Mr. Pathak waives service of notice of rule for<br \/>\nrespondent No.1.  Having regard to the facts of the case, the<br \/>\npetition is taken-up for final disposal today.\n<\/p>\n<p>2.\tThe<br \/>\nquestion that arises in this petition is, whether an employee, who is<br \/>\ntransferred from one District to another, would be entitled for<br \/>\ncontinuity of service for the purpose of grant of higher grade<br \/>\npay-scale.\n<\/p>\n<p>3.\tHeard<br \/>\nthe learned advocate Mr.Gadhavi for the petitioner and learned<br \/>\nA.G.P.Mr.Pathak for the State.\n<\/p>\n<p>4.\tThis<br \/>\nvery question arose before this Court in Special Civil Application<br \/>\nNo. 1446\/1994 and allied matters, where a coordinate Bench of this<br \/>\nCourt, by judgment dated 12.03.2009, has answered the question in the<br \/>\naffirmative.\n<\/p>\n<p>5.\tThere<br \/>\nis no dispute amongst the parties before this Court that if the<br \/>\npetitioner&#8217;s service at the Districts where-from he came to be<br \/>\ntransferred, is considered, he would be eligible to the benefits of<br \/>\nhigher grade pay-scale as per the Resolution. In this view of the<br \/>\nmatter, the case is squarely covered by the said judgment.\n<\/p>\n<p>6.\tThis<br \/>\npetition is, therefore, allowed. The services rendered by the<br \/>\npetitioner at the Districts from which he was transferred, shall be<br \/>\ntaken into consideration by the respondent-authorities for computing<br \/>\ncontinuity of service for the purpose of grant of higher grade<br \/>\npay-scale. Needless to add that the petitioner would be paid the<br \/>\narrears of the benefits of higher grade pay-scale at the earliest,<br \/>\npreferably within a period of three months from the date of receipt<br \/>\nof writ of this judgment, but, not later than four months, in any<br \/>\ncase. Rule is made absolute. D.S.
