Bodh Gaya, District- Gaya....\n                                                       ..Petitioner\n                                      Versus\n            The State Of Bihar.....\n                                                ...Opposite Party\n                                    .................\n<\/pre>\n<p>            For the Petitioner     : Mr. Rashid Izhar, Advocate<br \/>\n            For the State          : Mr. Ram Priyasharan Singh, A.P.P<br \/>\n                                   &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.\n<\/p>\n<p>3   19.10.2011                   Heard learned counsel for the petitioner<\/p>\n<p>                     and the learned A.P.P. for the State and also<\/p>\n<p>                     perused the report kept at Flag- A.<\/p>\n<p>                                 The petitioner seeks bail in a case<\/p>\n<p>                     registered for the offence under Section 395 of the<\/p>\n<p>                     Indian Penal Code.\n<\/p>\n<p>                                 Petitioner&#8217;s prayer for bail has been<\/p>\n<p>                     rejected twice, firstly vide order dated 22.05.2009<\/p>\n<p>                     passed in Cr.Misc. No. 17659 of 2009 and again<\/p>\n<p>                     vide order dated 19.01.2011 passed in Cr. Misc.<\/p>\n<p>                     No. 30583 of 2010, copy of the orders have been<\/p>\n<p>                     appended as Annexure- 1 series.\n<\/p>\n<p>                                 It has been submitted on behalf of the<\/p>\n<p>                     petitioner that he is in custody since 05.07.2008,<br \/>\n<span class=\"hidden_text\">               2<\/span><\/p>\n<p>i.e., more than three years. However, from the<\/p>\n<p>report kept at Flag- A, it appears that the trial has<\/p>\n<p>not commenced as yet, as the dates are being fixed<\/p>\n<p>for appearance of the absentee accused. Learned<\/p>\n<p>counsel for the petitioner also submitted that co-<\/p>\n<p>accused, namely, Vijay Das has already been<\/p>\n<p>granted bail by another Bench of this Court.<\/p>\n<p>            Having regard to the facts and the<\/p>\n<p>circumstances of the case, the petitioner, Radhey<\/p>\n<p>Paswan, is directed to be released on bail on his<\/p>\n<p>furnishing bail bond of Rs.10,000\/-(Rupees Ten<\/p>\n<p>Thousand) with two sureties of the like amount<\/p>\n<p>each to the satisfaction of the S.D.J.M.,<\/p>\n<p>Sherghati, Gaya in connection with Amas P.S.<\/p>\n<p>Case No.82\/2008 with a further condition that<\/p>\n<p>one of the bailors of the petitioner must be the<\/p>\n<p>close relative of his family member, who will<\/p>\n<p>file affidavit before the court below giving full<\/p>\n<p>genealogy showing his or her relationship with<\/p>\n<p>the petitioner.
