Learned APP waives<br \/>\nservice.\n<\/p>\n<p>2.\t\tThe applicant &#8211;\n<\/p>\n<p>convict who vide judgment and order dated 19\/5\/2010 rendered by the<br \/>\nLd. Addl. Sessions Judge, F.T.C., Morbi, in Sessions Case No. 01 of<br \/>\n2009 has been convicted for the offences punishable under sections<br \/>\n306, etc., of the IPC and sentenced to undergo imprisonment for 10<br \/>\nyears and fine, has  forwarded present application through jail<br \/>\nseeking temporary bail for period of 30 days for  harvesting of crop<br \/>\nand other agricultural work.\n<\/p>\n<p>3.\t\tThe jail remark sheet<br \/>\nforwarded with the application by the jail authority reveals that the<br \/>\napplicant convict has undergone 2 years and 9 months in jail. It<br \/>\nfurther transpires that the applicant convict has only enjoyed<br \/>\nfurlough leave once for 14 days and surrendered in time before the<br \/>\njail authority.\n<\/p>\n<p>5.\t\tConsidering the facts<br \/>\nand circumstances of the case, the  application is allowed in part.<br \/>\nThe applicant convict is ordered to be released on  temporary bail<br \/>\nfor the period of 15 [fifteen] days from the date of his actual<br \/>\nrelease, upon furnishing personal bond in the sum of Rs.5,000\/-<br \/>\n[Rupees five thousand only] before the jail authority on usual terms<br \/>\nand conditions.
