        Petitioner is the accused in C.C.215 of 1999 on the file<\/p>\n
of Judicial First Class Magistrate-I, Nedumangad, a complaint<\/p>\n
filed by first respondent alleging an offence under section 138 of<\/p>\n
Negotiable Instruments Act, and after trial, convicted            and<\/p>\n
sentenced him for the offence under section 138 of Negotiable<\/p>\n
Instruments Act on 31.10.2000. Petitioner did not file an appeal<\/p>\n
challenging the conviction.            First respondent filed Criminal<\/p>\n
Revision Petition 1066 of 2000 before this Court challenging the<\/p>\n
inadequacy of the sentence.             This court as per order dated<\/p>\n
19.3.2007 set aside the sentence and remitted the matter to the<\/p>\n
learned Magistrate to reconsider the sentence and to pass<\/p>\n
appropriate order holding that the sentence imposed was<\/p>\n
inadequate. Learned Magistrate thereafter heard the petitioner<\/p>\n
and first respondent and sentenced him to imprisonment till<\/p>\n
rising of the Court and a fine of Rs.1,000\/- and in default simple<\/p>\n
imprisonment for three weeks and also a compensation of<\/p>\n
Rs.50,000\/- under section 357(3) of Cr.P.C. Petitioner filed Crl.<\/p>\n

Appeal 780\/2007 before Sessions Court, Thiruvananthapuram.<\/p>\n
Learned Sessions Judge dismissed the appeal finding that<\/p>\n
petitioner is not entitled to challenge the conviction as he did<\/p>\n
not file an appeal against the conviction and remand was only<\/p>\n
for the purpose of awarding appropriate sentence. According to<\/p>\n
the learned Sessions Judge, an appeal against inadequacy of<\/p>\n
sentence is only as provided under section 377 of Code of<\/p>\n
Criminal Procedure and it can only be by the State and the<\/p>\n
appeal is not maintainable. Revision is filed challenging the<\/p>\n
order.\n<\/p>\n
      2.   Learned counsel appearing for petitioner and the<\/p>\n
learned public prosecutor were heard.       In the nature of the<\/p>\n
order to be passed in this revision petition, it is not necessary to<\/p>\n
issue notice to first respondent.\n<\/p>\n
      3.   It is true that petitioner did not file an appeal<\/p>\n
challenging his conviction and sentence passed by the learned<\/p>\n
Magistrate on 31.10.2000.       The case was remanded to the<\/p>\n
Magistrate by this Court in Crl.R.P.1066 of 2000 only for<\/p>\n
awarding an adequate sentence. In such circumstances, when<\/p>\n
learned Magistrate thereafter awarded an appropriate sentence,<\/p>\n
petitioner is not entitled to challenge the conviction by filing an<\/p>\n

appeal against the said judgment. But it is different from stating<\/p>\n
that petitioner is not entitled to file an appeal at all.<\/p>\n
     4.    Section 377 of Code of Criminal Procedure deals with<\/p>\n
an appeal by the State Government against a sentence. Under<\/p>\n
sub section (1) save as otherwise provided in sub section (2), the<\/p>\n
State Government may, in any case of conviction on a trial held<\/p>\n
by any Court other than a High Court, direct the Public<\/p>\n
Prosecutor to present an appeal against the sentence on the<\/p>\n
ground of its inadequacy. Sub section (2) deals with a case<\/p>\n
investigated   by   the   Delhi    Special    Police Establishment<\/p>\n
constituted under Delhi Special Police Establishment Act,1946<\/p>\n
or by any other agency empowered to make investigation or<\/p>\n
under any Central Act other than this Code in which the case an<\/p>\n
appeal as against inadequacy is to be filed on the direction of<\/p>\n
the Central Government. Sub section 3 of section 374 deals<\/p>\n
with an appeal by a person convicted on trial by a Magistrate or<\/p>\n
Assistant Sessions Judge. It reads:\n<\/p>\n
            “Save as otherwise provided in sub-section (2),<\/p>\n
            any person,–\n<\/p><\/blockquote>\n
            (a) convicted     on    a    trial held    by  a<\/p>\n
               Metropolitan     Magistrate     or   Assistant<\/p>\n

               Sessions Judge or Magistrate of the first<\/p>\n
               class, or of the second class, or<\/p>\n<\/blockquote>\n
            (b) sentenced under section 325, or<\/p>\n<\/blockquote>\n
            (c) in respect of whom an order has been<\/p>\n
               made or a sentence has been passed<\/p>\n
               under section 360 by any Magistrate,<\/p>\n
             may appeal to the Court of Session.”<\/p><\/blockquote>\n
Section 385 provides the procedure to be followed by the<\/p>\n
appellate Court hearing an appeal if not dismissed summarily.<\/p>\n
Sub section 2 of section 385 mandates that appellate Court shall<\/p>\n
send for the records of the case if such record is not already<\/p>\n
available in that Court and thereafter hear the parties. Proviso<\/p>\n
thereto makes it absolutely clear that an appeal is maintainable<\/p>\n
only against the extent or the legality of the sentence. It reads:<\/p>\n
             ” Provided that if the appeal is only as to the<\/p>\n
             extent or the legality of the sentence, the<\/p>\n
             Court may dispose of the appeal without<\/p>\n
             sending for the record”\n<\/p><\/blockquote>\n
Sub section 3 of section 385 makes that aspect further clear.<\/p>\n
It reads:\n<\/p>\n
             ” Where the only ground for appeal from a<\/p>\n

             conviction is the alleged severity of the<\/p>\n
             sentence, the appellant shall not, except<\/p>\n
             with the leave of the Court, urge or be heard<\/p>\n
             in support of any other ground.”<\/p>\n<\/blockquote>\n
Therefore the view taken by the learned Sessions Judge that an<\/p>\n
appeal will lie only against the conviction and not the sentence<\/p>\n
alone is not legally sustainable.    In such circumstances the<\/p>\n
finding of the learned Sessions Judge that the criminal appeal is<\/p>\n
not maintainable, is illegal.\n<\/p>\n
      5.   It is clear from the judgment of the learned<\/p>\n
Magistrate that the sentence is not legal. Apart from sentencing<\/p>\n
petitioner to imprisonment till rising of Court, a fine of<\/p>\n
Rs.1,000\/- was awarded with a default sentence of simple<\/p>\n
imprisonment for three weeks. In spite of the fact that fine<\/p>\n
forms part of the sentence, learned Magistrate has also directed<\/p>\n
payment of compensation under section 357(3) of Code of<\/p>\n
Criminal Procedure. It is per se illegal as compensation under<\/p>\n
sub section 3 of section 357, could be awarded only if fine does<\/p>\n
not form part of the sentence. When fine forms part of the<\/p>\n
sentence, compensation could be awarded only under sub<\/p>\n
section 1 of section 357, which could only the fine or its part.<\/p>\n

       Revision is allowed. Judgment of the Sessions Judge is set<\/p>\n
aside. Crl. Appeal 780 of 2007 is remanded to Sessions Judge<\/p>\n
for disposal in accordance with law, after hearing the parties.<\/p>\n
