That was refused<\/p>\n<p>  by the first respondent on grounds referable to a DTP scheme.<\/p>\n<p>  The petitioner moved this Court.                    He was relegated to<\/p>\n<p>  alternate statutory remedy. When the petitioner moved the<\/p>\n<p>  Tribunal for Local Self Government Institutions, it was held<\/p>\n<p>  that the appeal was beyond time and even beyond the period<\/p>\n<p>  that could be condoned. Hence, the petitioner challenges the<\/p>\n<p>  decision rejecting the building permit application on grounds<\/p>\n<p>  referable to the DTP scheme as also the decision of the<\/p>\n<p>  Tribunal for LSGI rejecting the appeal on ground of delay.<\/p>\n<p>2.Having lost an earlier round before this Court on the ground<\/p>\n<p>  that the petitioner has alternate remedies, she stood confined<\/p>\n<p>  to seek relief before the Tribunal for LSGI. The appeal was<\/p>\n<p>  found to be beyond time and even beyond the period that could<\/p>\n<p>WPC.12441\/09<\/p>\n<p>                            Page numbers<\/p>\n<p>  be condoned in terms of the rules. The rules and provisions<\/p>\n<p>  governing the period of limitation are not under attack in this<\/p>\n<p>  writ petition.   Obviously therefore, the Tribunal cannot be<\/p>\n<p>  found fault with for having acted in terms of an existing statute<\/p>\n<p>  law, including existing rules. So long as the statutory<\/p>\n<p>  provisions governing alternate remedy, including statutory<\/p>\n<p>  rules exists, the challenge of the petitioner to the order of the<\/p>\n<p>  Tribunal fails. That having failed, the petitioner cannot be<\/p>\n<p>  permitted to challenge the order rejecting the application for<\/p>\n<p>  building permit since that will be by-passing the statutory<\/p>\n<p>  remedy which,      not only been invoked but has been lost.<\/p>\n<p>  Therefore, I do not find any ground to interfere with the<\/p>\n<p>  impugned order.\n<\/p>\n<\/p>\n<p>3.However, as of now, in the judgment issued today in W.P(C).<\/p>\n<p>  17413\/09, this Court has held that the DTP scheme is<\/p>\n<p>  inoperative and oppressive.      Hence, any application of the<\/p>\n<p>  petitioner for building permit, made de novo, will have to be<\/p>\n<p>WPC.12441\/09<\/p>\n<p>                           Page numbers<\/p>\n<p> considered under the changed circumstances. It is directed<\/p>\n<p> that if the petitioner files an application for building permit<\/p>\n<p> under the changed circumstances, the municipal authorities<\/p>\n<p> will consider such application in accordance with law as it now<\/p>\n<p> stands.
