Advocate\n\nHon'ble Imtiyaz Murtaza,J.\n<\/pre>\n<p>Hon&#8217;ble Naheed Ara Moonis,J.\n<\/p>\n<p>Challenge in this petition is to the show cause notice dated 11.01.2010 issued<br \/>\nto the petitioner under the U.P. Control of Control of Goondas Act by<br \/>\nrespondent no. 3, i. e. Additional District Magistrate(City), Agra.<br \/>\nFrom a perusal of the notice, it would transpire that the notice has been issued<br \/>\nlisting charges firstly that he is a Goonda and has committed an offence<br \/>\ndefined under Chapters 16,17 and 22 I.P.C. Secondly, the charge against the<br \/>\npetitioner is that either no one dares to lodge the F.I.R. or give the evidence<br \/>\nagainst him. One case has been cited to prop up the invocation of the<br \/>\nprovisions of the U.P. Control of Goondas Act against the petitioner. On the<br \/>\nbasis of alleged criminal history as embodied in the notice, the action was<br \/>\ninitiated under section 3(3) of the U.P. Control of Goondas Act 1970 spelling<br \/>\nout the ground that the activities of the petitioner are causing alarm and<br \/>\ndanger to person or property or that there are reasonable grounds for believing<br \/>\nthat that such person is engaged or is about to be engaged in commission of<br \/>\nenumerated offenses or in the abetment of any such offense or is so desperate<br \/>\nand dangerous as to render his being at large hazardous to the community.<br \/>\nThe main brunt of the submissions advanced across the bar by the learned<br \/>\ncounsel for the petitioner is that the petitioner is not a habitual offender. It is<br \/>\nfurther argued that the Additional District Magistrate recited in the notice that<br \/>\nthe petitioner is indulging in offenses punishable under Chapter 16,17 and 22<br \/>\nof the Act but the petitioner has never been involved in the offences listed in<br \/>\nthe Chapters afore-stated. Another submission advanced across the bar is that<br \/>\nthe notice issued against the petitioner militates against the relevant<br \/>\nprovisions of the Control of Goondas Act inasmuch as the same do not<br \/>\ncontain &#8220;general nature of material allegations&#8221;. It is further argued that<br \/>\nthe notice has been issued in a routine manner.\n<\/p>\n<p>Reference in connection with the grounds and submission urged before us be<br \/>\n made to two decisions of the Apex Court i.e. (1) <a href=\"\/doc\/1798029\/\">Kabir Chawla V. State of<br \/>\nU.P. and others<\/a> 1994 SCC (Crl) 577 and (2) <a href=\"\/doc\/566805\/\">State of U.P. V. Chandra<br \/>\nShekhar Shukla<\/a> (2000) 9 SCC 392. <a href=\"\/doc\/1798029\/\">In Kabir Chawla V. State of U.P. and<br \/>\nothers<\/a> (suprs), wherein the Apex Court taking exception to the order of the<br \/>\nHigh Court quashing the notice observed that there is no ground for quashing<br \/>\nthe said proceedings at the stage of listing show cause notice. It appears from<br \/>\nthe said decision that the petitioner in that case challenged the show cause<br \/>\nnotice issued by the District Authority and in the facts of that case, the, the<br \/>\nHigh Court proceeded to quash. The Apex Court made the following<br \/>\nobservations.\n<\/p>\n<p>&#8220;There is no ground for quashing the said proceedings at this stage. The<br \/>\nmatter is under consideration before the Additional District Magistrate. It is<br \/>\nopen to the petitioner to satisfy the Additional District Magistrate that no<br \/>\nground has been made out for passing the order against him. In the writ<br \/>\npetition, the petitioner has not made out a case that in issuing the show cause<br \/>\nnotice, the Additional District Magistrate was actuated by mala-fides. There<br \/>\nis, therefore no reason to assume that the Additional District Magistrate would<br \/>\nnot give a fair consideration to the matter.&#8221; (Emphasis supplied).<br \/>\nThe decision of the Apex Court in the second case <a href=\"\/doc\/566805\/\">(State of U.P. V. Chandra<br \/>\nShekhar Shukla,<\/a> (2000) 9 SCC 392) revolves round non application of mind<br \/>\nby the High Court while passing interim order. In the said case show cause<br \/>\nwas issued to the respondent under section 3(3) of the U.P. Control of<br \/>\nGoondas Act, 1970. The High Court through an interim order stayed further<br \/>\nproceedings. The State of U.P. went up in Appeal before the Apex Court. The<br \/>\nApex Court in its order held that the High Court passed the impugned interim<br \/>\norder without application of mind, mechanically and there was no justification<br \/>\nfor the High Court to pass such interim order at this stage. Ultimately, the<br \/>\nApex Court set aside the impugned order of stay granted by the High Court.<br \/>\nThe order in so far as it germane to the controversy involved in this petition is<br \/>\nquoted below.\n<\/p>\n<p>&#8221; On a notice being issued to the respondent to show cause under the<br \/>\nprovisions of Section 3(3) of the U.P. Control of Goondas Act, 1970, a writ<br \/>\npetition was filed and the High Court by the impugned order, without<br \/>\napplication of mind mechanically has passed order of interim stay of the<br \/>\nfurther proceedings. We see no justification for the High Court to pass such<br \/>\n interim order at this stage. This appears to us to be a total non-application of<br \/>\nmind by the High Court while passing the interim order. We, therefore, set<br \/>\naside the impugned order of stay granted by the High Court and allow this<br \/>\nappeal accordingly. &#8221; (Emphasis supplied).\n<\/p>\n<p>Be that as it may, in the above conspectus, no case is made out for<br \/>\ninterference at this stage as the matter is still inactive process of consideration<br \/>\nbefore the Additional District Magistrate and the petitioner would have ample<br \/>\nopportunity of urging his contentions as canvassed in this court before the<br \/>\nAdditional District Magistrate concerned.\n<\/p>\n<p>The petition being premature, is not sustainable and therefore, it is<br \/>\naccordingly dismissed in limine.\n<\/p>\n<p>Order Date :- 2.2.2010<br \/>\nA.
