection 168 thereof, an insurer has to<br \/>\nbe given a notice in which event, it goes<br \/>\nwithout saying, it would be open to the<br \/>\ninsurance company to plead and prove<br \/>\nthat it is not liable at all.\n<\/p>\n<p>18.\tFurthermore, it is not in dispute<br \/>\nthat there can be more than one award<br \/>\nparticularly when a sum paid may have<br \/>\nto be adjusted from the final award.<br \/>\nKeeping in view the provisions of<br \/>\nSection 168 of the Act, there cannot be<br \/>\nany doubt whatsoever that an award for<br \/>\nenforcing the right under Section 140 of<br \/>\nthe Act is also required to be passed<br \/>\nunder Section 168 only after the parties<br \/>\nconcerned have filed their pleadings<br \/>\nand have been given a reasonable<br \/>\nopportunity of being heard.  A Claims<br \/>\nTribunal, thus, must be satisfied that<br \/>\nthe conditions precedent specified in<br \/>\nSection 140 of the Act have been<br \/>\nsubstantiated, which is the basis for<br \/>\nmaking an award.\n<\/p>\n<p>19.\tFurthermore, evidently, the<br \/>\namount directed to be paid even in<br \/>\nterms of Chapter-X of the Act must as<br \/>\nof necessity, in the event of non-\n<\/p>\n<p>compliance of directions has to be<br \/>\nrecovered in terms of Section 174 of the<br \/>\nAct.  There is no other provision in the<br \/>\nAct which takes care of such a<br \/>\nsituation.  We, therefore, are of the<br \/>\nopinion that even when objections are<br \/>\nraised by the insurance company in<br \/>\nregard to its liability, the Tribunal is<br \/>\nrequired to render a decision upon the<br \/>\nissue, which would attain finality and,<br \/>\nthus, the same would be an award<br \/>\nwithin the meaning of Section 173 of<br \/>\nthe Act.<\/p>\n<p>8.\tSo far as the question of liability regarding labourers<br \/>\ntravelling in trollies is concerned, the matter was considered<br \/>\nby this Court in Oriental Insurance Company Ltd. Vs. Brij<br \/>\nMohan and Ors. (2007 (7) SCALE 753) and it was held that the<br \/>\nInsurance Company has no liability.  In view of the aforesaid<br \/>\ntwo decisions of this Court, we set aside the impugned order<br \/>\nin each case and remit the matters to the High Court to<br \/>\nconsider the matters afresh in the light of what has been<br \/>\nstated by this Court in Smt.
