DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 01\/12\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\t\tThis<br \/>\napplication is preferred by the accused-applicants against whom<br \/>\noffences have been registered under sections 306 and 114 of IPC on<br \/>\n6.10.2010 before Naroda Police Station being CR.I- No.12 of 2001.\n<\/p>\n<p>2.\t\tThe<br \/>\napplicants who preferred  bail applications earlier on 2.8.2010<br \/>\nbefore this  court by filing Criminal Misc. Application No. 8126\/2010<br \/>\ncame to be  withdrawn.  Subsequently, as per order dated 17.9.2010<br \/>\npassed in Criminal Misc. Application No.10429 of 2010, the applicants<br \/>\nwere granted temporary bail on the ground that father of the<br \/>\napplicants was hospitalised and the above period of 15 days was over<br \/>\nand the applicants surrendered in time.\n<\/p>\n<p>3.\t\tLearned<br \/>\nAdvocate for the applicants submits that now the marriage of two<br \/>\ndaughters of applicant No.1 is scheduled on 12.12.2010 at his native<br \/>\nplace at Deusana, Taluka Kadi, District Mehsana and, therefore, both<br \/>\nthe applicants be granted temporary bail for a period of 30 days.  It<br \/>\nis further submitted that the factum about the marriage of the<br \/>\ndaughters of applicant No.1 is verified by  the office of the<br \/>\nSuperintendent of Police,  Mehsana and it is reported that there is<br \/>\nno likelihood of disturbance of any law and order but if the<br \/>\napplicants are granted temporary bail,  who are involved in a serious<br \/>\ncrime, no recommendation has been made to grant  any temporary bail.\n<\/p>\n<p>4.\t\tIt<br \/>\nis to be taken note that the District Superintendent of Police,<br \/>\nMehsana has verified the factum of the marriage of  the applicants&#8217;<br \/>\ndaughters &#8211; Asha and Rekha scheduled on 12.12.2010 at their<br \/>\nnative place. However, it is further opined that there is no<br \/>\nlikelihood  of breach of public order or tranquility if they are<br \/>\ngiven temporary bail but considering  the gravity of  offence, they<br \/>\nmay not be granted temporary bail.\n<\/p>\n<p>5.\t\tHowever,<br \/>\nconsidering the the above, I am of the  opinion that when the<br \/>\nmarriage of the daughters is scheduled on 12.12.2010 along with other<br \/>\nceremonies attached with and there is no likelihood of breach of<br \/>\npublic order or tranquility, I am inclined to grant  them temporary<br \/>\nbail for a period from 07th December to 14th December, 2010.  The<br \/>\napplicants are  ordered to be enlarged on temporary bail for the<br \/>\nabove period on their executing  personal bond in the sum of Rs.<br \/>\n2,000\/- each to the satisfaction of the jail authority and on usual<br \/>\nterms and conditions. On completion of the bail period, they shall<br \/>\nsurrender to the jail authority in time. Rule is made absolute<br \/>\naccordingly.\n<\/p>\n<p>\t\t\t\t\t\t\t[ANANT<br \/>\nS.
