DUMRA, DISTRICT\n                  SITAMARHI\n                                        - PETITIONER.\n                      Versus\n                  THE STATE OF BIHAR--OPP. PARTY.\n                                   -----------\n<\/pre>\n<pre>2\/   14-07-2010             Heard the parties.\n\n                            The    petitioner    apprehends    his   arrest     in    a\n\n<\/pre>\n<p>                  complaint case in which cognizance has been taken<\/p>\n<p>                  under section 498A of the Indian Penal Code and section<\/p>\n<p>                  4 of the Dowry Prohibition Act. In the complaint petition<\/p>\n<p>                  vide Annexure-1, the petitioner has been specifically<\/p>\n<p>                  named     as     accused,      being   the   husband     of        the<\/p>\n<p>                  complainant. There is allegation of demand of dowry and<\/p>\n<p>                  torture against the petitioner. From the material available<\/p>\n<p>                  on record it appears that at the intervention of the<\/p>\n<p>                  learned Sessions Judge a compromise was arrived at<\/p>\n<p>                  between    the    complainant      and   this   petitioner.    The<\/p>\n<p>                  complainant was taken to Delhi but subsequently<\/p>\n<p>                  petitioner appears to have violated the terms of the<\/p>\n<p>                  compromise and did not take care his wife properly at<\/p>\n<p>                  Delhi, as a result of which she returned to her parental<\/p>\n<p>                  house.\n<\/p>\n<p>                            It is also submitted that the petitioner is again<\/p>\n<p>                  prepared to enter into compromise and is prepared to<\/p>\n<p>                  keep the complainant as his legally wedded wife with all<\/p>\n<p>                  dignity, comfort, safety and honour.\n<\/p>\n<p>                      Be that as it may, in the facts and circumstances<\/p>\n<p>            of the case, this Court is not persuaded to accede to the<\/p>\n<p>            prayer made on behalf of the petitioner for grant of<\/p>\n<p>            anticipatory bail. It is, accordingly , rejected. The<\/p>\n<p>            petitioner   must   surrender    in   the   court   below   in<\/p>\n<p>            connection with Complaint Case No. C-1\/452\/08 within<\/p>\n<p>            a period of four weeks from today and seek regular bail, if<\/p>\n<p>            so advised, which shall be considered and disposed of on<\/p>\n<p>            its own merit without being prejudiced by the present<\/p>\n<p>            order.\n<\/p>\n<p>                     It is made clear that if the petitioner enters into<\/p>\n<p>            compromise with his wife in the meantime before his<\/p>\n<p>            surrender within a period of four weeks fixed by this<\/p>\n<p>            Court and files such a compromise petition in the court<\/p>\n<p>            below and if the court below is satisfied about the<\/p>\n<p>            bonafide of compromise between the petitioner and the<\/p>\n<p>            complainant, then in that event the prayer for bail may<\/p>\n<p>            be disposed of in terms of said compromise.<\/p>\n<p>B.Tiwary\/                       ( Birendra Prasad Verma, J )\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Bachchan Kumar vs The State Of Bihar on 14 July, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
